MOTION: That full reading of the resolutions and ordinances on the regular agenda of the Mayor and Common Council and Community Development Commission dated September 19, 2011, be waived. 6. Council Minutes. (See Attached) MOTION: That the claims and payroll and the authorization to issue warrants as listed in the memorandum dated September 14, 2011, from Barbara Pachon, Director of Finance, be approved. 8. (See Attached) MOTION: That the personnel actions, as submitted by the Chief Examiner, dated September 15, 2011, in accordance with Civil Service rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. 5 09/19/2011 City Attorney 9. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of a Professional Services Agreement between Mundell, Odlum & Haws and the City of San Bernardino in the Case of San Bernardino City Professional Firefighters, Local 891 v. City of San Bernardino, et al., Public Employment Relations Board Unfair Practice Charge No. LA-CE- 714-M. (See Attached) All Wards MOTION: That said resolution be adopted. City Manager 10. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of an agreement with the San Bernardino Symphony Orchestra for the promotion of Arts & Culture. (See Attached) (Resolution not available at time of printing.) Ward 1 MOTION: That said resolution be adopted. Fire 11. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the San Bernardino City Fire Department (SBCFD) to enter into a Cooperative Agreement with the United States Department of Agriculture (USDA), San Bernardino National Forest, relating to fire protection and rescue services within the mutual threat zone. Resolution of the Mayor and Common Council of the City of San Bernardino ratifying the submittal of the 2011 Assistance to Firefighters Grant Program on- line application to the Department of Homeland Security in the amount of $173,200. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing a purchase order in the amount of $90,000 to New World Systems Corporation for software configuration and training-related expenses. MOTION: That said resolution be adopted; and that the Director of Finance be authorized to amend the FY 2011-12 IT budget by transferring $90,000 from Account No. 679-250-5704-0000-00658 to Account No. 679-250-5181-0000-0058. 14. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the award of annual purchase orders for the City's 800 MHz Voice/Data Backbone, MDC/MDT maintenance, dispatch console maintenance, and user equipment maintenance with the County of San Bernardino's 800 MHz Group. Resolution of the Mayor and Common Council of the City of San Bernardino awarding a contract to Elite Companies US, Inc. for pavement rehabilitation on Meridian Avenue from UPRR overcrossing to Foothill Boulevard (SS11-002), per Project Plan No. 12796. (See Attached) (Cost to the City - $180,193.70 from Streets and Street Lighting (SS11-002); Cross Gutters and Drainage Inlet Repairs (SD-A) (Resolution not available at time of printing.) Resolution of the City of San Bernardino authorizing and directing execution of a License Agreement with Magnolia Highland, L.P., for an encroachment within Medical Center Drive, located at 2196 Medical Center Drive, within the City, for the installation, operation, and maintenance of a bus stop shelter and appurtenant facilities. Resolution of the Mayor and Common Council of the City of San Bernardino awarding a contract to DBX, Inc., for Traffic Signal Installation and Street Improvements at Medical Center Drive and Magnolia Avenue (TC07-001) per Plans and Special Provisions Nos. 12031 & 12031A. Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of an agreement and issuance of a purchase order in the amount of$34,306.63 to Generator Services Company, Inc for repairs to the emergency generator at the Police Department headquarters. Public Hearing - First Amendment to Development Agreement No. 91-01 between the City of San Bernardino and the developer of the Inland Center Mall (No Cost to the City) (Backup materials distributed on July 18, 2011, Item No. 33; item continued to August 15, 2011, Item No. 16; item continued to September 6, 2011, Item No. 27.) Ward 3 A resolution of the Mayor and Common Council of the City of San Bernardino approving First Amendment to Development Agreement No. 91-01 between the City of San Bernardino and the developer of the Inland Center Mall, located at 500 South Inland Center Drive. The hearing remains open... MOTION: That the matter be continued to October 17, 2011. END OF PUBLIC HEARINGS STAFF REPORTS Police 20. Resolution of the City of San Bernardino authorizing a contract with American Traffic Systems (ATS) of Phoenix, Arizona for an upgrade to the City's Red Light Camera Enforcement System, and to authorize the Director of Finance to increase the Red Light Camera Program revenue and expenditures. (See Attached) (Cost to the City - $669,238 from FY 2011/12 Traffic Safety Program, Other Professional Services) (Resolution not available at time of printing.) MOTION: That said resolution be adopted; and that the Director of Finance be authorized to amend the FY 2011/12 budget by increasing the Red Light Camera Program revenue (128-210-4441-000) by $662,348 and increasing the Red Light Camera expenditures (128-210-5505-0000-0087) by $552,238 as discussed in the staff report from the Chief of Police dated September 13, 2011. PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA: A three-minute limitation shall apply to each member of the public who wishes to address the Mayor and Common Council/Community Development Commission on a matter not on the agenda. No member of the public shall be permitted to "share" his/her three minutes with any other member of the public. (Usually any items heard under this heading are referred to staff for further study, research, completion and/or future Council/Commission action.) 22. Adjournment. MOTION: That the meeting be adjourned. NOTE: The next joint regular meeting of the Mayor and Common Council/Community Development Commission is scheduled for 1:30 p.m., Monday, October 3, 2011, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 9 09/19/2011 NOTICE: Any member of the public may address this meeting of the Mayor and Common Council/Community Development Commission on any item appearing on the agenda by approaching the microphone in the Council Chambers when the item about which the member desires to speak is called and by asking to be recognized. Any member of the public desiring to speak to the Mayor and Common Council/Community Development Commission concerning any matter not on the agenda but which is within the subject matter jurisdiction of the Mayor and Common Council/Community Development Commission, may address the body at the end of the meeting, during the period reserved for public comments. Said total period for public comments shall not exceed forty-five (45) minutes, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. A three minute limitation shall apply to each member of the public, unless such time limit is extended by the Mayor and Common Council/Community Development Commission. No member of the public shall be permitted to "share" his/her three minutes with any other member of the public. The Mayor and Common Council/Community Development Commission may refer any item raised by the public to staff, or to any commission, board, bureau, or committee for appropriate action or have the item placed on the next agenda of the Mayor and Common Council/Community Development Commission. However, no other action shall be taken nor discussion held by the Mayor and Common Council/Community Development Commission on any item which does not appear on the agenda unless the action is otherwise authorized in accordance with the provisions of subdivision (b) of Section 54954.2 of the Government Code.
