The Agreement provided Community Development Block Grant (CDBG) funding for the implementation of the City's Fair Housing Program. The First Amendment to the Agreement will provide $8,000 in CDBG funds to allow for the completion of the fair housing planning component of the 1995-1999 Consolidate Plan. As of February 6, 1996,jurisdictions receiving CDBG and other Federal funding must comply with the new Consolidated Submission regulations for Community Planning and Development Programs. These regulations include significant new program requirements with regard to the long-standing obligation to affirmatively further fair housing. The new regulations require: (1) conducting at the beginning of each five-year cycle (Consolidated Plan) an analysis of impediments to fair housing choice; (2) carrying out actions to overcome the effects of identified impediments and (3) maintaining records and making available information and reports, including the analysis of impediments, to document actions undertaken to eliminate identified impediments. The new regulations require the completion of the analysis of impediments 12 months after the effective date of the regulations or February 6, 1996. In order to accommodate the completion of the Consolidated Plan and the first and Second Year Action Plans, HUD has extended the due date for the analysis until August 6, 1996. Inland Mediation Board has undertaken the analysis of impediments for numerous jurisdictions throughout the Inland Empire and is the most appropriate entity to assist the City with compliance with the new regulations. The First Amendment to the Agreement will provide an additional $8,000 in 1995-1996 CDBG funds to Inland Mediation for the completion of the analysis. ------------------------------------------------------------------------------------------------------------------ REW:NJ0:1ag:06-17-01.cde COMMISSION MEETING AGENDA MEETING DATE: 06/17/19\96 Agenda Item Number: b ECONOMIC DEVELOPMENT AGENCY STAFF REPORT First Amendments - Inland Mediation/SBETA June 5, 1996 Page Number-2- ------------------------------------------------------------------------------------------------------------------ On July 1, 1995, an Memorandum of Understanding (MOU 95-107)between the City and San Bernardino Employment Training Agency(SBETA) was executed. The MOU provided Community Development block Grant (CDBG) funding for the provision of job support services for low- and moderate income job training participants. The First Amendment to the MOU will change the termination date from June 30, 1996 to September 30, 1996. SBETA has requested the extension of time to accommodate billings anticipated to be received subsequent to June 30, 1996. No additional funds have been requested. RECOMMENDATION It is appropriate for the Mayor and Common Council to approve the First Amendments to the Agreement between the City of San Bernardino and Inland Mediation Board (Agreement No. 95- 134) and between the City of San Bernardino and the San Bernardino Employment and Training Agency (MOU-95-107). City and Subrecipient agree as follows: WITNESSETH Community Development Block Grant Whereas, City and Subrecipient have previously entered into agreement# 95-134, dated July 1, 1995, referred to as ("Agreement"), for fair housing services; and Whereas, City and Subrecipient desire to amend agreement to include the subrecipient's completion of an analysis of impediments to fair housing; and Whereas, City desires to increase the amount Community Development Block Grant funding in the amount of Eight Thousand Dollars ($8,000.00)to allow Subrecipient to complete amendment. Now, therefore, in consideration of the mutual covenants herein set forth and the mutual benefits to be derived there from, the parties agree as follows: 1. Add to Section 1(b) Recitals (The revised Exhibit"A") 2. Change the first sentence in Section 2 Payments City shall reimburse Subrecipient for allowable costs incurred under the scope of this Agreement and applicable Federal regulations, which have not been paid for or reimbursement F. will be made at least on a monthly basis, with the total of all such reimbursements not to exceed $32,014. City and Subrecipient agree as follows: WITNESSETH Community Development Block Grant Whereas, City and Subrecipient have previously entered into Memorandum of Understanding 9 95-107, dated July 1, 1995, referred to as ("MOU'), for Job support services such as childcare, transportation, meals and limited medical attention for low- and moderate income job training participants; and Whereas, City and Subrecipient desire to amend agreement to extend the time for project implementation. Now, therefore, in consideration of the mutual covenants herein set forth and the mutual benefits to be derived there from, the parties agree as follows: 1. Change the language in Section 3 Term "This Memorandum of Understanding shall commence on July 1, 1995 and terminate on September 30, 1996."
