Public hearing relative to amendment to agreement with the Home of Neighborly Service. (See Attached) Mayor to open the hearing . . . Motion: That the hearing be closed. FINAL READINGS Motion: That the final reading of the following ordinances be waived and said ordinances be laid over for final passage. 2. Ordinance of the City of San Bernardino adding Sections 9.84.020 and 9.84.030 to the San Bernardino Municipal Code to require a minimum two-day jail sentence for the unlawful discharge of a firearm, and to define the term firearm. (See Attached) 3. Ordinance of the City of San Bernardino, adding Chapter 5.72 to Title 5 of the San Bernardino Municipal Code whereby the City elects to receive its allocated share of satellite wagers at the National Orange Show County Fairgrounds. (See Attached) 4. Request for Closed Session to discuss pending litigation. Motion: That the Common Council recess to Closed Session pursuant to Government Code Section 54956.9(a) to confer with its attorney regarding pending litigation which has been initiated formally to which the City is a party as follows: Hayes vs. Delaney, et al - San Bernardino Superior Court Case No. 240286; Highland Homeowners vs. City of San Bernardino, et al - San Bernardino Superior Court Case No. 241464; Shumpert, et al vs. City of San Bernardino, et al - San Bernardino Superior Court Case No. 223140; City of San Bernardino vs. San Bernardino Baseball Club, Inc. - San Bernardino Superior Court Case No. 239193; Barrett, Inc. vs. City of San Bernardino, et al - San Bernardino Superior Court Case No. 239913; Saldecke, et al vs. City of San Bernardino, et al - San Bernardino Superior Court Case No. 236836; City of San Bernardino vs. California Construction Management, Inc. , et al - San Bernardino Superior Court Case No. 238755; Cable Lakes Associates vs. City of San Bernardino - Superior Court Case No. 238714; In Re Operation Second Chance - United States District Court (Central District) Case Nos. 87-1439 (PAR) (BK No. SB 86-0289 (DN) ) (No. 87-122-(BN) ) - 2 - 1/25/88 5. Request for Closed Session to discuss personnel matters. Motion: That the Common Council recess to Closed Session to consider personnel matters pursuant to Government Code Section 54957. 6. Request for Closed Session to discuss pending litigation. Motion: That the Common Council recess to Closed Session to confer with its attorney regarding pending litigation pursuant to Government Code Section 54956.9(b) ( 1) , as there is significant exposure to litigation. 7. Request for Closed Session to discuss pending litigation. Motion: That the Common Council recess to Closed Session to confer with its attorney regarding pending litigation pursuant to Government Code Section 54956.9(c) , so that Council may decide whether to initiate litiga- tion. 7 8. Resolution of the City of San Bernardino awarding a contract for the repair of leaks in the Convention Center roof. (See Attached memo only) Motion: That further reading of the resolution be waived and said resolution be adopted. Motion: Authorize and direct the City Attorney to prepare Z sole source contract document and authorize and direct the Mayor to execute said contract on behalf of the City. (See Attached) Motion: That the Mayor and Common Council accept the report entitled, "Mobilehome Parks in San Bernardino: A Survey of Residents, an Evaluation of Options and a Proposed Action Plan" , submitted by Connerly and Associates, Inc. Further, that the Mayor and Common Council consider the oral presentation to be made by representatives of Connerly and Associates, Inc. , and take action as deemed appropriate. TO BE HEARD AT 5:00 P. M. - CONTINUED FROM JANUARY 4, 1988 10. Ordinance of the City of San Bernardino providing that rents for mobile home sites shall not exceed those in effect on July 1, 1987, and temporarily prohibiting rental increases therefor, and declaring the urgency thereof. (See Attached) Motion: That the final reading of the ordinance be waived and said ordinance be adopted. 11. Adjourn Meeting. Motion: That the Council Meeting adjourn to Monday, February 1, 1988, in the Council Chambers of City Hall, 300 N. "D" Street, San Bernardino. k "NOTICE: Any member of the public may address this meeting of the Mayor and Common Council on any item appearing on the agenda, by approaching the microphone in the Council Chambers when the item about which the member desires to speak is called, and by asking to be recognized. Any member of the public desiring to speak to the Mayor and Common Council concerning any matter not on the agenda but which is within the subject matter jurisdic- tion of the Mayor and Common Council, may address the body at the beginning of the meeting, during the period reserved for public comment. A five-minute limitation shall apply to each member of the public, unless such time limit is amended by the Common Council. The Mayor and Common Council may refer any items raised by the public to staff, or to any commission, board, bureau or committee for appropriate action or have the item placed on the next agenda of the Mayor and Common Council. However, no action shall be taken on any item which does not appear on the agenda unless the action is otherwise authorized in accordance with the provisions of subdivision (b) of Section 54954.2 of the Government Code". Completion of a public speaker information form, located at the entrances to the Council Chambers, stating the name, address, phone number of the petitioner and the nature of the subject to be addressed will not only assist the City Clerk in correctly identifying that individual for the public record, but will enable t e Mayor to assure the petitioner an opportiinity to speak. u SUPPLEMENTAL AGENDA JANUARY 25, 1988 S-1 Resolution of the City of San Bernardino awarding a contract to McLaughlin Construction Co. , Inc. , for the construction of the Senior Citizens Center in Perris Hill Park, and approval of Change Order ##1. Motion: That further reading of the resolution be waived and said resolution be adopted.
