Description) Finance: Council Notes: 75-0262 / CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Subject: Initiation of a Development Code Amendment to grant an automatic, one time, two year extension of time on Conditional Use Permits, Development Permits and Variances which were previously approved and valid as of September 13 , 1993 . Mayor and Common Council Meeting of December 20, 1993 BACKGROUND Senate Bill 428 was approved by the Governor on September 13 , 1993 . It was approved on an urgency basis because of adverse economic conditions in the construction industry. It extended the expiration date of tentative tract maps and parcel maps that had not expired on the effective date of the legislation. The City has various related development projects (Conditional Use Permits and Development Permits) which were approved concurrently with, or shortly after the tentative tract or parcel map, but which are not included in the automatic extension. Since the maps have been extended, the related projects should be also. In addition, the same economic conditions affect development projects not related to tentative tracts or parcel maps. Because of the time and cost associated with preparing plans and studies in order to get a development application processed, I feel that all approved projects should receive the same consideration. COSTS TO CITY Planning Division staff estimates that it will cost approximately $1500 for staff to complete an amendment. This does not include review by any other departments/divisions. RECOMMENDATION I recommend that Planning Division staff be directed to prepare an amendment to the Development Code to allow an automatic, one time, two year extension of time on previously approved Conditional Use Permits, Development Permits and Variances. In addition, the amendment should be retroactive to include those projects that were valid as of September 13 , 1993 . Tom Minor, Mayor
