STAFF REPORT
A request was received to vacate that certain East/West alley, located South
of 10th Street, East of "H" Street, from an adjoining owner. This request
represents 33% of those owners who adjoin the alley.
On September 22, 1987 meeting, the Findings of need for health and safety as
to why the alley South of 10th Street amd East of "H" Street should be
vacated, was made.
All of the interested City Department Heads and Utility Companies were
notified of the proposal on December 11, 1987 with a reply due by January 11,
1988. The Utility companies have responded and no reservations for any
easements were requested.
On February 1, 1988, the Negative Declaration was adopted
The proponents have been notified by letter on February 25, 1988 and have
responded with notification for us to proceed. The remaining fee of $200.00
will be paid prior to the adoption of the Resolution Ordering Vacation and it
is therefore recommended that favorable consideration be given to the
requested vacation.
The Resolution of Intention, which sets a protest date of April 18, 1988 has
been attached hereto for your action also.

2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
3 TO ORDER THE VACATION OF THAT CERTAIN EAST/WEST ALLEY SOUTH OF 10TH STREET
AND EAST OF "H" STREET.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO AS FOLLOWS:
6 SECTION 1. That the Mayor and Common Council of the City of San
7 Bernardino hereby declares its intention to order the vacation of that
R certain East/West Alley South of 10th Street and East of "H" Street,
9 described as follows:
10 That certain East/West alley, as delineated on the map of
Fussell Subdivision as per map recorded in Book 3 of
11 Maps, page 42, records of the County Recorder of San
Bernardino County, State of California, described as
12 follows:
13 Beginning at the Southwest corner of Lot 26 of said
Fussell Subdivision, said point also being the East line
14 of "H" Street, 82.50 feet wide; thence East along the
South lines of Lots 26, 25, 24, and 23 of said Fussell
15 Subdivision, to the Southeast corner of said Lot 23;
thence South, along the Southerly prolongation of the
16 East line of said Lot 23, to the Northeast Corner of Lot
27 of said Fussell Subdivision; thence West, along the
17 North line of said Lot 27, to the Northwest corner
thereof, said point also being the East line of said "H"
18 Street; thence North, along the Northerly prolongation of
said East line, to the Point of Beginning.
10 SECTION 2. That the Mayor and Common Council of the City of San
20 Bernardino, in vacating the above described portion of said street ,elects
21 to proceed under and in accordance with the provisions of the "Public
22 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of
23 the Streets and Highways Code of the State of California.
24 SECTION 3. That the hour of 10:00 A.M. on the 18th day of April ,
25 1988 in the Council Chamber of the City Hall , San Bernardino, California,
26 be, and the same hereby is fixed as the time and place when and where all
27 persons interested in or objecting to the proposed vacation may appear
28
l before the said Mayor and Common Council and offer evidence in relation
2 thereto. For further particulars as to the proposed vacation of the
`; herei nbefore described portion of said street, reference is made to that
4 certain map marked "Plan No. 7339" approved September 22, 1987, on file
5
in the office of the City Clerk of said City.
G SECTION 4. That the City Engineer of the City of San Bernardino
7 hereby is directed to cause Notices of Street Vacation to be posted as
8 required by the Public Streets, Highways and Services Vacation Law.

SECTION 5. That the City Clerk shall certify to the adoption of
10 this Resolution of Intention and shall cause the same to be published once a
11 week for two successive weeks in The Sun, a newspaper published and
12 circulated in the City of San Bernardino, prior to the date of the above
13 public hearing.
