Description) Finance: Council Notes: Agenda Item No. SDE\drn\actform STAFF REPORT Recent federal legislation has prohibited the City from regulating the business of tow truck companies, and the City has deleted such regulations from its ordinances. The City may still contract with tow truck companies to provide tow services to the City, and the City has entered into such contracts with five local companies. However, the City has been experiencing increasing urbanization resulting in increasing need for tow services. The City deals with abandoned vehicles, both operative and inoperative, vehicles that have been in accidents and those that have been the subject of thefts. It is an ongoing job to stay ahead of the towing need. To fail to do so would result in increasing blight, disease and other health and safety problems for the City, as well as the concern about providing attractive nuisances for the children of the area. It would be beneficial for the City to add an additional tow company to the rotation list to provide a greater ability to meet these needs. Since the current resolution now limits the tow companies to one for every 40,000 residents in the City, an additional company could not be added without a change. It is therefore recommended that the resolution be amended to provide that one company per every 35,000 residents or portion thereof could be placed on the rotation list. This would have a moderate effect on the current businesses, and provide additional options for the City agencies using the rotation list. DAB/tbm [Tow.Rpt] 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING SUBSECTION 6 OF RESOLUTION NO. 95-241 3 RELATING TO THE NUMBER OF TOW COMPANIES ON THE CITY'S ROTATION LIST 4 WHEREAS, the City of San Bernardino from time to time has need for the towing of 5 vehicles, and 6 WHEREAS, the City has compiled a list of tow companies to provide said service, and 7 WHEREAS, the increased urbanization of the City has increased the need for such 8 services beyond the simple increase in population, and 9 WHEREAS, the City desires to increase its call for such services to combat the increase 10 in stolen vehicles and to reduce the blight and deleterious affect to the health and safety of the 11 City to which such vehicles contribute, and 12 WHEREAS, adding an additional tow company will assist the City in both providing 13 a better service in removing such vehicles, and also in obtaining the best service for the 14 taxpayers of the City, and 15 WHEREAS, it is therefore necessary that the number of tow companies providing such 16 service be increased, 17 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 18 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 19 SECTION 1. Subsection 6 of Resolution No. 95-241 is hereby amended to read as 20 follows: 21 "6.
