Description) Finance* �- .ncil Notes: '7 i 75-0262 Aaenda Item Nn � CITY OF SAN BERNAC)DINO - REQUEST FC-1 COUNCIL ACTION STAFF REPORT In December of 1989, the City received a request for annexation from Calmat, who is a major landowner within the proposed annexation territory. On December 12, 1989, authorization was given to proceed with the proposed annexation. The adoption of the attached Resolution, making application to LAFCO for the annexation, is recommended. The proposed annexation is approximately 1628 acres, of which 1392 acres is owned by Calmat. Thus, Calmat represents 86% of the total area within this proposal . Calmat has proposed industrial development of this area (i.e. sand and gravel mining) and has undergone an Environmental Impact Report, General Plan Amendment and Specific Plan Review with the City relative to the proposed project, and on May 10, 1993, resolution No. 93-140 was adopted, certifying the Environmental Impact Report, adopting Findings and Statements of Overriding Consideration, adopting the Mitigation monitoring Reporting Program, adopting General Plan Amendment No. 91-18 and adopting Specific Plan No. 90-01. The adoption of the attached Resolution is the first formal step in the annexation process. Prior to the finalization of this proposal, LAFCO will hold a public hearing, after which time, the City will hold a public hearing. PUN FOR SERVICES (Reorganizations and Annexations) Section 56653 of the Government Code requires the submission of a Plan for Services with every proposal initiated by a resolution of a legislative body. The Commission has adopted standards for the prepara- tion of these documents. OSED ANNEXATION TO THE CITY OF SAN BERNARDINO, FOR THE AREA GENERALLY LOCATED SOUTHWESTERLY OF CAJON BOULEVARD, SOUTHEASTERLY OF DEVORE ROAD The mayor and Members of the Common Council of the City of San Bernardino agree and desire to annex the above described territory to the City of San Bernardino, for the following reasons: 1. The territory proposed to be annexed is contiguous to the corporate limits of said City on one side. 2. The incorporation of this territory will help contribute to and facilitate the orderly growth and development of the existing City area and the territory proposed to be annexed. This proposed annexation is within the sphere of Influence for the City of San Bernardino. 3. This annexation will also help to provide a uniform and orderly manner of growth, planning and zoning of lands, and the subdivision of lands therein in such a manner most conductive to the welfare of said City and the area proposed for annexation. 4. The City of San Bernardino has planned for providing all typical City services to the area under consideration for annexation. The following is an enumeration and description of services which will be extended to the affected territory, which describes the level and range of such services that will be provided, as well as the feasibility of extending such services and any improvements that will be required by the City, along with a description of when the service will commence and the financing of such improvements and services and any conditions imposed by the City. a) Planning, Zoning, Code Enforcement and Building Inspection - The City shall provide these services in conformance with appropriate Government Codes and City Ordinances as well as following the City's General Plan for zoning and subject to the provisions of Land Use Ordinance No. 1991 and Specific Plan 90-01. This function is supported by City taxes and appropriate zoning, building and permit fees. b) Parks and Recreation - The area proposed for annexation will have no impact on park or recreational facilities or programs, and no additional services will be required as a result of the annexation. The cost to the taxpayer within the proposed annexation will be collected through the City taxes and by required fees charges to those individuals who wish to participate in City-sponsored recreational activities where charges and fees are applicable. C) Library Service - It is important to note that the resources of the entire library system are readily made available to the proposed annexation, including the Central Library located at 6th and "E" Streets. The cost for these services are paid through City taxes and become available immediately upon annexation. -2- d) Public safety, Police - The San Bernardino Police Department is authorized a complement of 244 sworn officers and approximately 128 civilians not counting 72 school crossings guards. The Patrol Division maintains 6 beat areas of the City. The Division presently averages 24 Police units on patrol 24 hours a day, counting supervisory and traffic personnel. The Detective Division has 30 sworn officers and works from 8:00 a.m. to 5:00 p.m. daily, Monday through Friday. The Services Division maintains all records and identification and provides support services to the other two Divisions on a 24 hour a day basis. The cost for these services are paid through City taxes, and become available immediately upon annexation. e) Public Safety, Fire, Paramedic and Rescue - Fire protection services will be provided upon annexation and the affected residents will be provided with a Class 3 rated Fire department with eleven (11) different fire stations to respond. A typical structural fire on the first alarm deploys two (2) engine companies, one (1) ladder truck company, a paramedic squad and one (1) Battalion Chief. In addition to fire protection, the City also has a minimum of five (5) paramedic units on duty 24 hours a day. Each unit has two (2) paramedics each, giving a total of eight (10) paramedics on duty at all times. The closest fire station to the proposed annexation area is Fire Station No. 5 , located at 1640 Kendall Drive. The cost for these services are paid through the City taxes and become available immediately. It fire station has also been proposed in the Palm & Kendall Area, which, when built, would provide services to the area. The City currently has a paramedic user fee which ranges from $100 - $200 per call. Most health insurance programs cover this charge. In lieu of paying the user fee, a household may pay an annual fee of $24 which would cover all paramedic calls irregardless of the number of calls made. Currently there is no annual fee program for commercial properties. f) Public Safety, Ambulance Service - The City of San Bernardino, under Ordinance No. 1987, franchise to Courtesy Ambulance Company as the only medical transportation carrier within the City limits. The rates are established by the above ordinance and fees are paid by the user and vary. g) Water and Sewer services - The area is currently served by San Bernardino Municipal Water, and they will remain to serve this area for the time. The treatment, disposal and reclamation of waste water is processed by the City of San Bernardino's Treatment Plant. Sewer services would be available to the area upon annexation. The methods and availability of installing of sewer mains would vary, as would the financing for such projects ( paid for by developers in the area, assessment districts, etc.) h) Public Utilities - Electricity, Gas and Telephone services - These services are currently provided to the project area. The City will allow service to continue upon annexation under present franchise agreements between the various utility companies. The rate structure and cost to the property owners are controlled by the Public Utilities Commission and any expansion of future service will be created by the request of developers and/or property owners. j) Solid Waste, Collection and Disposal - When the area is annexed, the City will provide service at that time. Also, if upon request, the City will provide refuse service to the existing customers, or at the end of the 5 year cancellation period, whichever comes first. The current fee for twice a week pickup (residential) is $15.25 per month. Commercial rate vary widely, depending on the type of container and frequency of pick-up. A 3 yard bin is $9.00 per month bin rental and $57.69 per month for once a week pickup. A 4 yard bin is $10.00 per month rental and $76.92 per month for once a week pickup. A 20 yard roll-off bin is $45.00 per month rental and $258 .per pickup. k) Street Sweeping , lighting and maintenance - Street sweeping is currently done on a twice a month basis. Street repair and/or maintenance is done on an as needed basis. The costs for street maintenance is paid for through the City taxes, and the service becomes available immediately upon annexation. Street sweeping and street lighting is paid for through City-wide Assessment District No. 994. The annual assessment for single family parcel is about $48.00 per year. The commercial rate is 4 assessment units (one assessment unit is currently about $48.00) per acre of land. Annexed property is not automatically annexed into the assessment district, since that will require a separate proceeding, but the services become available im.ediately. 5. Special Taxes - In addition to the regular property taxes, an 8.5% utility tax is collected by the City to offset costs of the general services provided. This amount is billed and paid through the respective utility's billing process. As stated above, the annexed area would be subject to City-Wide Assessment District No. 994, but would require a separate proceeding. 6. Conditions - There are no special conditions that will be imposed as a result of this annexation.
