Synopsis of Previous Council action:
November 9, 1987 Presentation to Ways and Means Committee
December 21 , 1987 Attorney was directed. to prepare a resolution
"authorizing the development of a pooled excess liability insurance
nroctram. "
Recommended motion:
(1) Adopt resolution authorizing the development of a pooled excess
liability insurance program.
(2) Direct the City Attorney to prepare resolution "authorizing the
execution and delivery of a liability risk coverage agreement and
filing of validation proceedings and certain other actions in
connection therewith" for consideration on February 15 , 1988
agenda of the Mayor and Common Council .

STAFF REPORT
Over the past six months, I have been meeting with officials
from other medium and large cities interested in forming a
fully funded self-insured risk sharing Liability Insurance
Pool . The report, which you received, discussed the pool in
detail. At the luncheon on the 21st of December, the follow-
ing were in attendance to discuss the report. ICRMA - Gordon
Davis; Marsh and McLennan - Gary Martin; Brown and Wood -
Michael Bailey; Kelling, Northcross and Nobriga - Mark
Northcross. At that meeting you took action directing the
City Attorney to prepare a resolution indicating your support
of this program.
The risk sharing fully funded pool would provide the City
with 25 million dollars in liability coverage for approxi-
mately $410-$420, 000 . In years where the payouts do not
exceed premiums paid, refunds of 50% will be made.
The proposed program is supported by cities involved with the
possible exceptions of Torrance and Pasadena. As you have
indicated by your action, it is a program worth the support
and participation of Mayor and Common Council .
It is respectfully recommended that the proposed actions be
taken.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
DEVELOPMENT OF A POOLED EXCESS LIABILITY INSURANCE PROGRAM .

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
4 OF SAN BERNARDINO AS FOLLOWS:

WHEREAS , representatives of the City of San Bernardino (the

7 "City" ) have examined the advisability of participation in a
pooled excess liability insurance program (the "Program" ) , which
8
9 may include the cities of Garden Grove , Fullerton , Huntington
10 Beach , Los Angeles , Oakland , Oxnard , Pasadena , Pomona , Riverside ,
Sacramento , San Bernardino , Santa Ana and San Diego , California
11
12 (the "Prospective Participants" ) , and have taken preliminary
13 steps to develop the Program;
WHEREAS , the City is authorized by Part 6 of Division 3 . 6
14
15 of Title 1 , Section 990 et seq. , of the California Government
16 Code (the "Act" ) to insure its employees against injury resulting
17 from an act or omission in the scope of their employment and to
18 insure against the costs of defending such claims;
19 WHEREAS , pursuant to Section 990 .4 of the Act , the City is
20 authorized to provide insurance by self-insurance which may be
21 funded by appropriations and to establish or maintain reserves
22 for such purposes;
23 WHEREAS , pursuant to Section 990 .6 of the Act , the cost to
24 the City of such self-insurance is a proper charge against the
25 City and , therefore , the Mayor and Common Council of the City of
26 San Bernardino are authorized to make premium payments for such
27 coverage in an amount such Mayor and Common Council determines to
28 be necessary to provide such coverage;
