Description) Finance: Council Notes: 75-0262 AnnnAn I+nm AL, 0?/ OITY OF RAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Page 1 of 2 A motion was adopted at the Council meeting of 5-2-94 , giving consent to the formation of a Benefit Assessment District by the San Bernardino Board of Supervisors. This district was to be formed to finance the local agency share of the improvement of San Timoteo Creek, under the U. S . Army Corps of Engineers ' project to provide flooding protection for the Santa Ana River. The total estimated cost for the improvement of San Timoteo Creek is $58 Million. Seventy-Five percent (750) of this amount will be financed by the U.S. Army Corps of Engineers and ' 250 ($14 . 5 Million) by the local interests.. Due to several constraints in the Flood Control District Act, the County decided to form the district under the Municipal Improvement Act of 1913 . At their meeting of 4-18-95 , a Resolu- tion of Intention was adopted by the Board of Supervisors relative to formation of Assessment District No. 95-1 (San Timoteo Creek) . The project for the improvement of San Timoteo Creek traverses the Cities of Redlands, Loma Linda, San Bernardino and Colton. Concurrence must be given by all four (4) cities, in order for the County to proceed with formation of a 1913 Act Assessment District. A resolution supporting a 1913 Act District was considered at the Council meeting of 5-15-95 . This resolution was continued, due to concerns voiced by some property owners within the Tri-City area that their proposed assessment was not equitable. Under the original proposal, a two tiered system of assessments would be used. Properties within a flood hazard zone would pay a full assessment, and properties within the 100 year flood zone, such as Tri-City, would pay 1/2 of an assessment unit. The resolution supporting the original assessment method was tabled at the Council meeting of 6-05-95 , and the Flood Control District was asked to review the areas of potential flooding and method of spreading assessment. An amended preliminary Engineer' s Report has been prepared. This report is based upon the 100-year flood plain established by the U. S. Army Corps of Engineers and the flood risk zones as determined by the Federal Emergency Management Agency. The areas identified by these agencies are not identical, which is to be expected. The method of assessment is based on the following zones : Flood Zone Benefit Factor Non-mitigatable (Flood Hazard) 1 . 25 Mitigatable (100 Flood Plain per FERIA) 1 . 00 Shallow/Access Only (U.S . This amended report has been reviewed by the Civil Engineer for the Tri-City property owners and found to be valid. IThe reduction in flooding potential north of the freeway was achieved by taking the traffic barrier into account. This resulted in more storm water being directed to the west along Redlands Boulevard. Studies by the U. S. Army Corps of Engineers show that the storm water could flow over the Southern Pacific Railway and inundate an area to the south. This area was not included in the original district boundaries . A single family residence would receive a total assess- ment of $1 , 556 under the amended Engineer' s Report. The City of Loma Linda has adopted a resolution of support. A resolution of support will be considered by the City of Redlands on 2-20-96 , and the City of Colton on 3-5-96 . A new Resolution of Intention will be adopted by the County Board of Supervisors, to approve the amended Engineer' s Report. The proposed resolution determines that the properties within the City of San Bernardino, to be included within the boundaries of San Bernardino County Assessment District No. 95-1 for San Timoteo Creek, will be benefited by the proposed flood control improvements. Since the County cannot proceed without support from all four (4) affected cities, we recommend that the above determination be made and an indication of support given. Mr. Ken Miller, Director of Transportation Flood Control with the County of San Bernardino will be present at the Council meeting to give a presentation of the proposed assessment district.
