Descri tion Finance: Council Notes: 7s_n9r9 Anonrin Itom Nn CK r CITY OF SAN -BERN..tDINO - REQUEST F(:)R COUNCIL ACTION STAFF REPORT This Public Meeting was set forth in Resolution of Intention No. 93-417 , adopted on November 15, 1993, for the purpose of discussing the matter of the proposed Assessment District for the construction of a sewer main in the Quail Canyon Area. No action can be taken at this meeting regarding the formation of the proposed assessment district and protests, if any, must be carried over to the Public Hearing on January 10, 1994. A petition was received by this office requesting the formation of an assessment district for the construction of a sewer main in the Quail Canyon Area, from property owners in the area. The assessment will include the construction of sewers and appurtenant facilities, administrative costs and the cost for the acquisition of easements. The signatures affixed to the referenced petition have been checked and found to represent the owners of 100 percent of the area of the properties liable to be assessed for the proposed construction. Included in the district are those properties from which easements will be required, but will be nil assessed. It is proposed that the construction costs will be paid for out of the sewer construction fund which will then be reimbursed through assessments over a period of 10 years. The total cost of Construction and incidental expenses has been 'I estimated at $130,584. Each of the parcels in the district would be assessed equally. The first year's assessment has been estimated to be $4,352.80 for each of the 6 parcels proposed to be assessed. This amount included interest on the unpaid balance and the assessments would decrease each year as the balance is reduced. On November 15, 1993, Resolution of Intention No. 93-417 was adopted and the Engineer's Report , on file in the office of the City Clerk, was accepted. The Resolution set forth a Public Meeting, and a Public Hearing. Yours very truly, Encl: Protest PROTEST OF THE PROPOSED BOUNDARIES TO ASSESSMENT DISTRICT NO. 1011 FORMED FOR THE CONSTRUCTION OF A SEWER MAIN IN THE QUAIL CANYON AREA by: Robert A. and Hildegard L. Longmire 1420 Quail Court San Bernardino, CA 92404 Lot 9, Tract No. 3642, Quail Hollow, in the City of San Bernardino, County of San Bernardino, State of California, as per Map recorded in Book 52, Pages 27 and 28, of Maps, Records of said County. The cost of this project to us and connecting our house to it is far more than we can afford even if the City were to put in the sewer free of charge. On July 2, 1993, in a letter to Mr. Fogassy, Department of Public Works, we withdrew from the petition to form an assessment district for the construction of a sewer main in the Quail Canyon area. We did this because the construction costs were expected to be higher than previously estimated and because a private contractor had just informed us that there was no practical or affordable way to connect with the proposed City sewer. Yet, we are still included in the proposed assessment district for reasons I do not understand. The contractor reported that it would cost $14 ,700 just to connect our house with the proposed sewer. The reason for the high cost is the odd shape of our lot. It is shaped something like an inverted frying pan with the house on the pan portion and with a long, narrow handle, containing the driveway, which reaches down to to the street, Quail Court. There is a distance of 245 feet between the sewage outlet of our house and the street while most others on the Court are about 20 feet from the proposed sewer. In addition, during the 33 years that we have lived here there have been additions to the house, retaining walls and garden walls built and a concrete driveway laid. There remains no practical way to reach the street without destroying nine trees, some of them over 30 years old, and a great amount of landscaping, sprinkler systems and the like or by chopping up the driveway. The total cost to us of obtaining a City sewer and connecting to it under the proposed assessment district would be over $58, 000. ( $43, 528, using the 10 year payment plan, plus $14 ,700 to connect. Admittedly, the interest under the 10 year plan would decrease each year but the cost to finance the $14 ,700 is not included, thus the total cost of $58, 000 is a close approximation. ) The cost of $58, 000 is far, far more than we can afford. In addition, taking out the nine trees and all the landscaping which we have so carefully planted and nurtured while living here would so mutilate the property that it would not recover during our lifetime. We are in our advanced years and had hoped to live out our lives in the environment which we have created and, now, to tear it all out is not acceptable.
