Sutton, SUBJECT: Appeal of Board of Building Director/Building Official Commissioners decision for Dept: BUILDING & SAFETY DEPARTMENT 151 South "I" Street (ITEM 21 ) Date: March 4, 1988 ' Synopsis of Previous Council action: The subject property was brought to the Board of Building Commissioners Meeting on November 6, 1987, with a recommendation to demolish the property. The recommendation stemmed not only from the condition the property was in, but also the fact that the property had been vacant and the zone had changed from a residential use to a manufacturing use. This condition had existed for more than 180 days, as the Municipal Code provides, the property had lost its vested right to continue as a residential use. An Appeal was made by a Mr. Mier, which the Mayor and Common Council heard on January 4, 1988, The Mayor and Common Council gave Mr. Mier 90 days to rehabilitate the structure. To date, no attempts Have been made to rehabilitate the property; however, a 60-day rehabilitation permit was issued and will expire on March 7, 1988. Staff recommends that the Mayor and Common Council direct the demolish of the structure and the clean-up of the lot, and that all costs be assessed against the property in form of a lien. Schweitzer, City Administrator ------------------------------------------------------------- Attached is a copy of information on the above subject which was heard by the Mayor and Common Council at their January 4 , 1988 , meeting. As I recall, the Board of Building Commissioner's (BBC) decision was reversed and the property owner was given 90 days to rehabilitate the structure. Please check the status of the building permit and advise of the progress. If rehab work is not occurring, the item would need to go back to the Mayor and Common Council for demolition. �ESC. SAN BERNAR.ANO — REQUcEST FOR COUNCIL ACTION STAFF REPORT At the November 6, 1987, meeting of the Board of Building Commissioners (BBC) , staff recommended immediate demolition of the house located at 151 South "I" Street. On November 19, 1987, the property owner, Mr. Peter Mier, filed a letter (attached) with the City Clerk' s Office appealing the decision of the BBC. The Mayor and Common Council will need to set a public hearing for December 21st on this appeal. URGENCY CLAUSE: Staff could not prepare the request for Council action in a timely manner and placement as a supplemental agenda item will avoid further delay of hearing until January 4 , 1987 .
