STAFF REPORT
The California State University - San Bernardino offered to
pay $50 ,000 toward the cost of installing traffic signals at the
intersection of University. Parkway and Northpark Boulevard . At the
Council Meeting of 10-19-87 , this offer was accepted . Also , the
allocation of $50 ,000 from Federal -Aid Urban Funds and the transfer
of $15 ,000 , from fees collected from developers , was approved .
The proposed Standard Agreement , Contract No . 49870091 , pro-
vides , in general , that the State will pay Contractor (City of San
Bernardino) a total amount of $50 ,000 for its share of the project .
All work is to be completed within 18 months .
We recommend that the Standard Agreement be approved .
The letter of transmittal , from J . L . Lemond , Procurement
and Support Services Officer , requests that an authorized official
sign all copies and initial the deleted paragraph on the second
page , which is a hold harmless clause . This clause states that the
City will hold the University harmless , and was deemed not needed .

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A STANDARD AGREEMENT WITH CALIFORNIA STATE UNIVERSITY
3 SAN BERNARDINO , RELATING TO THE PAYMENT OF $50 ,000 TOWARD THE
COST OF INSTALLING TRAFFIC SIGNALS AT UNIVERSITY PARKWAY AND
4 NORTHPARK BOULEVARD .
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS :

SECTION 1 . The Mayor of the Cite of San Bernardino is

hereby authorized and directed to execute , on behalf of said
8
City , a Standard Agreement with California State University ,
9
San Bernardino , relating to the payment of $50 ,000 toward the
10
cost of installing traffic signals at University Parkway and
11
Northpark Boulevard , which agreement is attached hereto , marked
12
Exhibit "A" and incorporated herein by reference as fully as
13
though set forth at length .

SECTION 2 . The agreement shall not take effect until
15
fully signed and executed by both parties . The City shall not be
16
obligated hereunder unless and until the agreement is fully
17
executed and no oral agreement relating thereto shall be implied
18
or authorized .

I HEREBY CERTIFY that the foregoing resolution was

duly adopted by the Mayor and Common Council of the City of San
21

It is the intent of the State to support the installation of traffic signals at the intersection
of Northpark Boulevard and University Parkway. Contractor will provide all necessary procedures
for this installation including, but not limited to, all required architectural and engineering
designs, environmental reports, bids, and award of contract for installation of the signals.
This agreement will be effective upon final approval and shall be completed within eighteen
months from the effective date. This agreement requires the approval of the Office of the
Chancellor and is not valid until so approved.
State will pay Contractor a total amount of $50,000.00 for its share of this project. Payment
of $25,000.00 will be made after completion of the design portion of the project and receipt of
invoice in duplicate by the Accounting Office, California State University, San Bernardino,
5500 University Parkway, San Bernardino, CA 92407-2397. Payment of the balance of $25,000.01-
will be made upon completion of the installation of the signals and receipt of invoice as
detailed above.
The on-campus coordinator of this project is William Shum.

8. All contracts in excess of $10,000.00 will be subject to the examination
and audit of the Auditor General for a period of three years after final
payment under this contract.
9. By signing of this contract, the Contractor does swear under penalty of
perjury that no more than one final unappealable finding of contempt of
court by a Federal Court has been issued against contractor within the
immediately preceding two-year period because of Contractor's failure to
comply with an order of a Federal Court which orders Contractor to comply
with an order of the National Labor Relations Board.
