STAFF REPORT
This vacation proceeding was begun in April of 1992 and Authorization to Proceed
was approved on 05-04-92. All of the affected City Departments and public
utility companies were notified of the proposed vacation on 05-21-92 with
responses due by 06-03-92.
Due to a lack of money to continue the vacation process, this file was put on
hold in October of 1992. In August, 1995, the file was reopened by the payment
of the second 1/2 of the vacation processing fee by a "second petitioner. At this
time the scope of the vacation was increased to include property Easterly of the
original petition.
This 50 foot by 969 foot vacation consists of excess right-of-way relinquished to
the City from Caltrans in 1991. Currently, the Kendall Drive right-of-way is
over 140 feet wide (the Northerly one-half is over 101 feet wide) . The vacation
of 50.00 feet will adjust the remaining right-of-way to the current standard in
the area.
The three public utilities (GTE, SoCal Gas, and City Water) which indicated they
wanted to reserve easements during the first part of the vacation proceedings
were sent an update in October, 1995. The result was that none of these utili-
ties were now interested in retaining an easement as their utilities will be
:included within the retained right-of-way. The revised responses are attached
for your information.
All adjacent property owners will be notified of the public hearing by mail, the
street will be posted and the Resolution of Intention will be published 2 times
in the Sun, the first time at least 15 days prior to the public hearing.
On 08-07-92, a Notice of Exemption was filed with the County Board of Super-
visors, and a finding of consistency with the General Plan was made.
The second half of the $1000 administrative fee has been paid.
We recommend that the Resolution of Intention be adopted to set the public
hearing for the regularly scheduled Council Meeting of 03-04-96.
