Public Hearings 6A. Public Works RES. 2015-143 — Resolution of the Mayor and Common Council of the City of San Bernardino Finding and Determining that the Public Interest and Necessity Require the Acquisition of a Permanent Easement and a Temporary Construction Easement Over a Portion of Certain Real Property Located Southwesterly of Cajon Boulevard and Northerly of Kenwood Avenue, Known as Assessor's Parcel Number 0349-101-25-0000, Unincorporated San Bernardino County, California, for the Water Department Relative to the Kenwood Well Field 20" Transmission Main Project, in San Bernardino County, California. Mayor Davis opened the hearing. Pursuant to Resolution No. 2000-279, City Clerk Hanna administered an oath to those individuals wishing to speak on the matter that they would provide true and honest testimony. Robert and Janet Aaberg, San Diego, owners of the subject property, submitted into the record a document entitled, "Request to be Heard at Hearing on Resolution of Necessity." Mr. and Mrs. Aaberg spoke in opposition to the proposed project and requested that the 20"pipeline be rerouted so it would not encumber their property. C, Matthew Litchfield, P.E., Water Utility Director, stated that the pipeline alignment was chosen for both economic and operational reasons and that rerouting the pipeline, as was suggested by the Aabergs, would result in excess costs to the department and its rate payers. He added that the proposed route was the path of least resistance in regards to the environmental species that exist in that area. Council Member Valdivia asked if the Water Department made every attempt to compensate the Aabergs. Julianna Tillquist, Attorney with Redwine and Sherrill, stated that an offer of$4,500 was made pursuant to the Government Code and she attempted to engage in discussions with the Aabergs regarding that offer. She advised that the Aabergs did make a counter offer of $100,000, which was not seriously considered because it was over 20 times the valuation the appraiser had put on the easement. Ms. Tillquist stated that the appraisal for eminent domain purposes had to look at severance damages, and the amount of the appraisal opinion indicated that the appraiser did not believe the project would hamper future development on the subject property. City Attorney Request to Authorize and Direct City Attorney to Pursue Administrative Appeals of Anticipated Decision of Governor Not to Designate City of San Bernardino as a Workforce Development Area Under Workforce Innovation and Opportunity Act of 2014. Council Member Johnson made a motion, seconded by Council Member Mulvihill, to Authorize and Direct City Attorney to Pursue Administrative Appeals of Anticipated Decision of Governor Not to Designate City of San Bernardino as a Workforce Development Area Under Workforce Innovation and Opportunity Act of 2014. No vote was taken. City Manager Parker explained that the City has been carrying SBETA out of the General Fund because the City's single audits for 2012/2013 were not submitted in a timely manner and because the City has been on cash hold since October 2014. He stated that he fully expected that the $1.3 million would be returned once the audits were completed. He requested a 90-day authorization to continue to support SBETA while the City goes through the appeal process. Council Member Johnson stated that he would amend his motion to include the 90-day authorization to continue to support SBETA while the City goes through the appeal process. After some discussion, Council Member Mulvihill pulled his second. Council Member Johnson stated he would amend his motion by removing the 90-day authorization, and adding that a workshop be set for the week of July 13, 2015. Motion: Authorize and Direct City Attorney to Pursue Administrative Appeals of Anticipated Decision of Governor Not to Designate the City of San Bernardino as a Workforce Development Area Under Workforce Innovation and Opportunity Act of 2014; and set a workshop to be held the week of July 13, 2015, to discuss SBETA. ....................... Jacob Kuenz, San Bernardino, spoke about PACE financing for solar, water and other needs for residential, commercial and multi-family. Robert Porter, San Bernardino, stated that the City needed to finish the audit; spoke about the sexual assault that took place at the Carousel Mall prior to the Great Race event; and thanked the Council for approving his micro-grant from the Fine Arts Commission. Scott Olson, San Bernardino, suggested that San Bernardino Water Department Board Members be elected by the voters rather than selected by the Mayor and approved by the Council; stated that he would be working with outside individuals to put the repeal of the utility tax on the ballot; and spoke about the outsourcing of Refuse. Sandra Ibarra, San Bernardino, said she did not see any police officers enforcing the use of illegal fireworks in her neighborhood on the Fourth of July; and stated that there were a lot of potholes in the 2nd Ward. Elizabeth Flores, San Bernardino, spoke about the closure of a fire station in the 6rn Ward. Jay Lindberg, San Bernardino, spoke about the Trans-Pacific Partnership. Al Palazzo, Rialto, said he was going to apply for the Economic Development position, but would not accept more than $50,000, and that the difference should be used to keep the fire station open. Rudi Flores, San Bernardino, spoke about the need to get rid of fire unions and recent improvements on the west side, including LED lights. William Cioci, San Bernardino, spoke about how hard it is to end the discrimination against disabled patients, and stated that San Bernardino is close to becoming the pot capitol of the world, with its biggest competitors being Las Vegas, Denver, Amsterdam and Prague. 9.
