HARDGRAVE, Director Subject: Resolution Confirming Annual Assessment Roll , Assessment Dept: Public Works/Engineering District No. 994 (City-Wide Assessment District) Date: June 11, 1993 Synopsis of Previous Council action: 06-04-90 Resolution No. 90-207, adopted by the Mayor and Common Council found that the public interest, convenience and necessity required the formation of a City-wide street lighting and street sweeping assessment district, known as Assessment District No. 994 07-17-90 Resolution No. 90-323, adopted by the Mayor and Common Council declared that all the land included within the boundaries of said district will be benefited by street sweeping and street lighting. 07-06-92 Resolution No. 92-245 was adopted, confirming the annual assessment roll for 1992-93 fiscal year. Distr. 994 Finance:, Council Notes: 75-0262 Agenda Item No. CITY OF SAN BERPnRDINO - REQUEST L.,,)R COUNCIL ACTION STAFF REPORT On July 16, 1990, Resolution No. 90-323 was adopted, creating a City-wide assessment district for street lighting and street sweeping, and is more particularly described in Resolution of Intention No. 90-207, adopted June 4 , 1990. The Resolution of Intention also states that an annual finding and determination must be made that the net amount of the total assessment is being spent on law enforcement services, and that the total assessment, exclusive of administrative costs, does not exceed the Consumer Price Index, or 5%, whichever is less. The total amount of the 1992-93 Assessment Roll was 3,034,495 ($2,911,883 budget amount plus $122,612 administrative costs) . The 1993-94 Assessment Roll is 53,015,430 ($2,949,040 plus $66,390 administrative costs) . The budget amount is an increase of 1.3% over last year, which is less than the Consumer Price Index (CPI) of 3.8% and less than the maximum 5% increase allowed under the provisions of Resolution of Intention No. 90-323. The total assessment roll , however, is less than last years. The assessment for a single family residence, which is the basis for calculating all other assessments, is $47.54 this year, which is the same as it was last year. As required by the provisions of Chapter 12.90 of the Municipal Code and Resolution No. 90-323, which established the District, the Resolution Confirming Assessment Roll relative to Assessment District No. 994, has been prepared and is attached for your action. The roll for 1993-94 is on file in the office of the City Clerk. 75-0264 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1993 - 94 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 994 CITY-WIDE STREET 3 LIGHTING AND STREET SWEEPING ASSESSMENT DISTRICT. 4 WHEREAS, by Resolution No. 90-323, the Mayor and Common Council 5 found that the public interest, convenience, and necessity required 6 the formation of a City-wide street lighting and street sweeping 7 Assessment District; and 8 WHEREAS, by said Resolution No. 90-323, the Mayor and Common 9 Council formed an assessment district known as Assessment District 10 No. 994 for the purpose of providing City-wide street sweeping and 11 street lighting services pursuant to the provisions of Chapter 12.90 of 12 the San Bernardino City Municipal Code; and 13 WHEREAS, by Resolution No. 90-207, the Mayor and Common Council 14 declared that all the land included within the boundaries of said 15 district will be benefited by street sweeping and street lighting; and 16 WHEREAS, said Resolution No. 90-207 declared that an annual 17 assessment shall be levied on all land within the district to provide 18 funding for said street lighting and street sweeping; and 19 WHEREAS, an Assessment Roll has been prepared totaling 20 53,015,043.30, of which S 66,390.12 is administrative costs and incidental 21 expenses, which sets forth the individual assessments i to be levied on 22 each of the parcels of land within Assessment District No. 994 for the 23 fiscal year 1993-94; 24 WHEREAS, said Resolution No. 90-207 requires that the Mayor and Common 25 Council of the City of San Bernardino make a finding and determination that 26 an amount equal to the net amount of the proceeds of the total assessments 27 for the fiscal year 1992-93 has been used for law enforcement services, and 28 said Resolution No. 90-207 requires that the total amount of increase, if 06-11-93 RESOLUTION CONFIRMING 1993-94 ASSESSMENT ROLL RELATIVE TO CITY-WIDE ASSESSMENT DT "RIOT NO. 994 j any, of each annual assessment roll , excluding administrative costs, does 2 not exceed the Consumer Price Index for the Los Angeles-San Bernardino- 3 Riverside area, as published by the United States Department of Labor, 4 Bureau of Labor Statistics, or five percent (5%) , whichever is less. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 6 BERNARDINO AS FOLLOWS: 7 SECTION 1. That the Mayor and Common Council of the City of San 8 Bernardino do hereby find and determine that an amount equal to the net 9 amount of the proceeds of the total assessments received for the fiscal year 10 1992-93 has been used for law enforcement services. 11 SECTION 2. That the Mayor and Common Council of the City of San 12 Bernardino do hereby further find and determine that any increase in the 13 total amount of the assessment roll as set forth herein, excluding 14 administrative costs, does not exceed the Consumer Price Index for the Los 15 Angeles-San Bernardino-Riverside area, as published by the United States 16 Department of Labor, Bureau of Labor Statistics, or five percent (5%) , 17 whichever is less. 18 SECTION 3. That the Mayor and Common Council do hereby further 19 find and determine that the proportionate costs to be levied against the 20 parcels of land within Assessment District No. 994 are correctly set forth 21 on Assessment Roll No. 994 for the fiscal year 1993-94, on file in the 22 office of the City Clerk, and do hereby confirm said assessments. 23 SECTION 4.
