STAFF REPORT
On August 17, 1987, staff was authorized to institute proceedings for
vacation of a portion of alley near Evans and Mt. Vernon. The request was
City initiated and a waiver of fees was made.
On November 17, 1987, a finding of need for health and safety reasons as to
why the alley West of Mt. Vernon Avenue, between 16th St. and Evans St.
should be vacated, was made, and Plan No. 7335 was approved.

All of the interested City Department Heads and Utility Companies were
notified of the proposal on December 10, 1987 with a reply due by January 10,
1987. The Utility companies have responded and reservation for pulic
utility easements was requested.
On February 1, 1987 , the Negative Declaration was adopted.
The Resolution of Intention, which sets a protest date of April 18, 1988 has
been attached hereto for your action .

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
3 TO ORDER THE VACATION OF THAT CERTAIN NORTH/SOUTH ALLEY LOCATED WEST OF MT.
VERNON AVENUE, BETWEEN 16TH STREET AND EVANS STREET AND RESERVING PUBLIC
4 UTILITY EASEMENTS THEREON.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
0 BERNARDINO AS FOLLOWS:

SECTION 1. That the Mayor and Common Council of the City of San
8 Bernardino hereby declares its intention to order the vacation of that
9 certain North/South alley located West of Mt. Vernon Avenue, between 16th
10 Street and Evans Street, and reserving public utility easements thereon,
111 described as follows:
121 That certain North/South Alley, located West of Mt. Vernon
Avenue, between 16th Street and Evans Street, as delineated on
13 the Map of Tract No. 2780, as per map recorded in Book 38 of
Maps, page 71, records of the County Recorder of San
14 Bernardino County, State of California, described as follows:
15 Beginning at the Northeast corner of Lot 38 of Tract No. 2850,
as per map recorded in Book 39 of Maps, page 26, records of
16 said County, said point also being the South line of said 16th
Street; thence South, along the East line of said Lot 38, and
the East line of Lot 39 of Tract No. 2891, as per map recorded
l � in Book 40 of Maps, page 1, records of said County, to the
18 Southeast corner thereof, said point also being the North line
of said Evans Street; thence East, along the Easterly
19 prolongation of said North line ,a distance, of 20 feet more or
less, to the West line of Lot 18 of said Tract No. 2780;
20 thence North, along the West lines of Lots 18, 17, 16, 15, 14
and 13 of said Tract No. 2780, to the Northwest corner of
21 said Lot 13, said point also being the South line of said 16th
Street; thence West, along the Westerly prolongation of said
22 South line, to the Point of Beginning.
23 SECTION 2. That the Mayor and Common Council of the City of San
24 Bernardino, in vacating the above described portion of said street ,elects
25 to proceed under and in accordance with the provisions of the "Public
26 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
27 the Streets and Highways Code of the State of California.
28 SECTION 3. That the hour of 10:00 A.M. on the 18th day of April ,
1988, in the Council Chamber of the City Hall, San Bernardino, California,
be, and the same hereby is fixed as the time and place when and where all
2 persons interested in or objecting to the proposed vacation may appear
3 before the said Mayor and Common Council and offer evidence in relation
4 thereto. For further particulars as to the proposed vacation of the
`' hereinbefore described portion of said street, reference is made to that
6 certain map marked "Plan No. 7335" approved September 22, 1987, on file
7 in the office of the City Clerk of said City.
8 SECTION 4. Nothing in this Resolution shall in any way affect or
9
disturb any existing easements for public utility purposes belonging either
10 to the City of San Bernardino or to any public utility and there is hereby
11 reserved for future general public utility purposes and for this City an
12 easement reasonably necessary to locate public utility facilities over, in,
13 under or across the real property hereinabove described and to use,
14 maintain, repair, replace or renew such facilities.
15 SECTION 5. That the City Engineer of the City of San Bernardino
1611 hereby is directed to cause Notices of Street Vacation to be posted as
17 required by the Public Streets, Highways and Services Vacation Law.
18 SECTION 6. That the City Clerk shall certify to the adoption of
19 this Resolution of Intention and shall cause the same to be published once a
20 week for two successive weeks in The Sun, a newspaper published and
21 circulated in the City of San Bernardino, prior to the date of the above
22 public hearing.
