A total of 6 bids were received, ranging from $322 , 531 . 00
to $388 , 413 . 50 . The low bid of $322 ,531 . 00 is 22 . 6% below the
Engineer' s Estimate of $416 , 670 . 00 .
The contract documents were prepared with two alternates
'for pavement rehabilitation. Alternate "A" is for conventional
asphalt concrete, while Alternate "B" is for rubberized asphalt
concrete. The low bid was for Alternate "B. "
Below is the total estimated project cost, based upon the
actual low bid price.

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO E. L. YEAGER CONSTRUCTION COMPANY, INC. FOR PAVEMENT
3 REHABILITATION OF WATERMAN AVENUE, FROM BARTON ROAD TO REDLANDS
BOULEVARD.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS :
6 SECTION 1 . E. L. Yeager Construction Co. , Inc. , is the
7 lowest responsible bidder for: Pavement Rehabilitation of
8 Waterman Avenue, from Barton Road to Redlands Boulevard, per Plan
9 No. 8869 . A contract is awarded accordingly to said bidder for
10 the total amount of $322 , 531 . 00 for Alternate "B, " but such award
11 shall be effective only upon the contract being fully executed by
12 both parties . All other bids, therefore, are hereby rejected.
13 The Mayor is hereby authorized and directed to execute said
14 contract on behalf of the City; a copy of the contract is on file
15 in the office of the City Clerk and incorporated herein by
16 reference as fully as though set forth at length.
17 SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements, amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.
24 SECTION 3. This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.
