Description) Finance: Council Notes: 'L _ 10 Agenda Item No. u/ao/9s s �1' u,\ v CITY OF SAN BERNAP11NO - REQUEST For COUNCIL ACTION STAFF REPORT SUBJECT: 7091 LITTLE LEAGUE DRIVE, SAN BERNARDINO, CA 92405 APPEAL OF BOARD OF BUILDING COMMISIONERS ACTION BACKGROUND - On August 2 , 1993 an inspection was made by the Code Compliance division. The following conditions were observed in violation of the San Bernardino Municipal Code. UBC 301 (a) - Mobile Home installed without plans or approvals. SBMC 15. 24 . 040 (A3) Weeds, Dry Brush, Overgrown Vegetation UAC 104 (F) - Illegal to move building or structure without permits or approvals (See exhibit "A") On August 10, 1993 the owner of record, Richard Jimenez filed a typed letter protesting the Notice to Abate Nuisance. (See exhibit "Bn) On October 1, 1993 - This case was heard before an open public hearing, of the Board of Building Commissioners to consider all relevant evidence, objections or protests. The owner of record Mr. Richard Jimenez having an interest in the property appeared on his own behalf. (See exhibit "C") The Board of Building Commissioners upheld staff recommendation and instructed the owner to comply with the requirements for legal use of the trailer, all permits and approvals must be obtained and all work completed within sixty days. If the structure cannot be legally used, the owner shall remove the trailer from the site. Upon the property owner's failure to comply the city shall initiate abatement action. (See Board of Building Commissioners Order No. 1876 as exhibit "D") On January 7, 1994 , Mr. Richard Jimenez filed a complaint for temporary restraining order, preliminary and permanent injunction and damages. Based on the complaint filed this case was in some litigation and was being assigned to Henry Empeno of the City Attorney's office. The complaint was dismissed due to lack of merit. Case No. SCU 08615. (See exhibit "E") On April 12 , 1994 , Mr. Richard Jimenez was sent a letter requesting that he comply with the October 1, 1993 order and again was advised to take corrective action or remove trailer. (See exhibit "F") n�aa PAGE 2 REQUEST FOR COUNCIL ACTION SUBJECT: 7091 LITTLE LEAGUE, SB APPEAL OF BBC ACTION On October 13 , 1994 , Mr. Richard Jimenez was sent a letter from this department informing Mr. Jimenez that the trailer which was moved on the parcel (0261-031-10) doesn't comply with the Development Code, Section 19 . 04 . 030. 2 I . 1 (a) . Therefore as a result it will be necessary to remove the trailer from the site within 30 days. (See exhibit "H") On January 24 , 1995 Mr. Richard Jimenez came to Planning and Building Services requesting to speak with the director. However since there was pending litigation involving the subject property, staff met with the City Attorney's office and was advised that this case should go back before the Board of Building Commissioners to reaffirm the order of October 1, 1993 . On May 15, 1995, another inspection revealed that the requested corrections were still not completed. Mr. Jimenez was again advised by letter that violations must be corrected within (10) days. On or about June 1995 Mr. Jimenez dismissed his lawsuit. On July 7, 1995, Mr. Jimenez was sent a letter via certified mail to appear before the Board of Building Commissioners Meeting of August 3 , 1995. (See exhibit "H") Also at this time a Notice of Pendency was filed to APN#261-031-10. Document #19950239770 (See exhibit nIn) On August 3 , 1995 this case was heard before the Board of Building Commissioner. The owners of record were notified. The owner of record, Mr. Jimenez was present at this hearing. The Board upheld staff recommendation and instructed the owner to comply with the following requirements: "Within thirty (30) days, owner(s) shall obtain the necessary permits to remove the mobile home installed without the required permits and approvals. Within ten (10) days owners shall maintain the landscaping to include regular irrigation and pruning and shall remove all weeds, dry brush, overgrown vegetation, trash, debris or other items causing an unsightly appearance. The property shall meet all applicable codes adopted by the City of San Bernardino. " (Order #2783 - See exhibit "J") On August 28, 1995, the owner,Mr. Richard Jimenez, filed a Notice of Appeal of the action of the Board of Building Commissioners. (See exhibit "K") PAGE 3 REQUEST FOR COUNCIL ACTION SUBJECT: 7091 LITTLE LEAGUE, SB APPEAL OF BBC ACTION STAFF RECOMMENDATION - The city has received numerous complaints regarding this property and continues to receive complaints. Staff has requested compliance numerous times since 1993 but the conditions and violations remain and the trailer is still present without plans submitted or permits applied for. On several occasions Mr. Jimenez has been informed by staff that the trailer doesn't meet the current development Codes and that the trailer must be removed. It should be noted that the Planning Department has made a determination that the trailer could never be permitted as it could never meet development code standards and must therefore be removed. (See exhibit "H") Mr. Jimenez has come before the Board of Building Commissioners Hearings twice and has been instructed to remove the mobile home but no corrective action has been made to date. Since Mr. Jimenez has failed to comply to the Board of Building Commissioners Resolutions the staff recommendations are as follows: "Within thirty (30) days, owner(s) shall remove the trailer from the property known as 7091 Little League Drive, APN# 261-031-10 San Bernardino, California; Since it has been determined that the mobile home can't be modified we are requesting that he bring the property back to it's natural condition i.e. vacant property until which time Mr. Jimenez submits plans and obtains proper permits to develop the property and if these conditions are not complied with allow the City Code Enforcement Division to vacate said property through an abatement warrant. " The decision of the Board of Building Commissioners should be upheld. The large dust clouds created during the winds from a lot with no vegitation will create a hazardous health condition . If the city would stop there retaliation and reinstate my electrical power on my city and edison approved power pole as I have requested and paid for tim perm is which h.-acre been approved by the City of San Bernardino. I would be more than happy to abate the limbs and brush with my power tools, but without power for my tools it would create an extreme hardship on my family and I to abate such a large area without my power tools. I am in the process of completing the necessary drawings and plans for my mobile home. These plans will be submitted to the planning dept. for there appoval . After reviewing the order from that meeting I checked with Planning and Plan Check and was informed that no plans had been submitted for this property in accordance with the timeframe specified in the order. Based on this information a courtesy call was made to the property owner, Richard Jiminez. I was told Mr. Jiminez was not there so I left a message that it was urgent that Mr. Jiminez contact this office regarding the trailer on the property. At approximately 8:30 AM this date Mr. Jiminez came to the counter asking for me and Al Boughey. Mr. Boughey was in a meeting so the Senior Code Compliance Office Bonnie Garcia came to the counter with me. Mr. Jiminez told us that he had not submitted plans but did talk to Donald Jackson, Plan Checker. Donald Jackson stated that Mr. Jiminez did ask him about the plan approval process but to date has not submitted plans. Bonnie asked Mr. Jiminez if he had an architect drawing the plans and he informed us that it was a private party but would not give us the name. At this time Mr. Jiminez handed us a document stating that he had obtained a restraining order and we were to stop harassing him. At this time Bonnie called the City Attorney's office and was told to have Mr. Jiminez bring them the order. We informed Mr. Jiminez of this and he told us that we had been served and left the office.
