The petitioner has paid the total processing fee of $2,000. Motion: Adopt the Resolution. Synopsis of Previous Council Action: None. Background: An application was received by Frontier Communities, the owner/developer of the Colony 22 project, requesting the vacation of a portion of a Public Utility Easement (PUE) that was dedicated to the City within their Tract No. 17699, generally located northwesterly of Campus Parkway. The PUE within the tract branches out into each driveway of the anticipated homes for the utility companies to connect at their service points. Frontier has indicated that the layout of one of the homes within the tract has changed and the existing PUE currently lies within the footprint of a home. The tract will be a newly constructed residential development, and there is no apparent future need for this portion of the PUE as a home is anticipated to be built over this proposed vacation area. Pursuant to Section 8333 of the Streets and Highways Code, the legislative body of a local agency may summarily vacate a public service easement in any of the following cases: (a) The easement has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation. (b) The date of dedication or acquisition is less than five years, and more than one 0 year, immediately preceding the proposed vacation, and the easement was not Updated: 12/18/2014 by Georgeann "Gigi" Hanna C I Packet Pg. 209 5.H 3573 used continuously since that date. (c) The easement has been superseded by relocation, or determined to be excess by the easement holder, and there are no other public facilities located within the easement. On November 6, 2014, all City departments and utility companies were notified by a mailed notice to determine if any conflicts exist with the proposed vacation, and/or if any facilities have been installed at this location. No conflicts and no reservation of easements were requested from any of the notified utility companies. Since there are no facilities in the proposed vacation area and the easement is considered excess, per Section 8333(c) above, this PUE can be summarily vacated. The Mayor and Common Council hereby approves Plan No. 13028, and O C 23 hereby finds and determines that this portion of the PUE on Assessor Parcel Number 0151- 6 24 311-01 as shown on Plan No. 13028, has been superseded by relocation or is excess, and that 25 there are no other public facilities located within the easement; and that based upon these E 26 27 findings and determinations, the said portion of the PUE is hereby summarily vacated, 28 pursuant to Section 8333(c) of the Streets and Highways Code. 1 FPaqkd0dm 211 1 SECTION 3.
