RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DIRECTING THE CITY CLERK TO TRANSMIT THE
CHARTER BALLOT MEASURE FOR PURPOSES OF PREPARATION OF AN
IMPARTIAL ANALYSIS.

5 WHEREAS, the Mayor and Common Council of the City of San Bernardino has adopted a
6 Resolution calling a Special Municipal Election on a proposed new city charter and requesting that
7 said Special Municipal Election be consolidated with the November 7, 2000 statewide presidential
8 general election conducted by the County of San Bernardino; and
9 WHEREAS, the City of San Bernardino has adopted a Resolution proposing said new
10 charter, and
1 1 WHEREAS, the City of San Bernardino has further adopted a Resolution submitting to the
12 qualified electors of said City for their consideration the proposed new charter; and
1 WHEREAS, the law firm of Gresham, Savage, Nolan & Tilden, LLP has been retained by
14 the City to assist the City in analyzing the proposed new charter; and
15 WHEREAS, the proposed new charter, if adopted, would alter the position of the City
16 Attorney of the City of San Bernardino from one of being elected by the people to one of being
17 appointed by the Mayor and confirmed by the Common Council; and
18 WHEREAS, the charter ballot measure would alter the organization of the office of the City
19 Attorney; the City Attorney not wishing to give the appearance of a conflict of interest by preparing
20 the impartial analysis respectfully declines to do so;
21 NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
22 OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
23 Pursuant to the State of California Elections Code, the City Clerk is hereby directed to
24 transmit a copy of the charter ballot measure, with all other necessary documents, to the law firm
25 of Gresham. Savage, Nolan & Tilden, LLP, for the purpose of having that law firm prepare the
26 impartial analysis of said charter ballot measure.
