2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTIONS
9 . 84 .020 , 96. 84 030 , AND 9 .84 .040 TO THE SAN BERNARDINO MUNICIPAL

ISCHARGE OF A IREARM, DEFINING THE TERM FIREARM, AND PROVIDING

5 THE MAYOR ADD COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
0 ORDAIN AS FOLLOWS:

SECTION 1 . Section 9 .84 .020 is added to the San Bernardino
7 Municipal Code and reads as follows :

"9 .84 .020 Violation - Penalty.

Any person violating any provision of this chapter is
10
guilty of a misdemeanor which, upon conviction thereof , is
11
punishable in accordance wi h the provisions of Section 1 .12 .010
12
of the Code except that any ,erson violating any provision of
13
this chapter using a firearm upon conviction thereof shall be
14
punished by confinement in the county jail for at least two days
15
in addition to any fine imposed . If probation is granted upon
16
the conviction of any person using a firearm, a term of probation
17
shall be a minimum of two days in the county jail in addition to
18
any fine imposed . "

SECTION 2 . Section 9 . 84 .030 is added to the San Bernardino
20
Municipal Code and reads as follows:

"9 .84 .030 Firearm - Defined .

As used in this chapter , the word firearm shall include any
23
device designed to be used as a weapon , from which is expelled a
24
projectile by the force of any explosion , or other form of
25
combustion , and shall include any rocket , rocket-propelled
26
projectile , launcher , or similar device containing any explosive
27
or incendiary material whether or not such device is designed for
28
emergency or distress signalling purposes . "

1 SECTION 3 . Section 9 .84 .040 is added to the San
2 Bernardino Municipal Code and reads as follows:
3 "9 .84 . 040 Exceptions .
4 Nothing herein shall be construed as prohibiting members of
5 a recognized model rocket club or similar organization from
6 discharging model rockets within the City limits , nor shall any
7 teacher or student in public or private school be prohibited from
8 discharging rockets or other projectiles so long as said
9 discharge is part of an organized class or supervised school
10 project . "
11 I HEREBY CERTIFY that the foregoing ordinance was duly
12 adopted by the Mayor and Common Council of the City of San
13 Bernardino at a meeting thereof , held on
14 the day of 1988 , by the following
15 vote , to wit :

9.84 .020 and 9.84 .030 TO THE SAN BERNARDINO MUNICIPAL CODE TO
3 REQUIRE A MINIMUM TWO-DAY JAIL SENTENCE FOR THE UNLAWFUL
DISCHARGE OF A FIREARM AND DEFINING THE TERM FIREARM.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:
6 SECTION 1 . Section 9.84 .020 is added to the San Bernardino
7 Municipal Code and reads as follows:
8 "9.84.020 Violation Penalty.
9 Any person violating any provision of this chapter is
10 guilty of a misdemeanor which-, upon conviction thereof , is
11 punishable in accordance with the provisions of Section 1.12.010
12 of the Code except that any person violating any provision of
13 this chapter using a firearm upon conviction thereof shall be

16 the conviction of any person using a firearm, a term of probation
17 shall be a minimum of two drays ' confinement in the county jail in
18 addition to any fine imposed . "
