That the Director of Public Works/City Engineer and the City Clerk are authorized to proceed with the vacation of an 8-foot by 108-foot public walkway lying between Sierra Way and Genevieve Lane North of 44th Street, as a City initiated action. AND 2. That Plan No. 9383 showing the vacation of a public walkway lying between Sierra Way and Genevieve Lane North of 44th Street, is approved. IDINO - REQUEST P.-A COUNCIL ACTION STAFF REPORT A request and petition was received from approximately 19 of 37 homeowners in Tract No. 3410, to vacate an 8 foot by 108 foot pedestrian walkway running West- erly from Sierra Way to Genevieve Lane (North of 44th Street) . The walkway was dedicated on Tract Map No. 3410 on December 4, 1952, primarily to allow property owners in the tract pedestrian access to Sierra Way. In 1989, sidewalk was constructed along the West side of Sierra Way and the sidewalk within this 8 foot easement was raised to meet the new improvements along Sierra Way. In 1989, the two adjoining property owners requested that the walkway be closed due to concerns over the reduced height of their block walls as a result of the walkway being raised. The other property owners were polled at that time to ascertain if they were in agreement with closing the walkway. None of the other owners indicated they would like to have the walkway closed at that time. The past several years have shown increasing criminal activity through the use of the walkway, i.e. grafitti, vandalism, and car and home thefts. Several months ago a group of concerned tract residents contacted their councilman, David Obe- rhelman, to request that the walkway be closed to the public's use. The easement was created for the convenience of the residents of the tract, but is being used as access for criminal activities by persons living outside the area. The administrative fee of $1000 collected for street vacations does not apply to City initiated vacations.
