Closed Session Report City Attorney Saenz reported the following actions: Under Agenda Item No. 1 A, existing litigation: In the matter of Mekione Samatua, et al. v. City of San Bernardino, et al., the Council authorized an increase to the outside attorney fee cap by vote of 6-0 (Council Member Nickel absent); In the matter of Shab el Awar Trust v. City of San Bernardino, the Council gave settlement directive by vote of 6-0 (Council Member Nickel absent); In the matter of City of San Bernardino v. Lucille's Collective, et al., the Council gave settlement directive by vote of 6-0 (Council Member Nickel absent); In the matter of Stout, Marveen F., et al. v. City of San Bernardino, the Council gave settlement directive by vote of 6-0 (Council Member Nickel absent). Under Agenda Item No. I C, anticipated litigation—initiation of litigation: In the matter of City v. Cline, the Council gave settlement directive by vote of 6-0 (Council Member Nickel absent); In the matter of City v. Purpero, the Council gave settlement directive by vote of 6-0 (Council Member Nickel absent); In the matter of City v. Le, the Council gave settlement directive by vote of 7-0. City Attorney Saenz announced that on November 16, 2015, the Mayor and Common Council voted 4-3, with Council Members Marquez, Nickel and Mulvihill voting "no", to approve a transition agreement and mutual release between the City and City Manager Allen Parker in exchange for a mutual release of claims and the resignation of Allen Parker. The terms of the agreement were as follows: 1. Twelve months of base salary payable in twelve equal installments beginning January 15, 2016, and ending in December 2016. 2. Continuance of health insurance for twelve months from the resignation date. 3. Resignation date of December 31, 2015. The agreement was signed by Mr. Parker and the City on November 23, 2015. Reading of Resolutions and Ordinances Deputy City Clerk Sutherland read into the record the titles of all the resolutions and ordinances on the agenda. Invocation/Pledge of Allegiance The invocation was given by Pastor Anthony Fox of True Vine Ministries. The Pledge of Allegiance was led by Matthew and Jacob Alvarado, second grade students at Thompson Elementary School. Savage, SBCUSD Board Member, Retired - Council Member Mulvihill A Certificate of Recognition was presented to Lynda K. Savage from Senator Mike Morrell's office. 4B. Bankruptcy/Strategic Planning Update -- Management Partners Andy Belknap, Regional Vice President, Management Partners, Inc., stated that a revised Plan of Adjustment and Disclosure Statement was filed with the court on November 25, 2015, which addressed certain objections to the plan that were filed by creditors. He said it explained in more detail why the City's plan was feasible, how debts would be adjusted in bankruptcy, and how the City would be solvent upon exit from bankruptcy. Mr. Belknap stated that objections to the plan were due on December 16, 2015, and a hearing was scheduled on December 23, 2015. He added that the plan would soon be available on the City's website. 4C. Chamber of Commerce & Local Elected Officials Announcements Phil Waller announced upcoming Chamber events and activities. Congressman Pete Aguilar extended his thoughts and prayers to the victims of the tragic shooting that occurred at the Inland Regional Center on December 2, 2015. He thanked City leaders for organizing the candlelight vigil at the San Manuel Stadium, and commended the efforts of local law enforcement on behalf of several of the victims. 5. Consent Calendar 5A. City Attorney Saenz stated he would abstain on this item as he owned property within 500 feet of the project. Council Member Valdivia referred to paragraph four on page 573 of the backup, which stated, "Contract change orders over $5,000 require Mayor and City Council approval, per Resolution 88-389." He stated that he believed that amount had caused delays for the Public Works Department and should be revisited and possibly changed. Chief Assistant City Attorney Grider stated that after the meeting she would take a look at that resolution, draft an amendment, and bring it back to Council at the next meeting. He stated that the recommendation was the creation of a Quality of Life Team to help combat blight, which would help support the following priority goals listed in the Strategic Plan: Public Safety, Quality of Life, Business Development, Community Engagement, and Fiscal Sustainability. Public Comments on Items Not on the Agenda Robert Porter, San Bernardino, stated that on December 2, 2015, many people lost loved ones and were grieving. He said the City of San Bernardino needed more than thoughts and prayers, it needed hope. Sandra Owen Olivas, San Bernardino, stated that the residents of San Bernardino were resilient, proud and strong. Scott Olson, San Bernardino, stated that unless a miracle candidate showed up on the ballot for 7t" Ward Council, he would not be voting on February 2, 2016; he spoke in support of Bessine Littlefield-Richard for 6t" Ward Council; requested that Council Member Nickel be investigated for information he disclosed to the Sentinel regarding the City Manager; and asked that December 2, 2015, become a day of remembrance. 0 Keith McCarter stated that he would be making a presentation next week regarding his request to reinstate the Sister City Committee for China. He asked the Council Members to review the packet of information he sent to each of them and said he would address any questions and/or concerns at that time. Mr. McCarter said he was interested in creating an international internship and an international business expo in the City of San Bernardino, Jay Lindberg, San Bernardino, spoke about the recent attacks in Paris and the use of drones in the Middle East. Carol Donnelly, San Bernardino, a written statement regarding Citizens Offering Police Support (C.O.P.S.) was read into the record by City Clerk Hanna. Karmel Roe, San Bernardino, stated that San Bernardino has been given a new image — an image of hope and strength; stated that the City was wasting money that could be used to eliminate homelessness; demanded that the Council deny the City Manager's severance package; and stated that she knew of someone who wanted to recall Council Member Shorett. She said she was going to give the City her demands in writing, and if something was not done about it, she was going to file a lawsuit against the City. Jim Smith, Highland, spoke about the shooting that occurred at the Inland Regional Center on December 2, 2015, and all the events held in honor of the victims and their families; and commended the Police Chief for his leadership. Ralph Flower, San Bernardino, commended the San Bernardino City Police and Fire Departments for their professionalism. Items to be Referred to Council Committees Council Member Mulvihill suggested that the Legislative Review Committee discuss the development of a housing policy using the "Housing First"model to end homelessness. Council Member Nickel requested that the City Manager provide an update on the steps the City is taking in preparation for El Nino. 9. Adjournment At 6:59 p.m., the meeting adjourned in memory of the victims of the shooting that occurred at the Inland Regional Center on December 2, 2015. The next joint regular meeting of the Mayor and Common Council and the Mayor and Common Council Acting as the Successor Agency to the Redevelopment Agency is scheduled for 2:00 p.m., Monday, December 21, 2015.
