City Attorney Saenz announced that on November 16, 2015, the Mayor and Common
Council voted 4-3, with Council Members Marquez,Nickel and Mulvihill voting"no", to
approve a transition agreement and mutual release between the City and City Manager
Allen Parker in exchange for a mutual release of claims and the resignation of Allen
Parker. The terms of the agreement were as follows:
1. Twelve months of base salary payable in twelve equal installments beginning LO
January 15, 2016, and ending in December 2016. c°•,

2. Continuance of health insurance for twelve months from the resignation date. N

3. Resignation date of December 31, 2015.
The agreement was signed by Mr. Parker and the City on November 23, 2015. E

Invocation/Pledge of Allegiance
The invocation was given by Pastor Anthony Fox of True Vine Ministries. The Pledge of
Allegiance was led by Matthew and Jacob Alvarado, second grade students at Thompson
Elementary School.

A Certificate of Recognition was presented to Lynda K. Savage from Senator Mike
Morrell's office.
4B. Bankruptcy/Strategic Planning Update--Management Partners
Andy Belknap, Regional Vice President, Management Partners, Inc., stated that a revised d
Plan of Adjustment and Disclosure Statement was filed with the court on November 25, 0
2015, which addressed certain objections to the plan that were filed by creditors. He said 0
it explained in more detail why the City's plan was feasible, how debts would be adjusted o
in bankruptcy, and how the City would be solvent upon exit from bankruptcy. Mr.
Belknap stated that objections to the plan were due on December 16, 2015, and a hearing r
was scheduled on December 23, 2015. He added that the plan would soon be available =
on the City's website.

Phil Waller announced upcoming Chamber events and activities. a

Congressman Pete Aguilar extended his thoughts and prayers to the victims of the tragic
shooting that occurred at the Inland Regional Center on December 2, 2015. He thanked
City leaders for organizing the candlelight vigil at the San Manuel Stadium, and
commended the efforts of local law enforcement on behalf of several of the victims.

come in and assist in tightening up the City's housing program in regards to the
allocation of funds.
Council Member Valdivia made a motion to award $74,000.00 to the Norse Corporation w

Nickel. No vote was taken.

the scoping session of the North-South project, otherwise, known as So Cal Pipeline, had a
been extended to January 18, 2016. He stated that the issue he had with it, was that the _i
consultants who sent out the announcement had a return address of North-South Project >
in care of Ecology and Environment, Inc., San Francisco. He stated that written 1
comments that were submitted during the Public Scoping meetings held on October 27, -
28, and 29 in San Bernardino, Hesperia, and Moreno Valley had been misplaced, o
therefore, if individuals previously submitted written comments, they would have to
resubmit. He stated that all comments previously received would be posted on the
project website at the California Public Utilities Commission.

Betty Jean Long, San Bernardino, asked that the public remember the homeless this cm
holiday season. She stated that bags filled with toiletries, instant coffee, granola bars, r
bottled water, food gift cards, and bandages would be helpful to those people who
are living on the streets. E
James Penman, San Bernardino, spoke about a quote from City Manager, Allen Parker Q
which he read in the San Bernardino Sun Newspaper. He told the Mayor and City
Council that they came through like champs at one of the worst times of our City's
histories on December 2, 2015. He stated that the Mayor and City Council made all of
those people watching television proud to be from San Bernardino. He said that the
Police Department was great, as well as the Swat Team, and the Fire Department's
response was fantastic. He stated that in the 26 years that he was City Attorney, no
Mayor, City Council, or Police Chief that he had ever worked with could have done a
better job than they did.

Rory Murray, San Bernardino, said he wanted to echo Mr. Penman's comments. He
stated that the Candlelight Vigil on December 3, 2015 inspired him to write his song,
"We will Rise" and thanked the Mayor and City Council for receiving it so well at
the last City Council meeting of December 7, 2015. He announced that the song had
been recorded and produced by Dennis Hackett and was available to listen to and
download at cdbaby.com. He also wanted to thank Mr. Hackett, his son James, Gina,
and all of the singers and musicians that performed on the song.

Penny Li, Cultural and Art Limited Company, China, said she traveled to San N
Bernardino to introduce herself and her company to the Mayor and City Council. She
said she hoped to engage the City with cultural projects in the future. She indicated that E
Mr. Keith McCarter had provided all of the documentation concerning the proposal for
the Sister City Program with China to allow international exchange participants to

volunteer in the City for the purpose of sharing their language and culture. She asked ,O
that the Mayor and City Council support the New International Business Expo project for w
the purpose of building strong business relationships between the small businesses here in =
America and China.

Jay Lindberg, San Bernardino, spoke about how effective the FBI investigation was >
going to be in the December 2, 2015 shooting. He spoke about people that were a

investigating terrorist organizations in this Country and that nothing could be found as a
far as assessments were concerned. He stated that the City and the State needed to kick ,j;
the FBI to the curb on this investigation. cm
Laurie Stalnaker, San Bernardino, thanked the Mayor and City Council for their 0)
patience and efforts in assisting in the battle with the Workforce Investment Boards J
and SBETA. She stated that she was a long time member of the SBETA Board and 2 1
stated that SBETA did a wonderful job. She spoke about the statewide Workforce >i
Investment Board panel meeting held on Friday, December 18, 2015 and also spoke
about the audits. She said that she was confident that the Workforce Investment Board o
was going to follow through.

Karmel Roe, San Bernardino, wanted to thank Council Member Nickel for listening to
his constituents. She stated that she believed the City wasted a lot of money on
consulting services. She said that she served the City documentation regarding violation N
of the Brown Act and wanted the City Council to reconsider paying the $229,000 to c4
Allen Parker. She asked that the City Council make better choices in 2016.

Shirley Harlan, San Bernardino, read a letter she wrote about City Manager, Allen
Parker leaving the City and stated that it was not in the City's best interest to let 0
experienced staff leave. Q
Jim Smith, San Bernardino, complimented the Mayor and City Council on how they
handled the terrorist situation and thanked them for their leadership.

Council Member Nickel requested an update on the status of the City's storm drain
program and preparation for major weather events.

Council Member Johnson said he would like to see a defined procedure on when items
from the City Council come back with some kind of status report.

The Mayor read a letter from an unanimous senior citizen from Illinois regarding the
December 2, 2015 shooting incident. This individual made a contribution of$20.00 on
behalf of friends in Illinois. She also sent accolades to the Police Department.
