Recommended motion: 1. That the Public Hearing relative to the formation of Underground Utility District No. 22 along portions of 5th, 6th, 7th, "F", "G" and "H" Streets, be closed, and protests, if any, be overruled. 2. WINO - REQUEST FOR COUNCIL ACTION STAFF REPORT The Public Hearing was set by Resolution No. 93-409, which was adopted on 11-01-93. The Resolution creating Underground Utility District No. 22, along portions of 5th, 6th, 7th, "F" , "G" and "H" Streets, has been attached for your action. It is recommended that protests be overruled and the resolution be adopted. The proposed formation of Underground Utility District No. 22, was recommended by the City's Underground Utility District Committee at their meeting of May 5, 1993. Certain utility companies are required by Rule 20 of the Public Utilities Commission to set aside a certain portion of their revenues to finance the cost of undergrounding overhead facilities within districts established by local agencies. Each agency is allocated a certain amount of funds based upon the total number of overhead services within the agency's boundaries. The Underground Utility Committee reviews and designates areas proposed for the establishment of a district. Property owners within the district will be required to complete the undergrounding from their property lines to the service points at their own cost. No City funds will be required for this project (other than staff time) . All property owners within the proposed district and affected utility companies were mailed a notice of the public meeting, which was held on 12-06-93, and the public hearing. It is hereby found and determined pursuant to Chapter 22 13.36 of the San Bernardino Municipal Code of the City of San Bernardino, 23 and to definitions contained therein that the public necessity, health, 24 safety and welfare require the formation of an underground utility district, 25 located along said public streets as described herein, in order to remove 26 utility poles, overhead wires and associated structures and to underground 27 utilities along said portions of said streets. 28 SECTION 2. An underground utility district to be known as Underground Utility District No. 22 is hereby established in that area 11-24-93 RESOLUTION CREATING UNDERGROUND UTILITY DISTRICT NO. 22 ALONG PORTIONS OF 5TH STREET, 67 'TREET, 7TH STREET, "F" STREET, STREET AND "H" STREET 1 2 located along said portions of 5th Street, 6th Street, 7th Street, "F" Street, "G" Street and "H" Street, more particularly shown on Drawing No. 3 8771 by the Engineering Division, Department of Public Works, City of San 4 Bernardino, on file in the office of the City Clerk's office of the City of 5 San Bernardino. 6 SECTION 3. All poles, overhead wires and associated overhead 7 structures shall be removed and underground installations made in said 8 underground utility district within the following times: 9 a. Underground installation by utility companies and 10 property owners and reconnections not later than July 31, 1994. 11 b. Removal of poles, overhead wires and other associated 12 structures not later than August 31, 1994. 13 SECTION 4.
