M/CC Meeting Date: June 30, 2010 Synopsis of Previous Council Action: On February 17, 2009, the Mayor and Common Council approved a Side Letter to Resolution No. 2005-75 for full-time, non-safety, General Unit employees (Resolution No. 2009-33); Side Letter to Resolution No. 2007-343 for full-time, non-safety, Middle Management Unit employees (Resolution No. 2009-34); and Resolution No. 2009-35, which amended Resolution No. 2007- 345 between the City and Management/Confidential non-safety employees. On April 6, 2009, the Mayor and Common Council approved a Side Letter to Resolution No. 2005-75 for full-time, non-safety, General Unit employees (Resolution No. 2009-68); Side Letter to Resolution No. 2007-343 for full-time, non-safety, Middle Management Unit employees (Resolution No. 2009-69); and Resolution No. 2009-71 which amended Resolution No. 2007- 345 between the City and Management/Confidential Fire Safety Management employees. Recommended Motion: 1) Adopt resolution; 2) Authorize the City Manager to continue a 36-hour reduced work week and commensurate Friday closure of City Hall through Augus 31, 2010. Description) Finance: Council Notes: 1�1es0 Agenda Item No. (030 /G CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect• Resolution authorizing a 60-day extension of the Side Letters/Resolutions for the Middle Management, Management/Confidential and Fire Management bargaining units, and a 30-day extension of the Side Letters for the General Unit. Background: On June 30, 2010, the current 10% concession Side Letter agreement(s) will expire for the General Unit, Middle Management Unit, Management/Confidential and Fire Management. All parties recognize the current budget deficit and have agreed to extend their respective Side Letter agreement(s) to provide an opportunity for all parties to review proposals, counter proposals and reach agreement. The affected resolution numbers are as follows: ➢ General Unit: No. 2009-33 and No. 2009-68 ➢ Middle Management Unit: No. 2009-34 and No. 2009-69 ➢ Management/Confidential Unit: No. 2009-35 ➢ Fire Management Unit: No. 2009-71 Middle Management, Management/Confidential and Fire Management have agreed to a 60-day extension, until August 31, 2010. The General Unit has agreed to a 30-day extension, until July 31, 2010. The Human Resources Department recommends that the Mayor and Common Council adopt the attached Resolution. Financial Impact: General Fund savings total $477,950; a breakdown by each respective bargaining unit is as follows: General Unit: $163,050 Middle Management: $ 90,400 Management/Confidential: $207,500 Fire Management: 17,000 Total: $477,950 Recommendation: 1) Adopt resolution; 2) Authorize the City Manager to continue a 36-hour reduced workweek and commensurate Friday closure of City Hall through August 31, 2010. COPY 1 RESOLUTION NO. 2 RESOLUTION AUTHORIZING EXTENSION OF SIDE LETTERS/RESOLUTIONS FOR 3 THE GENERAL, MIDDLE MANAGEMENT, MANAGEMENT/CONFIDENTIAL AND FIRE MANAGEMENT BARGAINING UNITS. 4 5 WHEREAS, General Unit, Middle Management Unit, Management/Confidential and Fire 6 Management entered into Side Letters to provide a 10% salary reduction administered through a 7 36-hour reduced work week; 8 WHEREAS, pursuant to these Side Letters, the aforesaid employee concessions were to 9 10 expire on June 30, 2010; I I WHEREAS, the City is in contract negotiations with these employee groups and desires to 12 continue the aforesaid concessions; 13 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 14 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 15 SECTION 1: The City Manager of the City of San Bernardino and the Director of Human 16 Resources are hereby authorized and directed on behalf of the City to extend the termination dates 17 18 of the following Side Letters/Resolutions from June 30, 2010 to August 31, 2010: 19 Middle Management Unit—Side Letter/Resolution Nos. 2009-34 and 2009-69; 20 Management/Confidential Unit—Resolution No. 2009-35; 21 Fire Management Unit—Resolution No. 2009-71. 22 SECTION 2: The City Manager of the City of San Bernardino and the Director of Human 23 Resources are hereby authorized and directed on behalf of the City to extend the termination dates 24 25 of the following Side Letters from June 30, 2010 to July 31, 2010: 26 General Unit— Side Letter/Resolution Nos. 2009-33 and 2009-68 27 28 I RESOLUTION AUTHORIZING EXTENSION OF SIDE LETTERS/RESOLUTIONS FOR THE GENERAL, MIDDLE MANAGEMENT, MANAGEMENT/CONFIDENTIAL AND 2 FIRE MANAGEMENT BARGAINING UNITS. 3 4 SECTION 3: Side Letters executed by the affected employee groups reflecting the 5 extension of the above-mentioned termination dates are attached hereto and incorporated herein, 6 marked as Exhibits A, B, C and D. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I RESOLUTION AUTHORIZING EXTENSION OF SIDE LETTERS/RESOLUTIONS FOR THE GENERAL, MIDDLE MANAGEMENT, MANAGEMENTICONFIDENTIAL AND 2 FIRE MANAGEMENT BARGAINING UNITS. 3 I HEREBY CERTIFY that the foregoing resolution was duly adopted by the Mayor and 4 Common Council of the City of San Bernardino at a meeting thereof, held 5 on the day of 2010,by the following vote, to wit: 6 7 Council Members Aves Nays Abstain Absent 8 MARQUEZ 9 DESJARDINS 10 BRINKER 11 SHORETT 12 KELLEY 13 JOHNSON 14 15 MC CAMMACK 16 17 City Clerk 18 The foregoing resolution is hereby approved this day of 2010. 19 20 Patrick J.
