STAFF REPORT
Bids for this project were opened at 2 : 00 p.m. , Tuesday,
5-18-93 .
A total of 6 bids were received, ranging from $246 , 312 . 00
to $278 , 848 . 00 . The low bid of $246 , 312 . 00 is 9 . 0% below the
Engineer' s Estimate of $260 , 400 . 00 .
This project was bid with two alternates . Alternate "A"
is conventional construction, while Alternate "B" uses rubberized
asphalt. Federal-Aid projects are being required to use the
rubberized asphalt product on a phased in time line and there is
consideration for the same requirements on State funded projects.
Overall cost on this project makes the rubberized asphalt less
costly and provides a first time use of the product in this City.
Below is the total estimated project cost, based upon the
actual low bid price.

Supplemental funds in the amount of $120 , 000 were approved at the
Council meeting of 9-21-92, for a total available amount of
$342 , 000 .
We recommend that a contract be awarded for the low bid
price.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO SILVIA CONSTRUCTION, INC. FOR REHABILITATION OF
3 PAVEMENT ON REDLANDS BOULEVARD, FROM HUNTS LANE TO EASTERLY CITY
LIMITS .

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1 . Silvia Construction, Inc. , is the lowest
7 responsible bidder for: Rehabilitation of Pavement on Redlands
8 Boulevard, from Hunts Lane to Easterly City Limits , per Plan No.
9 8756 . A contract for Alternate "B" (Rubberized Asphalt) is
10 awarded accordingly to said bidder for the total amount of
11 $246 , 312 . 00 , but such award shall be effective only upon the
12 contract being fully executed by both parties . All other bids,
13 therefore, are hereby rejected. The Mayor is hereby authorized
14 and directed to execute said contract on behalf of the City; a
15 copy of the contract is on file in the office of the City Clerk
16 and incorporated herein by reference as fully as though set forth
17 at length.
18 SECTION 2 . This contract and any amendment or modifica-
19 tions thereto shall not take effect or become operative until
20 fully signed and executed by the parties and no party shall be
21 obligated hereunder until the time of such full execution. No
22 oral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not be implied from any act or
24 course of conduct of any party.
25 SECTION 3. This resolution is rescinded if the parties
26 to the contract fail to execute it within sixty (60) days of the
27 passage of this resolution.
