STAFF REPORT
The San Bernardino International Airport Authority ( the "Airport
Authority") has been created to oversee the reuse of Norton Air
Force Base. In connection with the exercise of its powers, it
is presently pursuing a lease transaction with the United States
Air Force.
In accordance with the terms of the Joint Powers Law the Airport
Authority is required to follow the procedures of the County of
San Bernardino with respect to any transaction that are not otherwise
specifically contemplated under the terms of the Joint Powers
Agreement.
Under the California Government Code, a county is required to
request the approval of a municipal entity whenever it seeks to
lease property within the territorial jurisdiction of a municipal
entity. Accordingly, the Airport Authority at this time is
requesting that the City of San Bernardino approve its proposed
lease transaction with the Air Force concerning Norton Air Force
Base. The attached resolution provides the necessary approval and
waives the otherwise statutorially prescribed sixty (60) day
notification period.
It is recommended that the Mayor and Common Council approve the
attached resolution.

CITY OF SAN BERNARDINO APPROVING THE SAN
BERNARDINO INTERNATIONAL AIRPORT AUTHORITY LEASE

6 WHEREAS, the City of San Bernardino, California (the
7 "City") , is a municipal corporation and a charter city duly
8 created and existing pursuant to the Constitution and the laws of
9 the State of California; and
10
11 WHEREAS, the San Bernardino International Airport
12 Authority (the "Authority") has been created pursuant to a
13 certain agreement entitled "Joint Exercise Of Powers Agreement
14 n_
Creating An Agency To Be Know As The San Bernardino
15 International Airport Authority" (the "Agreement") in accordance
16 with California Government Code Section 6500, et sea. ; and
17
18 WHEREAS, the Authority has been in negotiations with
19 the United States Air Force in connection with the proposed lease
20 of certain property and the buildings located on Norton Air Force
21 Base ("NAFB") which is within the territorial jurisdiction of the
City; and

24 WHEREAS, pursuant to the terms of the Agreement, the
25 Authority is to follow the procedures of the County of
26 San Bernardino (the "County") in connection with the exercise of
27 any powers not specifically addressed in the Agreement; and

1 WHEREAS, in accordance with Government Code
2 Section 25351 before the County leases buildings within the
3 jurisdiction of the City it requires the consent of the City
4 thereto; and

6 WHEREAS, the Authority has requested that the City
7 consent to its entry into a long-term lease arrangement with the
8 United States Government related to certain buildings and
9 properties located on NAFB; and
10
11 WHEREAS, the City Council of the City of San Bernardino
12 (the "City Council") hereby deems it desirable to waive the sixty
13 (60) day notification period in connection with giving its
14 consent to the lease by the Authority of certain property and/or
15 buildings located on NAFB.

17 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
18 COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS:

20 SECTION 1. The recitals contained herein are true
21 and correct.

23 SECTION 2 . The Mayor and Common Council hereby
24 consents to the lease by the Authority of certain property and/or
25 buildings located on NAFB.

1 SECTION 3 . The City Council hereby waives the
2 notification requirement as provided in Subsection (d) of
3 Government Code Section 25351.

3 SECTION 4 . The findings and determinations herein
4 shall be final and conclusive. This Resolution shall take effect
5 upon the date of its adoption.
