Bids for this project were opened at 2 : 00 p . m . , Tuesday ,
1- 12-88 .
A total of 11 bids were received , ranging from $290 ,990 . 50
to $437 , 369 . 90 , for the Basic Bid . The low bid of $290 ,990 . 50 is
6 . 9% under the Engineer ' s Estimate of $312 ,656 . 00 .
Eleven ( 11 ) Additive Alternates were included in the bid
documents . As many of these alternates as could be financed were
to be included in the contract . The alternates proposed for in-
clusion are shown below.
Alternates No . 1 through 4 relate to the grading and
irrigation system for the area between the baseball field and
California Street . Installation of brick dust for the infield is
Alternate No . 9 , which needs to be done during initial construction .
The Alternates not proposed for inclusion in the contract
are :
Hydrospraying ( the area between the baseball field and
California Street ) , bleachers , scoreboard and trees .
Seed can be applied by City Forces in lieu of the hydro-
spraying , and the bleachers , scoreboard and trees can be installed
at a later date without any significant increase in cost .
Listed below is an estimate of the total project cost ,
based upon the actual low bid price :

The amount shown for contingencies is less than normal ,
which could result in a funding shortfall if extra work is needed .
A contingency account is provided in the Park Construction Fee
Fund . These funds will be used as needed to cover any unantici -
pated cost on this project .

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO FERNANDO ORTEGA CONSTRUCTION FOR IMPROVEMENT OF
3 RIO VISTA (ANNE SHIRRELLS ) PARK, PHASE II -B .
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS :
5 SECTION 1 . Fernando Ortega Construction is the lowest
6 responsible bidder for : Improvement of Rio Vista (Anne Shirrells )
7 Park , Phase II -B , in accordance with Plan No . 7038 , for the total
8
amount of $328 ,416 . 50 ; a contract is awarded to said bidder
9 accordingly for the Basic Bid and Additive Alternates Nos . 1 , 2 ,
10 3 , 4 and 9 , but such award shall be effective only upon the
11 contract being ull executed b the
9 Y y parties ; all other bids
12 therefor are hereby rejected ; and the Mayor is hereby authorized
13 and directed to execute said contract on behalf of the City ; a
14 copy of the contract is attached hereto , markled Exhibit "A" and
15 incorporated herein by reference as fully as though set forth at
16 length .
17 SECTION 2 . Execution and Amendments . This contract and
18 any amendments or modifications thereto shall not take effect or
19 become operative until full signed and executed b
p y 9 y the parties
20 and no party shall be obligated hereunder until the time of such
21 full execution . No oral agreements , amendments , modifications or
22 waivers are intended or authorized and shall not be implied from
23 any act or course of conduct of any party .
24 SECTION 3 . All or a portion of the funds to be expended
25 in the construction of the ro ect are
p j provided by the United
26 States Department of Housing and Urban Development ( HUD ) . This

contract and any amendments or modifications thereto shall not
28 take effect or become operative until fully signed and executed

by the parties in the manner required by the applicable HUD

2 regulations and no party shall be obligated hereunder until the
3 time of such full execution . No oral agreements , amendments ,
modifications or waivers are intended or authorized and shall not

be implied from any act or course of conduct of any party .

7 adopted by the Mayor and Common Council of the City of San
8 Bernardino at a meeting thereof , held on the
