To Mayor and Common Council From SHAUNA CLARK Subject Survey of food venders Date March 3, 1988 Approved Date On February 4 , 1988 , the Legislative Review Committee considered the issue of allowing hot dog venders in the City of San Bernardino . Prior to the meeting, the City Clerk' s Office conducted a phone survey of 42 cities , mostly in Southern California , and asked each city' s business license division if hot dog and similar venders were allowed in their city. The results of this survey were presented to the committee. Mr . Larue, representing RandChic , disputed the validity of the survey. The Legislative Review Committee agreed that the hot dog issue could come back before the Council when there was new evidence to present . RandChic has submitted a new ordinance for your consideration, and the meantime , we have conducted a new survey . This time , the survey was sent to the Planning Department of the cities first surveyed and results were sent back in writing . Attached for your information are the following documents: 1 . A list of cities surveyed . (The asterisk indicates that written responses were received) 2 . A summary of the surveys received from the Planning Departments of the various cities . (Green) 3. Copies of the survey results received by our office. This survey will illustrate that those cities that allow venders do not allow them to remain stationary except to make a sale or for a ten minute limitation. However, Montclair and Norwalk do allow one cart in front of a warehouse type store. Montclair regulates this through the CUP process. Our City Attorney has expressed reservations with the CUP process because a CUP runs with the land and the hot dog vender is not the land owner . 5� 2 V 3/ /88 Page 2 Vender Survey I feel that any permit process that the Council ultimately agrees to should be equal in scope to a CUP process for equity reasons . If a legitimate , taxpaying , property-owning fast food restaurant came to this city tomorrow to start a business , they would have to have the proper zoning, provide parking and landscaping, pay processing fees , provide refuse disposal , restrooms , and pay a high price for the privilege of applying for a permit to do business. When RandChic applied for a business license they were told that they would have to keep on the move. They have violated the provisions under which the license was granted, but are claiming that since they have a license, they have a vested interest . If you decide not to create an ordinance to allow hot dog venders, please go one step further and declare RandChic ' s licenses null and void on the basis that they have violated the provisions under which the licenses were issued and on the basis that there is a violation of the zoning ordinance. Without a license, RandChics alternatives would not be totally cut off . They can :Hove inside the Home Club and the Buyers Club like they did at PACE and apply for a certificate of occupancy . Their operation at PACE is fully licensed and legitimate. In the Public Right-of-Way, when someone applies for a Pushcart Peddler's License (Under section 869 of the SF Police Code) , the application is reviewed by the City Planning Department. It is disapproved if the right-of-way is adjacent to a residential district. If it is adjacent to a Public district, it is disapproved unless the agency or department with jurisdiction over that Public district rec- ommends otherwise. Additional regulations having to do with safety, hours of operation and interference with established business are contained in the Police Code. 2. In some commercial zones, existing food establishments may have outdoor sales and service areas in the front of the property as a permitted use and may apply for conditional use authorization from the City Planning Commission to have outdoor sales and service areas other than the front of the property. Permitted hours of operation are 6a.m. to 2a.m. .
