CONSIDERATION OF FULL DEPARTMENT STATUS FOR COM- MUNITY DEVELOPMENT DIVISION - The Committee recommended elevation of this Division to Department status effective with the 88-89 Budget . (See attached justification) 2 . RECOGNITION OF EMPLOYEES - Item continued. Several recommendations were made for Personnel Director to incorpor- ate and bring back to the Committee. 3 . RESOLUTION AUTHORIZING CITY PERSONNEL ACCESS TO CRIMINAL HISTORY NEEDED TO EVALUATE PROSPECTIVE APPLICANTS FOR EMPLOYMENT CERTIFICATION AND LICENSING AND REPEALING RESOLUTION 87-16 - Item discussed. Changes recommended. staff will bring new draft resolution to the full Council the first meeting in March. 4 . BOND COUNSEL INTERVIEW AND SELECTION - The Committee discussed and agreed that the ordinance identifying responsi- bility of departments be adhered to. This was a "walk-on" item by the City Attorney. 5. CITY ATTORNEY PERSONNEL INCREASE - The Committee received a report from the City Attorney regarding the need and intent to hire an additional temporary secretary and a contract attorney to assist in litigation cases. Henderson, Director of Community Development SUBJECT: CONSIDERATION OF FULL DEPARTMENT STATUS FOR COMMUNITY DEVELOPMENT DATE: February 3, 1988 (7333) COPIES: Deputy City Administrator-Development Services; File -------------------------------------------------- Background In November, 1981, the Office of Community Development was merged into the Redevelopment Agency. The Director of Com- munity Development became the Executive Director of the Redevelopment Agency. On September 9, 1986, the Mayor and Common Council adopted resolutions separating the housing and community development functions from the Redevelopment Agency and incorporated said functions into the Administration Department as a division, effective September 15, 1986. During the last quarter of 1987, the Personnel Committee considered a salary adjustment for the position of Director of Community Development. A salary rate study was conducted and the results considered along with a proposed salary increase for the Redevelopment Agency Deputy Director position. A concern was expressed that if the Committee recommended to the Mayor and Common Council a salary rate equal to the average salary set forth in the salary rate study or in line with that of the Redevelopment Agency Deputy Director, the salary for the Director of Community Development position would be higher than certain City department heads. The issue could be resolved if the Committee took action recommendinq full departmental status for the Community Development Division. The Committee requested an item on this subject be prepared and placed on a future Personnel Committee agenda. Such an organizational change seemed natural and logical at the time. As time passed, a number of events have occurred which suggest a review of the original decision is in order. In late 1986, the Mayor and Common Council authorized the establishment and filling of the Deputy City Administrator - Development Services position. The person filling the position would coordinate the Planning, Building and Safety, Public Works and Community Development areas of responsibi- lity. Two (2) Deputy City Administrator positions were structured to reduce the City Administrator's span of control and to provide much needed staff support and coordination in managing municipal services in such a fast growing area. As Community Development made the transition into a full- fledged City operation, it became increasingly apparent that the operation of the Community Development Division was substantially different than that of the other Administration divisions, such as Emergency Services or Data Processing. First, the exposure to the Common Council and the funding of other City departments, particularly Public Works, Public Services and Parks, Recreation and Community Services, adds a level of complexity and a degree of independence not required by other division head positions. The Division Head of Community Development is the only division head invited on a consistent basis to department head staff meetings. Since the separation, Community Development has been asked to assume additional responsibilities, most notably the San Bernardino Economic Development Council (SBEDC) Small Business Loan Program and the City Mobilehome Assistance Program. Additionally, the responsibility of the City Enterprise Zone coordination was assumed and subsequently transferred to the Deputy City Administrator for Development Services. The Community Development Division Head has a lead role in Project Renaissance, if eventually approved by the Mayor and Common Council. All of these functions relate directly to national community development objectives and are a natural extension of what were at one time the "core" area of Community Development's responsibilities. Currently, the division has ten (10) full-time equivalents (F.T.E. 's) which is similar in size to the Attorney's Office (11) , the Personnel Department (12) and the Treasurer's Office (7) , although two (2) of the referenced departments have elected department heads. The number of staff positions, however, is only a part of the equation. The complexity, similarity and number of functions play a very important role in any analysis of this type. C) Housing Rehabilitation: Singlefamily and Multifamily. d) Commercial Rehabilitation. e) Economic Development: Small Business Loans; Incubators; Enterprise Zone Activities. f) Grants: Particularly UDAG, EDA, DOE and State HCD. g) Mobilehome Park Assistance Program. When the salary survey for the Director of Community Develop- ment position was conducted of the same cities and county included in the Personnel Research survey, the question was asked as to whether the person responsible for the same or similar functions as noted above had department of division head status. Conclusions a) The Community Development Division is charged with responsibilities which on occasion place it at the forefront of deliberations by the Mayor and Common Council, necessitating, of course, significant contact between the Director of Community Development and the Mayor and Common Council, Council Committees, and other City department heads. Given certain obvious constraints on the City's General Fund and the rela- tively high profile of the division, this situation is expected to continue into the foreseeable future. b) If the Community Development function is one of the responsibilities to be coordinated by the Deputy City Administrator - Development Services, the situation seems redundant if Community Development is to remain a division of the Administration Department. C) Other City departments are of comparable size, although two (2) of the departments have elected department heads. d) Community Development is income producing, self- sufficient, independent of the City General Fund and is a contributor to the City General Fund through annual lease payments ($1. 25 per square foot) and funds projects which are implemented by other City departments.
