Synopsis of Previous Council Action: 03/03/14 Resolution 2014-49, California Office of Traffic Safety - STEP grant, approved by Council 01/07/13 Resolution 2013-1, California Office of Traffic Safety - STEP grant, approved by Council 04/10/12 Resolution 2012-67, California Office of Traffic Safety - STEP grant, approved by Council Background: The California Office of Traffic Safety (OTS) is awarding grant funds for their Selective Traffic Enforcement Program (STEP) grant, using best-practice strategies shown to reduce traffic collisions and gain favorable media coverage. OTS funding is based on the federal fiscal year beginning October 1, 2015. The grant application requesting overtime reimbursement will become operational on October 1, 2015, and ends I Inrlatarl• 1/1a/gn1r, by(',cnrncnnn Y_'ini" I-lo o I Packet Pa. 394 5.1 3642 September 30, 2016. The grant application must be received in the OTS office or postmarked by January 31, 2015. The San Bernardino Police Department has been awarded and has administered similar grants over many years. Like the 2014-2015 STEP grant, all traffic events will be combined under one grant, titled STEP grant, rather than dividing events under different grants as was done in 2013-2014 and years prior. The police department will use STEP grant funds, if awarded, to reimburse overtime expended strategies such as DUI/CDL checkpoints, and DUI saturation patrols. This program will also develop a "Hot Sheet" program to notify patrol and traffic officers to be on the lookout for identified repeat DUI offenders with suspended or revoked licenses as a result of DUI convictions. There will also be enforcement patrols focused on motorcycle DUI enforcement, traffic enforcement, distracted driving enforcement, motorcycle enforcement, Nighttime seatbelt/child restraint seat violations, and bicycle/pedestrian safety enforcement operations. Each of these traffic operations will be conducted in an attempt to make the streets of San Bernardino safer for all pedestrians and motorists. The STEP program will seek voluntary compliance of traffic laws by generating publicity throughout the one-year grant period. OTS will cover all costs associated with overtime for enforcement programs for the full 12-month grant period. After conducting an evaluation of available resources and developing a deployment strategy during this period, the police department has requested funding to conduct 12 DUI/CDL checkpoints, 35 DUI saturation patrols, 4 motorcycle DUI saturation patrols, 4 traffic enforcement operations, 3 distracted driving enforcement operations, 3 motorcycle safety enforcement operations, 4 nighttime Click- It-or-Ticket operations, 12 bicycle and/or pedestrian safety enforcement operations and 2 educational presentations impacting 50 or more community members. We are asking that approximately 8-10 officers be funded for each event, which puts that many more police officers on our streets increasing visibility of patrol cars in our neighborhoods. The police department is also requesting that OTS cover the costs of grant related phlebotomy services, and other supplies to include: a truck or cargo style van to be used for traffic call-outs, three PAS (Preliminary Alcohol Screening) devices and supplies, a vital signs monitor with printer, and an infrared temporal scan thermometer. We are requesting $142,150.00 in funding to purchase equipment and services. Overtime funding will include supervisor, detective, officer, and clerical positions for a total cost of$560,458. Staffing varies depending on the enforcement detail being worked. There is no matching fund requirement for this grant. See Exhibit "A" for goals and objectives and budget sections of the grant application describing the agreement and allotted funds. This item is scheduled to be heard by the Grant Ad Hocs Committee in January and will be forwarded to full Council upon recommendation from the Grants Committee Chairman. PROBLEM STATEMENT a CL Q The City of San Bernardino has been on a steady financial decline since 2010. Every year since then we have experienced more and more cuts in programs and personnel. In 2012, the City of San Bernardino filed for bankruptcy protection. Since that time our City has been struggling to balance o the budget and come up with a plan of adjustment,which has not been an easy feat in this very LO difficult financial climate. As a result of these problems, staffing throughout the City of San o Bernardino has been reduced drastically. Not only have positions been cut but many employees N have chosen to leave their employment with the City of San Bernardino to go to other employment Q where they have more stability. t In December 2012, the police department staffed slightly over 300 sworn personnel. Today, late w December 2014, the police department has only about 230 sworn personnel. This is a cut of approximately 23%of our sworn personnel. The traffic unit within the police department has been E reduced to I sergeant, 1 detective, 5 officers, I community service officer II, 1 administrative assistant, 3 senior office assistants, and 2 parking enforcement officers. Q Unfortunately, our traffic unit is short on traffic officers because we are unable to pull officers out of patrol assignments to put them in this specialty assignment as they are needed to handle regular calls for service. With a lower number of traffic officers, there is much less time during the officer's regular shift to dedicate to proactive traffic enforcement. This is where the grant monies , ** that we have been awarded by the Office of Traffic Safety has been extremely beneficial to the residents and visitors of San Bernardino. Grant monies put more officers on our streets enforcing traffic laws and educating the public. i Packet Pg.401 STATE OF CALIFORNIA • OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (Rev. 10/14) C, Even though our sworn staffing has taken a substantial cut, San Bernardino Police officers continue to arrest impaired drivers. In 2013, the number of DUI drivers arrested increased to 310 from the 298 arrests made in 2012. In 2014,that number increased again as our officers arrested 435 (Jan- Nov) suspected DUI drivers. This is an increase of almost 29% in DUI arrests in an 11-month time period. Even with a decreased amount of pro-active enforcement time, excluding our grant funded events, our traffic and patrol officers are committed to taking impaired drivers off the streets as seen by our increased stats. The traffic detective and each of the five (5) officers assigned to the traffic unit have successfully earned their "23152" pin in 2014 as they all have 25 or more DUI arrests for r the year. v As of December 23, 2014,the San Bernardino Police Department has had to investigate 28 fatal Ui traffic collisions with 29 deaths on our city streets. This is the highest number of fatal collisions N Cn that we have seen on the streets of San Bernardino in over 20 years. Many of these collisions were investigated by our traffic personnel, many times during their scheduled time off. Although alcohol or drugs were confirmed to be a factor in only 7 of these collisions, 14 were or will be sent to the N San Bernardino County District Attorney's Office for review and possible manslaughter or murder LO filings due to negligence on the part of at least one of the involved drivers. These investigations are N time consuming and take the traffic officers off the street for a substantial amount of time, which N also adds to the decrease in our proactive time to enforce traffic laws. M Our city has seen a major influx in auto/pedestrian traffic collisions during this past year. 13 of the o 27 fatal collisions that we investigated in 2014 resulted in the deaths of pedestrians, some of which cc were not on the roadway when they were struck by vehicles. The grant monies that we are awarded Q by OTS will allow our officers to do more enforcement and education on pedestrian safety. Q Y A. PROPOSEI}SOLU'CIfliV A. Strategies: The San Bernardino Police Department will deploy officers during each grant event that are knowledgeable in traffic enforcement. The department will only deploy those motivated to seek out offenders in an attempt to make the streets safer for motorists as well as pedestrians. We will research our department stats ahead of time in an attempt to deploy in the area that has the L higher number of collisions, injuries, and DUIs. a. W The traffic detective will participate in these events as well and will work to ensure prosecution N of the violators, especially those arrested for DUI. We will ensure that most of the officers o working these events have the proper training so that he/she will easily detect and affect the arrest of all of the impaired drivers that they locate on the streets. N LO We will schedule the events during times when there is likely to be more traffic related to the N particular event. DUI events will generally be scheduled on Friday or Saturday nights, as these N are the nights we more commonly see impaired drivers while the traffic enforcement details will IV generally be scheduled for week days when traffic is heavier. c 0 The San Bernardino Police Department will participate in all traffic enforcement campaigns to include Click-It-or-Ticket and Distractive Driver campaigns. During these campaigns all Q department officers will be encouraged to enforce these important vehicle codes as well in an Q attempt to lower the number of traffic collisions that we experience in our city. c L We will use our department's Facebook and Twitter accounts to add to the advertisement of these events, which will notify the media and others immediately when an event is occurring as N well as the results of the event. 0 N B. Agency Qualifications: Q The San Bernardino Police Department has been awarded many grants from OTS in years past and has managed them as required each grant year, leaving few funds unclaimed. This will be x the traffic sergeants 41h consecutive year in this position, and she will be assigned as the w department's grant coordinator for the 3rd consecutive year. Because she has had this a responsibility in years past, she has a good understanding as to what the requirements are and has developed a great working relationship with OTS personnel. As the grant manager, the 2 traffic sergeant also works most grant events so that she can oversee the work being done and Q assure that everything is being done in accordance with the law and the rules of the grant. When the traffic sergeant is unable to work an event, she verifies that the sergeant working the event is briefed on the expectations and rules of the grant. The traffic sergeant has attended the Checkpoint Management course 2 different years and has facilitated all of the motorcycle officers attendance in this class as well. Each of the motorcycle officers in our traffic unit has attended SFST and ARIDE training. We also have 1 traffic officer that is DRE certified, with plans to send a 2nd officer to DRE school in 3 Packet Pg.403 STATE OF CALIFORNIA•OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (Rev. 10,"14) January. 3 of our officers are certified child safety seat technicians, which is useful for Click-It- or Ticket events. All of the officers assigned to the traffic unit like working our OTS grant events so they are always easy to staff and our staffed with well-trained officers. The fiscal portion of the grant is handled through a finance manager at the police department then reported through a fiscal representative from San Bernardino City Finance Department. Each of these ladies is experienced with the OTS grants as well as many other grants that the San Bernardino Police Department also manages. They both handled the fiscal portion of our OTS grants in the 2013-2014 fiscal year, which resulted in excellent reviews from our OTS L coordinator during our grant performance reviews. a. w The San Bernardino Police F,xplorer Unit, which is a group of volunteer youths assists in our W Cn checkpoint activities as do many Citizen Patrol Volunteers. These volunteers have to successfully complete a background check, which is done by the police department's Personnel and Training Unit, prior to being appointed to their position. They are also closely supervised at N each of the grant activities by the supervisor on scene. 0 N C. Program Sustainability: N �o This OTS traffic grant funds overtime and equipment expenses only. If funding is removed it will have a catastrophic impact on our agency. There is no additional funding source for this o program at our law enforcement agency. In addition, the supervisor will be responsible to choose checkpoint locations, as required by law and will monitor traffic through the checkpoints to verify that motorists are getting through the checkpoint in a reasonable amount of time. The detective/corporal assigned to work each grant event will patrol the streets looking for violations relevant to the event being worked and will also be present to assist with any additional paperwork needed for successful prosecution of each case. The detective will be responsible to L send all in-custody reports to the district attorney's office and will be responsible to handle any follow-up work as requested by the district attorney's office during his normal working hours, not LU on grant funded overtime. cn Cn Police officers working each grant event will patrol the streets looking for impaired drivers or other traffic violators. They will be responsible to contact drivers, conduct investigations, and complete N all appropriate paperwork, whether that is as little as a citation, an arrest or investigation. Each ,r', officer will record his/her own stats and will report these stats to the supervisor working the event N at the end of his/her shift. EQUIPMENT(551000 OR MORE PER UNIT) LO 0 N Traffic investigation call-out truck -$130,000. The San Bernardino Police Department has been tasked with investigating 29 fatal traffic collisions and many more major-injury collisions in the � 2014 calendar year, 14 of which were sent over to the San Bernardino County District Attorney's Office for review and possible prosecution of the at-fault driver. This is the highest number of fatal c collisions occurring in our jurisdiction in over 20 years. Because our department does not have a vehicle designed for and dedicated to traffic investigation Q most of the equipment needed for these investigations is stored in the traffic office in the police c department. This delays the response of our traffic investigators when they are responding to fatal 0 or major injury traffic collision scenes because they have to gather all of the equipment and load it into a patrol unit before driving to the scene. N LO The San Bernardino Police Department will be purchasing a new robotic total station in January N 2015 from funds awarded to our agency in our current OTS STEP grant, and we own several glo- bug lights and generators. We use this equipment and much more while investigating fatal traffic Q collisions. We would like to purchase a utility style truck or large cargo van that will be dedicated to the traffic unit to be used when investigating fatal and major-injury traffic collisions. Our hope w is to purchase something with locking cabinets so that our equipment can be left inside the vehicle while remaining secure. We would like a vehicle with a work station on the interior so that our traffic Reconstructionist will have a place to interview involved parties and conduct other work t while on the scene of a collision. We plan to equip this vehicle with a mount on the exterior that a will hold a glo-bug light which can be plugged into a generator to offer investigators light during darkness. This vehicle will also carry things such as an accident curtain, spare lime colored traffic safety vests, flashlights, road flares, traffic cones, misc. tools, extra batteries, battery chargers and other equipment needed to frilly investigate traffic collisions. If the budget allows, we would also like to equip our truck with an exterior awning so as to provide shade on sunny days. This vehicle will likely remain painted all white, while having a San Bernardino Police logo displayed on both doors. OTHER DIRECT COSTS Phlebotomist—To draw and collect blood samples from suspected DUI drivers on scene as evidence in support of DUI convictions in a court of law. OTS funds will not be used for"testing" of the evidence. The majority of our DUI suspects chose to provide a blood sample when they are arrested for DUI, which gets very costly. c� a Office Supplies—Used for standard office supplies to support grant related activities, grant W F- monitoring and reporting. Costs may include paper, toner, ink cartridges, CDs/DVDs and desk top Cn supplies such as pens, pencils, binders, folders, flip charts, easels and clips. o PAS (Preliminary Alcohol Screening) devices and supplies—To be used in the field to detect N impaired drivers. These will be used at all grant funded DUI/CDL checkpoints, and saturation Ln patrols. Along with the PAS devices,we will purchase gas necessary for calibrating the devices N and mouthpieces used with the device. This money will fund 3 PAS devices along with the N necessary accessories such as carrying cases, warranty, and mouth pieces. Each PAS device costs M approximately $425 each. We have purchased several PAS devices over the past couple of years, which are assigned to and being utilized by the officers assigned to traffic. If we are granted o monies to purchase additional PAS devices,we will assign them to patrol officers so that they will be available to field officers when the traffic officers are not on shift. The PAS devices that were Q assigned to patrol are old and not operating properly so they have been put out of service. I have consulted with a representative from Intoximeter, the company from which we purchase our PAS devices and they have advised that our old devices are no longer worth trying to repair as it is less expensive to buy new devices due to their age, 0 N 1 Vital Signs Monitor with Printer—This piece of equipment will be used by our officers that are certified drug recognition experts (DRE). We currently have 3 officers certified as DREs, with a N 4ch one scheduled to attend training in January 2015. 2 of these 4 DREs are assigned as motorcycle a officers in the traffic unit and work most if not all of our OTS grant events. The Vital Signs monitor provides all of the essential features needed for most patient monitoring and is hospital s grade and would simplify the three sets of vital signs that must be collected during each DRE w exam. The results can be printed and attached to the CHP DRE form if we desire. Non-invasive blood pressure monitoring is medically accepted everywhere. The device is small and portable (no rack required to hold it). r 1 Infrared Temporal Scan Thermometer—This piece of equipment will be used by our officers a that are certified drug recognition experts (DRE). We currently have 3 officers certified as DREs, with a 4th one scheduled to attend training in January 2015. 2 of these 4 DREs are assigned as motorcycle officers in the traffic unit and work most if not all of our OTS grant events. DRE exams require obtaining the subject's temperature. An oral thermometer is a simple tool but it has to be put in the subject's mouth.
