Synopsis of Previous Council action: 11/17/87 --- Resolution No. 87-404 was approved, ordering the vacation of State Street, North of Sheridan Road. 02/15/88 --- The quitclaiming of the west side of State Street, now vacated, to University Square, a Joint Venture, was approved in principal, and the Real Property Section was authorized to proceed with the preparation of the necessary documents. University Square, the property owner adjoining vacated State Street to the east, had underlying fee title to the easterly 40 feet of State Street. They have submitted plans to develop this area. The westerly 20 feet of State Street was owned by the City, and is now under our ownership. It has been determined that this strip of land is of no use to the City. The parkway area on the west side of State Street has been planted with grass, and is maintained as a part of the landscaping on the Edison easement. To instal Ilandscaping on the remaining portion of the 20 feet strip owned by the City would cost in excess of $13,000, with an annual maintenance cost of $1,760. University Square would like to acquire this strip of land from the City for use in their developments. The existing portion that was improved as a part of State Street will be retained. Maintenance of the grassed area will be assumed by University Square. On February 17, 1988, approval was granted, in principle, for quit-claiming the westerly portion of State Street, north of Sheridan Road, to University Square, and the Real Property Section was authorized to proceed with the preparation of the necessary documents. Based on the above, it is recommended that the attached resolution authorizing and directing the execution of a Quit-Claim Deed to University Square be approved. JUSTIFICATION FOR PLACEMENT ON SUPPLEMENTAL AGENDA This document was received by the City Attorney' s Office on 3-2-88 after the Regular Agenda deadline.
