Date: November 28, 1995 Synopsis of Previous Council action: 03-20-95 -- Resolution No. 95-71 adopted authorizing execution of Second Amendment to Joint Development Agreement. 08-07-95 -- Authorization to Proceed was given to initiate proceedings for the formation of an acquisition assessment district for the construction of New Pine Avenue. 10-16-95 -- Reimbursement Agreement, Resolution of Intention and other various were approved relative to the formation of an Acquisition Assessment District and Tract No. 15642 was approved. 11-06-95 -- Resolution Authorizing execution of Acquisition / Financing Agreement 11-20-95 -- Public Meeting was held relative to the formation of New Pine Acquisition Assessment District and matter carried over to December 18, 1995. Description) Assessment District No. 1015 --- Pine Avenue Acquisition Finance: Council Notes: j Re-6 �r- y-2 / 8 � 75-0262 Agenda Item No. V CITY.OF SAN BERNN&IDINO - REQUEST FnR COUNCIL ACTION STAFF REPORT The Joint Development Agreement, by and between CFB Investments, Redevelopment Agency and City of San Bernardino, was approved on 03-20-90 relative to the development of property located on the North side of Kendall Drive, West of Pine Avenue. The addendums to this agreement evidence a major change in the nature of the project from the originally approved 318 multi-family units to 42 single family units, pursuant to Tentative Tract No. 15642, approved by the Planning Commission on 05-16-95. The RDA and City agreed to undertake certain actions to facilitate development of the 42 single family units. One action was to provide CFB with financial assistance for the cost of the new Pine Avenue infrastructure, in the amount of $1 , 133,033. On 8-7-95, authorization was given to initiate the formation of the assessment district, and the selection of Brown,Diven and Hentschke for Legal Consultant and GFB - Friedrich and Associates for Assessment Engineer were also confirmed at that meeting. The funding source approved for the construction costs are through a combination of a loan from EDA (approximately 46%) , the Sewer Line Construction Fund (245) (approximately 27%) and the Sewer Line Maintenance Fund ( 132) (approximately 27%) . On 10-16-95, various resolution were submitted and approved, including approval of a Reimbursement Agreement, Resolution of Intention, Approval of the Preliminary Engineer's Report and District Boundary Map, and Resolution setting a Public Meeting and Public Hearing relative to the formation of the district. On November 6, 1995, a resolution was adopted approving the execution of an Acquisition / Financing Agreement. On November 20, 1995, a Public Meeting was held relative to the formation of the proposed assessment district, and the matter continued to the December 18, 1995 Council Meeting. All property owners liable to be assessed were given written notice of both the Public meeting and Public Hearing. No protests have been filed as of this date. There are two resolutions attached for your action. The first resolution confirms the assessments, orders the improvements and approves the Engineer's Report. The second resolution approves the bond document. Even though no bonds will actually be publicly sold, the bond certificate represents the total indebtedness of the district to the City, since the City is advancing the funds for construction.
