Synopsis of Previous Council action:
Periodically, resolutions have been presented to the Common Council
for authorization to impose liens on certain parcels of property on
which costs have accrued by the City's abatement of public nuisances.
Recommended motion:
Adopt resolution to impose liens.

3 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS OF
ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL
4 PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE
COSTS OF THE ABATEMENT OF PUBLIC NUISANCES. (Building

6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:

8 SECTION 1. The City of San Bernardino, pursuant to its
9 authority under San Bernardino Municipal Code Chapter 15.28
10 and other laws, did lawfully cause public nuisance abatements
11 on the real property described in Exhibit "A" , attached hereto
12 and incorporated herein by reference as though fully set
13 forth. The last known owners of record as to each such parcel
14 are also specified in Exhibit "A" .
15 Due notice was given to the person or persons having an
16 interest in said property and a hearing was held by the Board
17 of Building Commissioners to hear protests and to assess the
18 costs of said abatement on said property. The Board of
19 Building Commissioners has entered its order determining the
20 costs to be reasonable and proper and imposing a lien upon the
21 land involved. Notice of the right to appeal to the Mayor and
22 Common Council has been issued to all affected property
23 holders. The Board of Building Commissioners now requests
24 that the Mayor and Common Council confirm the imposition of
25 the liens.

4 SECTION 2. The matter having now come before the Mayor
5
and Common Council for confirmation of the imposition of the
6
liens imposed, the following costs are found to have been duly
7 incurred by the City pursuant to proceedings under said
8 provisions of the San Bernardino Municipal Code and the final
9 statements of costs on file with the City Clerk are hereby
10
confirmed and adopted as special assessments against the
11 properties listed in Exhibit "A" hereto.

13 SECTION 3. If said sum is not fully paid to the City
14 Clerk, City Hall, San Bernardino, within five (5) days after
15 mailing a notice to the person or persons having an interest
16 in said property informing said person or persons of the
17 adoption of this resolution as to any such individual parcel,
18 then said sum shall be and become a lien on said property
19 pursuant to said Municipal Code provisions and applicable laws
20 and shall be collected as a special assessment thereon.

22 SECTION 4. In the event said sum is not paid as
23
hereinabove provided, the City Clerk is hereby directed to
24 file a certified copy of this resolution with the Auditor of
25 the County of San Bernardino, State of California, directing
26 that said sum be entered as lien charges against said property
27 as it appears on the current assessment rolls, to be collected

at the same time and in the same manner, subject to the same

penalties and interest upon delinquencies, as the general
6 taxes for the City of San Bernardino are collected. The City
7 Clerk shall present for recording appropriate notices of the
8 imposition of these liens with the County Recorder.

adopted by the Mayor and Common Council of the City of San
12 Bernardino at a meeting thereof,
