Description) Finance: Council Notes: IT ,f f I i y ti CIT OF SAN BERNARDW - REOUL :T FOR COUNCIL AC ON STAFF REPORT Under current horseracing law, cities may choose to receive an amount equal to 0. 33 of 1% of the pari-mutuel wagers (defined as the total betting pool) placed at live horse- racing events within city boundaries. Assembly Bill 195, which was recently signed by the Governor, and became effective January 1, 1988, extended this revenue source to include satellite wagering in addition to live horseracing events. Cities and counties which have satellite wagering at County Fairs or District Agricultural Association Fairs, were authorized through this bill to receive . 33 of 1% of the total pari-mutuel wagering conducted on the fairgrounds. This proposed ordinance authorizes the City to immediately receive its allocated share of pari-mutuel wagering at the National Orange Show Fairgrounds. The California Horseracing Board has estimated that approxi- mately $250, 000 to $300, 000 per day in pari-mutuel wagering results at the Orange Show Fairgrounds. Assuming these figures will remain constant for the duration of the horseracing season, which runs about 250 days per year at the Santa Anita, Hollywood Park and Del Mar Race Tracks, the City can expect to generate anywhere from $206, 000 to $247 , 000 per year in revenues. In order to begin collecting these revenues, it is recom- nded that the Council adopt the proposed ordinanace. WILSON Assistant to City Administrator FW/jsg i 75-0254 • a 1� 0 0 0 ORDINANCE NO. 1 ORDINANCE OF THE CITY OF SAN BERNARDINO, ADDING CHAPTER 2 5 .72 TO TITLE 5 OF THE SAN BERNARDINO MUNICIPAL CODE WHEREBY THE CITY ELECTS TO RECEIVE ITS ALLOCATED SHARE OF SATELLITE WAGERS AT 3 THE NATIONAL ORANGE SHOW COUNTY FAIRGROUNDS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 SECTION 1. Chapter 5 .72 is added to Title 5 of the San 6 Bernardino Municipal Code to read as follows: Chapter 5 .72. Satellite Horse Race Wagering 8 Sec. 5.72.010 City receipt of allocated share. 9 Pursuant to the authority of Business and 10 Professions Code Section 19610.4 the City of San 11 Bernardino hereby elects to immediately receive its 12 allocated share of the total parimutual satellite 13 wagers made at the National Orange Show County 14 Fairgrounds. This City share currently is set 15 at 0 . 33 of 1 percent but shall be adjusted 16 17 automatically as the percentage is changed by the State law or regulation. 18 19 Sec. 5.72. 020.
