MUNICIPAL CODE Presently , the San Bernardino Municipal Code does not refer to the State mandated requirement for convenience zones and recycling facilities . In the Fall of 1986 , AB 2020 , the California Beverage Con- ( tair.er Recycling and Litter Reduction Act was signed into law. The legislation establishes a beverage container recycling program, which is to be administered by the State Department of Conservation , Division of Recycling . The program mandates the establishment of convenience zones for recycling centers throughout the State where consumers can redeem for cash their glass , aluminum, plastic and non- aluminum metal beverage containers . The centers must be located within designated convenience zones an area within a 1/2 mile radius of any supermarket that conducts $2 million a year or more in business. Recycling centers must be cer- tified by the Division of Recycling before redemption or reimbursement fees are paid to the consumers . The burden establishing and running the program rests on private industry . On September 1 , 1987 , beverage distributors began to pay a penny per container into a special fund for every beverage container offered for sale in the State . Gn October 1 , 1987 , consumers who recycle began to receive the penny redemption value plus applicable bonuses established by the Division of Recycling . Stores selling beverage containers after December 31 , 1987 that do not have a recycling facility sited in the convenience zone in which they are located , must either redeem all four container types or face a daily fine of $100 . Amendment To Text 87-4 Planning Commission meeting of February 2 , 1988 Page 2 Local governments are responsible for issuing permits for the siting of recycling center facilities and any concommitant changes to zoning ordinances relative to AB 2020 implemen- tation . Since October , the City has been issuing temporary permits for the siting of mobile units for recycling . Those permits will expire March 1 , 1988 . CEOA An Initial Study was prepared and presented to the Env-:.on- mental Review Con.mi `tee on December 30 , 1987 . It is recom- mended a Negative Declaration be adopted for the text a:�.end- ment . The public review period for the Initial Stud, and Negative Declaration was trom January 4 , 1988 to January i` , 1988 . No comments were received . (See Attachment "B" ) ANALYSIS Calitornia State enacted the Calitornia Beverage Container Recycling and Litter Reduction Act of 1986 . This law requires redemption centers for recyclable materials 'be located within 1/2 mile radius of any supermarket which does a gross annual business of $2 million or more. In response to that legislation, the City proposes to permit recycling tacilities to be located in those areas with the following procedures . COMMENTS_RECEIVED Comments regarding the proposed signage restrictions have been received from two recycling companies . The comments contend that the allowable area proposed is not in keeping with other jurisdictions and , therefore , mobile units which are uniform in appearance with unknown destinations m&y have allowable signage in most cities but would have signage in excess of allowable area in San Bernardino . Our proposal is for signage of 20% of the side of the unit or 16 sq. ft. whichever is less . Most cities where ordinances were modeled after the Ordinance proposed by the League of California Cities allow 20% or 16 sc.. ft . whichever is greater . The other comment received regards the proposed requirement that the "color and design be compatible with surrounding uses and neighborhood . " Comments from a company which utilizes the igloo-type kiosk collectors state that the co] ox of the igloo is bonded in during manufacturing and repainting to match any given shopping center is not practical in that paint applied to a bonded surface does not adhere to the surface . RECOMMENDATION Staff recommends that the Planning Commission : 1 . Adopt the Negative Declaration; and 2 . Approved Amendment to Text 87-4 . Respectfully submitted , R. Section 19. 04. 467 is added to the San 15 Bernardino Municipal Code as follows: 16 "19. 04. 467 Recycling facility. 17 'Recycling facility ' means a center for the collection 18 and/or processing of recyclable materials . Recycling facilities 19 include but are not limited to reverse vending machines , kiosks , 20 mobile units , and processing facilities . " 21 SECTION 3. Section 19. 04. 468 is added to the San 22 Bernardino Municipal Code as follows : 23 "19. 04. 468 Recycling material . 24 'Recycling material ' means reusable domestic containers 25 including but not limited to metals , glass , plastic and paper 26 which are intended for reuse , remanufacture , or reconstitution 27 for the purpose of reusing the altered form, but does not include 28 refuse or hazardous materials . Section 19. 04. 517 is added to the San 2 Bernardino Municipal Code as follows : 3 "19. 04. 517 Supermarket . 4 ' Supermarket ' means a full-service , self-service retail 5 store with gross annual sales of two million dollars or more and 6 which sells a line of dry grocery, canned goods , or non-food 7 items and some perishable items . " 8 SECTION 5. Section 19. 24 . 020 Subsection (A) of the San 9 Bernardino Municipal Code is amended to read as follows: 10 "A. Retail stores of the following types conducted 11 wholly within an enclosed structure . Excepted from this section 12 are recycling facilities of the following types : reverse vending 13 machines , small collection facilities , mobile units , and kiosk- 14 type collection facilities as defined in Chapter 19. 41. No 15 outdoor display of merchandise other than motor vehicles shall be 16 permitted unless approved under Chapter 5. 22 pertaining to 17 outdoor sales and displays: 18 1. Bakery employing not more than five persons; 19 2. Book store; 20 3 . Confectionery store; 21 4. Drugstore; 22 5. Drygoods or notions store; 23 b. Florist or gift shop; 24 7. Grocery, fruit , or vegetable store; 25 8. Hardware or electrical appliance store; 26 9. Jewelry store; 27 10 . Meat market or delicatessen store; 28 3-1-88 2 DAB:cm AMA 1 11. Packaged ice station; 2 12. Photographic supplies store; and 3 13. Stationery store . 4 SECTION 6. Section 19. 26. 020 Subsection B is amended to 5 read as follows: 6 "23 . Recycling collection facilities of the following 7 types as defined in Section 19. 41. 020: 8 1. Reverse vending machines; 9 2. Mobile units; and 10 3. Kiosk-type units . 11 SECTION 7. Section 19. 36. 020 Subsections V through AA is 12 amended to read as follows: 13 "V. Recycling facilities of the following types as defined 14 in Section 19. 41. 020: 15 1. Subsection BB is added to Section 19. 36. 020 to 23 read as follows : 24 "BB. Such other uses which the Planning Commission 25 determines to be similar in nature and which do not produce 26 obnoxious noise , odor , dust , smoke , glare or other nuisance . Chapter 19. 41 is added to the San Bernardino 2 Municipal code as follows : 3 "Chapter 19 . 41 4 Convenience zones 5 19. 41. 010 Purpose . 6 The purpose of this Chapter is to provide a comprehensive 7 and easily understood program to make the redemption and 8 recycling of reusable materials convenient to the consumer in 9 order to reduce litter and increase the recycling of reusable 10 materials . 11 19. 41 . 020 Definitions . 12 A. Recycling or Recyclable Material . Recyclable materials 13 are reusable domestic containers including but not limited to 14 metals , glass , plastic and paper which are intended for reuse , 15 remanufacture , or reconstitution for the purpose of using the 16 altered form. Recyclable material does not include refuse or 17 hazardous materials . 18 B. Recycling Facility. A recycling facility is a center 19 for the collection and/or processing of recyclable materials . A 20 certified recycling facility or certified processor means a 21 recycling facility certified by the California Department of 22 Conservation as meeting the requirements of the California 23 Beverage Container Recycling and Litter Reduction Act of 1986 . A 24 recycling facility does not include storage containers of 25 processing activity located on the premises of a residential , 26 commercial or manufacturing use and used solely for the recycling 27 of material generated by that residential property, business or 28 manufacturer . Recycling facilities may include the following : 3-1-88 4 ILJ p 1 1. Collection Facility. 2 A collection facility is a center for the acceptance 3 by donation redemption or purchase of recyclable materials from i 4 the public . Such a facility does not use power driven processing 5 equipment except as indicated in Section 19. 41. 040 Criteria and 6 Standards . Collection facilities may include the following: 7 a. Reverse vending machine (s) 8 b. Small collection facilities which occupy an area 9 of more than five hundred square feet and may include: 10 1. A mobile unit; 11 2. Bulk reverse vending machines or a grouping of 12 reverse vending machines occupying more than fifty square feet; 13 3. Kiosk-type units which may include permanent 14 structures . 15 C . Large collection facilities which may occupy an 16 area of more than five hundred square feet and may include 17 permanent structures . 18 2. Processing Facility. A processing facility is a 19 building or enclosed space used for the collection and processing 20 of recyclable materials . Processing means the preparation of 21 materials for efficient shipment , or to an end-user 's 22 specifications by such means as baling , briquetting , compacting , 23 flattening , grinding , crushing , mechanical sorting , shredding , 24 cleaning and remanufacturing . Processing facilities include the 25 following : 26 a. Light processing facility occupies an area of 27 under forty-five thousand square feet of gross collection , 28 3-1-88 5 DAB:cm 1 processing and storage area and has up to an average of two 2 outbound truck shipments per day. Light processing facilities 3 are limited to baling , briquetting , crushing , compacting , 4 grinding , shredding and sorting of source separated recyclable 5 materials sufficient to qualify as a certified processing 6 facility. A light processing facility shall not shred , compact , 7 or bale ferrous metals other than food and beverage containers . 8 b. A heavy processing facility is any processing 9 facility other than a light processing facility. 10 C. Reverse Vending Machines . A reverse vending machine is 11 an automated mechanical device which accepts at least one or more 12 types of empty beverage containers including , but not limited to 13 aluminum cans , glass and plastic bottles , and issues a cash 14 refund or a redeemable credit slip with a value not less than the 15 container 's redemption value as determined by the state . A 16 reverse vending machine may sort and process containers 17 mechanically provided that the entire process is enclosed within 18 the machine . In order to accept and temporarily store all three 19 container types in a proportion commensurate with their relative 20 redemption rates , and to meet the requirements of certification 21 as a recycling facility, multiple grouping of reverse vending 22 machines may be necessary. 23 A bulk reverse vending machine is a reverse vending machine 24 that is larger than fifty square feet , is designed to accept more 25 than one container at a time and will pay by weight instead of by 26 container . 27 28 3-1-88 6 nAR•r-m 1 D. Mobile Recycling Unit . A mobile recycling unit means 2 an automobile, truck , trailer , or van , licensed by the Department 3 of Motor Vehicles which is used for the collection of recyclable 4 materials . A mobile recycling unit also means the bins , boxes , 5 or containers transported by trucks , vans , or trailers , and used 6 for the collection of recyclable materials . 7 E. Convenience Zones . An area within a one-half mile 8 radius of a supermarket . 9 F. Supermarket . A full-service , self-service retail store 10 with gross annual sales of two million dollars or more , and which 11 sells a line of dry grocery, canned goods , or non-food items and 12 some perishable items . 13 19. 41. 030 Permits required . 14 No person shall permit the placement , construction or 15 operation of any recycling facility without first obtaining a 16 permit pursuant to the provisions set forth in this section. 17 Recycling facilities may be permitted as set forth in the 18 following table: 19 Type of Facility Zones Permitted Permit Required 20 Reverse Vending All Commercial Administrative Machine (s) All Industrial Review and Permit 21 up to five reverse vending 22 machines 23 Small Collection C-2, C-3 and Administrative All Industrial (DRC) 24 Large Collection C-3 Commercial Conditional Use 25 Industrial Permit 26 Light Processing All Industrial Conditional Use Permit 27 28 Heavy Processing Light Industrial Conditional Use 3-1-88 7 DAB:cm j Heavy Industrial Permit and Site Development 2 19. 41. 040 Criteria and standards . 3 Those recycling facilities permitted with an administrative 4 permit shall meet all of the applicable criteria and standards 5 listed . Those recycling facilities permitted with a conditional 6 use permit or development review shall meet the applicable 7 criteria and standards provided that the Director of Planning , 8 Planning Commission , or City Council as the case may be , may 9 relax such standards or impose stricter standards as an exercise 10 of discretion upon a finding that such modifications are 11 reasonably necessary in order to implement the general intent of 12 this section and the purpose of this Title. 13 The criteria and standards for recycling facilities are as 14 follows: 15 A. Reverse Vending Machine (s) . Reverse vending machine (s) 16 located within a commercial structure do not require 17 discretionary permits . Reverse vending machines do not require 18 additional parking spaces for recycling customers and may be 19 permitted in all commercial and industrial zones with an 20 administrative review and provided that they comply with the 21 22 following standards: 23 1. Shall be established in conjunction with a 24 commercial use or community service facility which is in 25 compliance with the zoning , building , and fire code of the City of San Bernardino. 26 27 2. Shall be located within thirty feet of the entrance to the commercial structure and shall not obstruct 28 pedestrian or vehicular circulation . 3-1-88 8 DAB:cm 1 3. Shall not occupy parking spaces required by the 2 primary use . 3 4. Shall occupy no more than fifty square feet of 4 floor space per installation , including any protective enclosure , 5 and shall be no more than eight feet in height . 6 5. Shall be constructed and maintained with durable 7 waterproof and rustproof material . 8 6. Shall be clearly marked to identify the type of 9 material to be deposited , operating instructions , and the 10 identity and phone number of the operator or responsible person 11 to call if the machine is inoperative . 12 7. Shall have a sign area of a maximum of four 13 square feet per machine , exclusive of operating instructions . 14 8. Shall be maintained in a clean , litter-free 15 condition on a daily basis . 16 9. Operating hours shall be at least the operating 17 hours of the host use . 18 10. Shall be illuminated to insure comfortable and 19 safe operation if operating hours are between dusk and dawn . 20 B. Small Collection Facilities . Small collection 21 facilities may be sited in commercial and industrial zones with 22 Development Review procedures provided they comply with the 23 following conditions: 24 1. Shall be established in conjunction with an 25 existing commercial use or community service facility, located 26 within a convenience zone and which is in compliance with the 27 zoning , building and fire codes of the City of San Bernardino . 28 3-1-88 9 DAB:cm 0 1 2. Shall be no longer than five hundred square feet 2 and occupy no more than five parking spaces not including space 3 that will be periodically needed for removal of materials or 4 exchange of containers . 5 3. Shall be set back at least ten feet from any 6 street line and shall not obstruct pedestrian or vehicular 7 circulation . 8 4. Shall accept only glass , metals , plastic 9 containers , papers and reusable items . 10 5. Shall use no power-driven processing equipment 11 except for reverse vending machines . 12 6. Shall use containers that are constructed and 13 maintained with durable waterproof and rustproof material , 14 covered when site is not attended , secured from unauthorized 15 entry or removal of material , and shall be of a capacity 16 sufficient to accommodate materials collected and collection 17 schedule . 18 7. Shall store all recyclable material in the mobile 19 unit vehicle and shall not leave materials outside of unit when 20 attendant is not present . 21 8. Shall be maintained free of litter and any other 22 undesirable materials , and mobile facilities at which truck or 23 containers are removed at the end of each collection day, shall 24 be swept at the end of each collection day . 25 9. Shall not exceed noise levels of sixty dBA as 26 measured at the property line of residentially zoned or occupied 27 property, otherwise shall not exceed seventy dBA. 28 3-1-88 10 DAB:cm 1 10. Attended facilities shall not be located within 2 one hundred feet of a property zoned or occupied for residential 3 use . 4 11. Collection containers , site fencing , and signage 5 shall be of such color and design so as to be compatible with and 6 to harmonize with the surrounding uses and neighborhood . 7 12. Containers shall be clearly marked to identify 8 the type of material which may be deposited ; the facility shall 9 be clearly marked to identify the name and telephone number of 10 the facility operator and the hours of operation and display a 11 notice stating that no material shall be left outside the 12 recycling enclosure or containers . 13 13 . Signs may be provided as follows : 14 a . Recycling facilities may have identification 15 signs with a maximum of fifteen percent per side or sixteen 16 square feet , whichever is greater in addition to informational 17 signs required in section 4.b . 12; in the case of a wheeled 18 facility, the side will be measured from the bottom of the 19 container to the top of the container . 20 b. Signs must be consistent with the character of 21 their location . 22 C . Directional signs , bearing no advertising message 23 may be installed with the approval of the Director of Planning of 24 necessary to facilitate traffic circulation or if the facility is 25 not visible from the public right-of-way. 26 14 . The facility shall not impair the landscaping 27 required by local ordinances for any concurrent use by this Title 28 or any permit issued pursuant thereto . 3-1-88 11 DAB:cm 1 15. No additional parking space will be required for 2 customers of a small collection facility located at the 3 established parking lot of a host use . One space will be 4 provided for the attendant if needed . 5 16. Mobile recycling units shall have an area 6 clearly marked to prohibit other vehicular parking during hours 7 when the mobile unit is scheduled to be present . 8 17. Occupation of parking spaces by the facility and 9 by the attendant may not reduce available parking spaces below 10 the minimum number required for the primary host use unless all 11 of the following conditions exist: 12 a. A parking study shows that existing parking 13 capacity is not already fully utilized during the time the 14 recycling facility will be on the site; and 15 b. The permit will be reconsidered at the end of 16 eighteen months . 17 18. Small collection facilities shall not be twenty- 18 four-hour operations. 19 19. Small collection facilities may be subject to 20 landscaping and/or screening as determined by the Development 21 Review Committee or Planning Commission . 22 C. Large Collection Facilities . A large collection 23 facility is one that is larger than five hundred square feet , or 24 is on a separate property not appurtenant to a host use , and 25 which has a permanent building . A large collection facility is 26 permitted in community commercial , general commercial , and 27 commercial-manufacturing and industrial zones with a Conditional 28 Use Permit , provided the facility meets the following standards : 3-1-88 12 DAB:cm 1 1. Facility does not abut a property zoned or 2 planned for residential use . 3 2. Facility will be screened from the public right- 4 of-way by operating in an enclosed building . 5 3. Setbacks and landscape requirements shall be 6 those provided for the zoning district in which the facility is 7 located . 8 4. All exterior storage of material shall be in 9 sturdy containers which are covered , secured , and maintained in 10 good condition . Outdoor storage shall be screened by a six-foot , 11 non-see-through fence or wall . No storage , excluding truck 12 trailers shall be visible above the height of the fencing . No 13 outdoor storage shall be permitted in the C-3 General Commercial 14 Zone , or the C-2 Community Commercial Zone . 15 5. Site shall be maintained free of litter and any 16 other undesirable materials , and will be cleaned of loose debris 17 on a daily basis . 18 6. Space will be provided on site for six vehicles 19 to circulate and to deposit recyclable materials . 20 7. Four parking spaces for employees plus one 21 parking space for each commercial vehicle operated by the 22 recycling facility shall be provided for on-site . 23 8. Noise levels shall not exceed 60 dBA as measured 24 at the property line of residentially zoned property or otherwise 25 shall not exceed 70 dBA. 26 9. If the facility is located within five hundred 27 feet of the property zoned , planned or occupied for residential 28 use , it shall not be in operation between 7 : 00 p .m. and 7 : 00 a .m. 3-1-88 13 DAB:cm 1 10 . Any containers provided for after hours donation 2 of recyclable materials will be at least fifty feet from any 3 property zoned or occupied for residential use , shall be 4 permanently located and shall be of sturdy rustproof 5 construction , shall have sufficient capacity to accommodate 6 materials collected and shall be secure from unauthorized entry 7 or removal of materials . 8 11. Donation areas will be kept free of litter and 9 any other undesirable material and the containers will be clearly 10 marked to identify the type of material that may be deposited; 11 facility shall display a notice stating that no material shall be 12 left outside the recycling containers . 13 12. Facility will be clearly marked with the name 14 and phone number of the facility operator and the hours of 15 operation; identification and informational signs will meet the 16 standards of the zone; and directional signs bearing no 17 advertising message may be installed with the approval of the 18 Director of Planning if necessary to facilitate traffic 19 circulation . 20 D. Processing Facilities . Light processing 21 facilities and large processors shall be permitted in all 22 industrial zones with a Conditional Use Permit . 23 1. Facility does not abut a property zoned or 24 planned for residential uses . 25 2. In a commercial or light industrial zone , 26 processors will operate in a wholly enclosed building . 27 28 3-1-88 14 DAB:cm ii 1 3. Power-driven processing shall be permitted 2 provided all noise level requirements are met . Light processing 3 facilities are limited to baling , briquetting , crushing , 4 compacting , grinding , shredding and sorting of source-separated 5 recyclable materials and repairing of reusable materials . 6 4. A light processing facility shall be no larger 7 than forty-five thousand square feet and shall have no more than 8 an average of two outbound truck shipments of material per day 9 and shall not shred , compact or bale ferrous metals other than 10 food and beverage containers . 11 5. Setbacks and landscaping requirements shall be 12 those provided for the zoning district in which the facility is 13 located . 14 6. All exterior storage of material shall be in 15 sturdy containers or enclosures which are covered , secured and 16 maintained in good condition . Storage containers for flammable 17 materials shall be constructed of nonflammable material . No 18 storage excluding truck trailers shall be visible above the 19 height of the fencing . 20 7. Site shall be maintained free of litter and any 21 other undesirable materials , and shall be cleaned of loose debris 22 on a daily basis and shall be secured from unauthorized entry and 23 removal of materials when attendants are not present . 24 8. Space shall be provided on-site for the 25 anticipated peak load of customers to circulate , park and deposit 26 recyclable materials . If the facility is open to the public , 27 space will be provided for a minimum of ten customers . 28 3-1-88 15 DAB:cm 1 9. One parking space will be provided for each 2 commercial vehicle operated by the processing center . 3 10 . Noise levels shall not exceed sixty dBA as 4 measured at the property line of residentially zoned or occupied 5 property, or otherwise shall not exceed seventy dBA. 6 11. If the facility is located within five hundred 7 feet of property zoned or planned for residential use , it shall 8 not be in operation between 7: 00 p.m. and 7: 00 a .m. The facility 9 will be administered by on-site personnel during the hours the 10 facility is open . 11 12. Any containers provided for after-hours donation 12 of recyclable materials will be at least one hundred feet from 13 any property zoned or occupied for residential use shall be 14 sturdy, rustproof construction; shall have sufficient capacity to 15 accommodate materials collected and shall be secure from 16 unauthorized entry or removal of materials . 17 13. Donation areas shall be kept free of litter and 18 any other undesirable material . The containers shall be clearly 19 marked to identify the type of material that may be deposited . 20 Facility shall display a notice stating that no material shall be 21 left outside the recycling containers . 22 14. Sign requirements shall be those provided for 23 the zoning district in which the facility is located . In 24 addition , facility shall be clearly marked with the name and 25 phone number of the facility operator and the hours of operation . 26 15 . No dust , fumes , smoke , vibration or odor above 27 ambient level may be detectable on neighboring properties .
