CITY_ OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
At its meeting of October 5 , 1987 , the Mayor and Common Council
adopted Resolution No . 87-347 authorizing the Purchasing Agent
to issue a purchase order for the financing of new furniture
purchased for City Hall . The purchase order was to be issued
for delivery of such financing in conformance with Bid
Specification No . F-87-38. A purchase order was thereafter
issued to Pacificorp Capital , Inc .
In response to the purchase order , Pacificorp issued a contract
with numerous appended documents for execution by the City.
These documents set forth the specific terms and conditions of
the financing . After lengthy discussion , it was determined
that the terms of the financing were unacceptable . An
alternative financing approach has been adopted .
The authority for the issuance of the purchase order should be
repealed to avoid claims based on the outstanding purchase
order .

RESOLUTION NO. 87-347 ENTITLED "RESOLUTION . AWARDING A BID
3 TO PACIFIC CORP. CAPITAL, INC. , FOR THE FURNISHING AND DELIVERY
OF LEASE PURCHASE FINANCING TO BE UTILIZED BY CITY HALL IN
4 ACCORDANCE WITH BID SPECIFICATION F-87-38" .
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

7 SECTION 1. Resolution No . 87-347 is hereby repealed .
8 I HEREBY CERTIFY that the foregoing resolution was duly
9 adopted by the Mayor and Common Council of the City of San
10 Bernardino at a meeting thereof , held on
