This license allows the sale of beer and wine for off-site consumption. KEY POINTS • Section 23958.4 of the Business and Professions Code requires that a local agency make a determination that a public convenience or necessity would be served through the issuance of a alcohol license prior to its issuance by the ABC. • On August 21, 1995 the Mayor and Common Council elected to be the body that reviews and issues letters of Public Convenience or Necessity letters to the ABC. • The subject site meets the locational criteria established in the Development Code. ENVIRONMENTAL DETERMINATION Conditional Use Permit No. 95-17 has been determined to be categorically exempt (Class 1 Exemption) from the provisions of the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA guidelines pertaining to the reuse of existing facilities with only a negligible intensification in use. CUP 95-17 Mayor and Common Council meeting of January 8, 1996 Page 2 DETERNIINATION The applicant's request has been reviewed and the off-site sale of beer and wine in association with the convenience store at 1198 East Highland Avenue will not have a negative impact on the surrounding community and will serve the public convenience or necessity. The determination is based on the following findings: 1. The proposed location is an existing service station with a convenience store. The proper security and lighting will allow patrons to purchase beer and wine in a safe setting. 2. The floor area devoted to beer and wine sales is minimal and customers will benefit from the issuance of the license by being able to conveniently purchase beer and wine form among the many products sold at the convenience store. 3. The sale of alcohol is reasonable and common within most service stations/convenience stores. The inclusion of beer and wine sales will allow the service station and convenience store shoppers the same opportunities given throughout the state. 4. The Police Department has reviewed the request and does not object to the sale of beer and wine for off-site consumption. COMMENTS RECEIVED A variety of comments have been received from the residents of the surrounding neighborhoods (Exhibit 1, Attachment H). These comments (one verbal and three written) range from supporting the development to having concerns with regard to the sale of alcohol. All three letters received are supportive of the re-use of the building, however, two of these raise concerns with the off-site sale of alcohol. Mr. Phil Sousa, Director of Real Property for the Catholic Diocese, also expressed the concerns of the Diocese with respect to the off-site sales of alcohol across the street. Mr. Sousa stated that the Diocese was supportive of the re-use of the building but against the sale of alcohol at this location. PLANNING COMMISSION RECOMMENDATION The Planning Commission reviewed Conditional Use Permit No. 95-17 on November 8, 1995, and voted 6-1 to approve Conditional Use Permit No. 95-17, for the re-establishment of the service station with a convenience store and off-site beer and wine sales, and recommend that the Mayor and Common Council make a determination that a public convenience or necessity will be served by the issuance of this license. No. 95-17 Agenda Item# 1 Hearing Date: November 8, 1995 Page 2 .QUEST AND LOCATION Under authority of Development Code Section 19.06.020(Table 06.02 [B][7]&[I][1]) the applicant is requesting a Conditional Use Permit to re-establish a service station, with a convenience store and off-site beer and wine sales (Type 20 License), in a building that has been vacant greater than 180 days in the CG-1, Commercial General land use district. The subject property is located at 1198 East Highland Avenue in the CG-1, Commercial General Plan land use designation (Attachment A). BACKGROUND The existing structure on the subject site was developed in 1960 by the Richfield Oil Company. The structure has housed a variety of service stations over the last 35 years, most recently Golden Car Care which occupied the site until September of 1994. Today the building is vacant and dilapidated. On August 7, 1995, the applicant submitted an application for Conditional Use Permit No. 95-17 to re-establish the service station use under a new ownership. The Development/Environmental Review Committee (D/ERC) reviewed this project on August 24, 1995 and again on September 12, 1995. The D/ERC voted to forward this proposal to the Planning Commission. CALIFORNIA ENVIRONMF_N'fAL QUALITY ACT STATUS Conditional Use Permit No. 95-17 has been determined to be categorically exempt (Class 1 Exemption) from the provisions of the California Environmental Quality Act (CEQA) under Section 15301 of the CEQA guidelines pertaining to the reuse of existing facilities with only a negligible intensification in use. COMMENTS RECEIVED A variety of comments have been received from residents of the surrounding neighborhoods (Attachment H). These comments (two written and one verbal) range from supporting the development to having deep concerns with providing another alcohol outlet along Highland Avenue. Both letters, included as Attachment H, are in favor of the re-use of the site. It seems that the surrounding neighbors are in favor of the proposed development, but some concerns remain with the off-site alcohol sales. PROTECT AND SITE CHARACTERI TICS SurnvwOng Ama The subject property is surrounded by a variety of similar land uses. To the east, across Golden Avenue, is a retail center and vacant land that is within the CG-1, Commercial General land use district. South of the site across Highland Avenue is the new Catholic Diocese office that is located within the CG-1, Commercial land use district. To the west and north of the subject site is a small 0 C.U.P. No. 95-17 Agenda Item# 1 Hearing Date: November 8, 1995 Page 3 retail center within the CG-1, Commercial General land use district. ANALYSIS Proposed Use The applicant proposes to re-establish a service station, with a convenience store and off-site beer and wine sales. The proposed project would be open 24 hours a day, seven days a week, and employ a total of 3 employees, with one employee being on the subject site at any time. The proposal will include the alteration of the existing service bay area into a convenience store. The convenience store will occupy approximately 475 square feet of the existing 1125 square foot building. Additional building area would be used for storage, bathrooms and an office. The Development Code recognizes service stations, and convenience stores, as conditionally permitted uses in the CG-1, Commercial General land use designation. The use would then have to meet the criteria of the particular land use district. Setbacks, lot coverage, building height, parking and etc. are determined by the land use district in which the business will be located within. Parking and Landscaping Parking for the proposed use is provided on the subject property. The subject use requires 1 space for every 250 square feet of building area. Thus, the approximate 1,125 square foot building would require a total of 5 off-street parking spaces, which are provided (Attachment B). Alterations to the site, as requested by the D/ERC, include the addition of parking spaces, landscaping and a refuse enclosure. Landscaping will increase from 0% (existing) to approximately 11% as proposed. The Development Code requires a minimum of 15% landscaping unless that requirement would reduce the number of required parking spaces. The applicant has worked with staff and provided the maximum amount of landscaping without negatively impacting the required parking and circulation. Alcoholic Beverage Control License This item was submitted to the Police Department for review and comment. The report (Attachment G) that the Police Department prepared concluded that they do not object to the approval of the project as long as certain conditions of approval are added. These conditions will help to alleviate residents' concerns, and are included in Attachment I. The Development Code requires that businesses establishing off-site alcohol sales not be located within 500 feet of any religious institution, school or public park within the City; 100 feet of any property designated for residential use or used for residential purposes; and shall not be located in such close proximity to another similar use to cause over-saturation of the neighborhood. This C.U.P. No. 95-17 Agenda Item# 1 Hearing Date: November 8, 1995 Page 4 proposal meets all of the Development Code locational criteria as stated above . The site is located in an area with an over saturation of off-site Alcoholic Beverage Control (ABC) licenses and requires a determination by the Mayor and Common Council that a public convenience or necessity will be served by the issuance of the license. The applicant feels that a public convenience would be served by the issuance of the ABC license (Attachment I). General Plan Consistency The Commercial General land use designation intends to "provide for the continued use, enhancement, and new development of retail, personal service, entertainment, office and related commercial uses along major transportation corridors and intersections to serve the needs of the residents; reinforcing existing commercial corridors and centers and establishing new locations as residential growth occurs." The CG-1, Commercial General land use district permits the re- establishment of a service station, with a convenience store and off-site beer and wine sales, with the approval of a Conditional Use Permit. The General Plan contains a policy stating: It shall be the policy of the City of San Bernardino to permit "a diversity of community- serving uses (grocery stores, apparel and accessories, furniture and home furnishings, garden supplies, restaurants, bookstores, cleaning establishments, shoe repair, beauty salons/hair styling, and other similar uses), entertainment uses, and professional and financial offices in areas designated as "Commercial General"." This proposal meets the requirements of the Development Code and the General Plan as shown in Attachment C, the General Plan/Development Code Conformance Table. CONCLUSION The proposal to re-establish a service station with a convenience store and off-site alcohol sales is consistent with General Plan policy and with the applicable Development Code requirements. The use is permitted in the CG-1, Commercial General land use district subject to the approval of a Conditional Use Permit. Staff's conclusion is that the proposed use is compatible with the surrounding properties and will not result in an adverse impacts pending adherence to the Conditions of Approval (Attachment E) and Standard Requirements (Attachment F). 0 C.U.P. Approve Conditional Use Permit No. 95-17 based on the Findings of Fact (Attachment D) and subject to the Conditions of Approval (Attachment E) and Standard Requirements (Attachment F). 2. Recommend that the Mayor and Common Council make a determination that a public convenience or necessity will be served by the issuance of the Alcoholic Beverage Control Type 20 license and that a letter be sent from the Planning and Building Services Department to the Alcoholic Beverage Control. ATTACBMENT D FINDINGS OF FACT Conditional Use Permit No. 95-17 1. Whereas the proposed use is permitted in the CG-1, Commercial General land use designation, subject to approval of a conditional use permit, it is in conformance with all of the applicable provisions of the Development Code. 2. The proposed use is consistent with the General Plan, in that it meets all applicable goals objectives and policies that are set forth. 3. The approval of Conditional Use Permit No. 95-17 is in compliance with the requirements of the California Environmental Quality Act and Section 19.20.030 of the Development Code, in that the project is categorically exempt from CEQA under Section 15301 and the proposal meets all standards set forth by the Development Code. 4. There will be no potentially significant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored, in that this project does not have the possibility to have a significant negative impact on the environment since it only includes the re-use of an existing building. 5. The location, size, design, and operating characteristics of the proposed use are compatible with the existing and future land uses within the general area in which the proposed use is to be located and will not create significant noise, traffic or other conditions or situations that may be objectionable or detrimental to other permitted uses in the vicinity or adverse to the public interest, health, safety, convenience or welfare of the City, in that building is already existing and the use has been conditioned so as to not adversely impact surrounding properties. 6. The subject site is physically suitable for the type and density/intensity of use being proposed, in that the building already exists and the proposed project meets all standards set forth by the Development Code. 7. There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to the public health and safety, in that this is an existing development that is only proposing a minor change in intensity and is currently fully serviced by utilities. ATTACHMENT E CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERNUT NO. 95-17 PLANNING/BUILDING DIVISIONS 1. Within two years of development approval, commencement of construction shall have occurred or the permit/approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year, then the permit/approval shall become null an void. Projects may be built in phases if preapproved by the review authority. If a project is built in preapproved phases, each subsequent phase shall have one year from the previous phase's date of construction commencement to have occurred or the permit/ approval shall become null and void. Project : Conditional Use Permit 95-17 Expiration Date : November 8, 1997 2. The review authority may, upon application being filed 30 days prior to the expiration date and for good cause, grant one time extension not to exceed 12 months. The review authority shall ensure that the project complies with all current Development Code provisions. 3. In the event that this approval is legally challenged, the City will promptly notify the applicant of any claim or action and will cooperate fully in the defense of the matter. Once notified, the applicant agrees to defend, indemnify, and hold harmless the City, its officers, agents and employees from any claim, action, or proceeding against the City of San Bernardino. The applicant further agrees to reimburse the City of any costs and attorney's fees which the City may be required by the court to pay as a result of such action, but such participation shall not relieve the applicant of his obligation under this condition. 4. Construction shall be in substantial conformance with the plans approved by the Planning Commission. Minor modification to the plans shall be subject to approval by the Director through a minor modification permit process. Any modification which exceeds 10 % of the following allowable measurable design/site considerations shall require the refiling of the original application and a subsequent hearing by the appropriate hearing review authority, if applicable. A. On-site circulation and parking, loading and landscaping; B. Placement and/or height of walls, fences and structures; C. Reconfiguration of architectural features, including colors, and/or modification of finished materials that do not alter or compromise the previously approved theme; and, D. A reduction in density or intensity of a development project. 5. No vacant, relocated, altered, repaired or hereafter erected structure shall be occupied or no change of use of land or structure(s) shall be inaugurated, or no new business commenced as authorized by this permit until a Certificate of Occupancy has been issued by the Department. A temporary Certificate of Occupancy may be issued by the Department subject to the conditions imposed on the use, provided that a deposit is filed with the Department of Public Works prior to the issuance of the Certificate of Occupancy. The deposit or security shall guarantee the faithful performance and completion of all terms, conditions and performance standards imposed on the intended use by this permit. 6. Prior to the issuance of a Certificate of Occupancy, the landowner shall file a maintenance agreement or covenant and easement to enter and maintain, subject to the approval of the City Attorney. The agreement or covenant and easement to enter and maintain shall ensure that if the landowner, or subsequent owner(s), fail to maintain the required/installed site improvements, the City will be able to file an appropriate lien(s) against the property in order to accomplish the required maintenance. 7. This permit or approval is subject to all the applicable provisions of the Development Code in effect at the time of approval. This includes Chapter 19.20 (Property Development Standards), and includes: dust and dirt control during construction and grading activities; emission control of fumes, vapors, gases and other forms of air pollution; glare control; exterior lighting design and control; noise control; odor control; screening; signs, off-street parking and off-street loading; and vibration control. Screening and sign regulations compliance are important considerations to the developer because they will delay the issuance of a Certificate of Occupancy until they are complied with. Any exterior structural equipment, or utility transformers, boxes, ducts, or meter cabinets shall be architecturally screened by a wall or structural element, blending with the building design and include landscaping when on the ground. A sign program for all new commercial, office and industrial centers of three or more tenant spaces shall be approved by the Department prior to the issuance of a Certificate of Occupancy. This requirement also includes any applicable Land Use District Development Standards for industrial developments regarding minimum lot area, minimum lot depth and width, minimum setbacks, maximum height, maximum lot coverage, etc. 8. This development shall be required to maintain a minimum of 4 standard off-street parking spaces, and 1 van accessible space, as shown on the approved plans on file. 9. All parking areas shall have lighting capable of providing 1 foot candle across the surface of the entire parking area. Ili i 10. This permit or approval is subject to the attached conditions or requirements of the following City Departments or Divisions: A. We feel that our new facility will be a tremendous asset to the neighborhood along Highland Avenue, and to the City as a whole. We, therefore, take exception to the issue that beer and wine is to be sold at the convenience store that is being proposed across the street at 1198 East Highland Avenue. According to the Alcohol Beverage Commission, there is already an over abundance of off-site liquor licenses in this area.
