Clark, City Clerk SUBJECT : Item 3 on Agenda of Adjourned Regular Meeting of the Mayor and Common Council - July 22 , 1996 COPIES : City Administrator Clark; City Attorney Penman; Deputy City Clerk Hartzel ------------------------------------------------------------------- BACKGROUND INFORMATION: Item Three on today' s agenda is a reconsideration of appeal of Board of Building Commissioners' Order No. 3220 relative to property located at 580 West Union Street . This item has been placed on today' s agenda to clarify the intent of the motion which was approved on Monday, July 15, 1996 and to correct the language of the motion noted on the Council summary. The motion approved on July 15, 1996, as shown on the Council summary, was : "That the matter be continued to August 5, 1996, subject to the payment of the continuance fee of $75 to be paid by 4 :30 p.m. , Friday, July 19, 1996, and if the fee is not paid, the appellant is in default and the appeal will be upheld" A review of the videotape of the July 15, 1996 Council meeting, when the item in question was voted upon, shows that the motion should have been: "That the matter be continued to the first meeting in August subject to payment of the continuation fee of $75 by 4 :30 p.m. July 19, 1996 and if the fee is not paid that the appellant is in default and the action of the Board of Building Commissioners will be upheld" The $75 continuation fee was paid on Thursday, July 18 , 1996; therefore, the matter will be on the Mayor and Council agenda for August 5 , 1996 . Honorable Mayor and Members of the City Council July 22 , 1996 Page two ACTION REQUESTED : That the Mayor and Council reaffirm the intent of their motion adopted on July 15, 1996 and that the minutes reflect that the approved motion should read: That the matter be continued to the first meeting in August subject to payment of the continuation fee of $75 by 4 :30 p.m. July 19, 1996 and if the fee is not paid that the appellant is in default and the action of the Board of Building Commissioners will be upheld.
