2 ORDINANCE OF THE CITY OF SAN BERNARDINO, ADDING CHAPTER
5 .72 TO TITLE 5 OF THE SAN BERNARDINO MUNICIPAL CODE WHEREBY THE
3 CITY ELECTS TO RECEIVE ITS ALLOCATED SHARE OF SATELLITE WAGERS AT
THE NATIONAL ORANGE SHOWGROUNDS.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:
6 SECTION 1. Chapter 5 .72 is added to Title 5 of the San
7 Bernardino Municipal Code to read as follows:
8 "Chapter 5 .72
9 SATELLITE HORSE RACE WAGERING
10 5 . 72. 010 City receipt of allocated share.
11 Pursuant to the authority of Business and Professions Code
12 Section 19610.4 the City of San Bernardino hereby elects to
13 immediately receive its allocated share of the total parimutual
14 satellite wagers made at the National Orange Showgrounds. This
15 City share currently is set at 0. 33 of 1 percent but shall be
16 adjusted automatically as the percentage is changed by the State
17 law or regulation.
18 5 . 72 . 020 Tax and fee exemption of racing association.
19 Any racing association which conducts the racing meeting at
20 the National Orange Showgrounds shall be, with respect to any
21 racing event conducted by that racing association, exempt from
22 levy or payment of any City license or excise tax or fee,
23 including, but not limited to, any admission, parking or business
24 tax, or any tax or fee levied solely upon the racing association
25 conducting a racing meeting or satellite wagering or any patron. "
26 I HEREBY CERTIFY that the foregoing ordinance was duly
27 adopted by the Mayor and Common Council of the City of San
