(NHS) Single Family Maintenance Grant Program BACKGROUND In 1998, the Agency contracted with San Bernardino Westside Community Development Corporation (WSCDC) for the implementation of the Single Family Maintenance Program which provided up to $5,000 grants to owner occupants to make necessary repairs to their homes. The Agreement between the Agency and WSCDC has expired and there are no plans to renew the contract at this time. Simultaneously, in 1998 through the present, the Agency also contracted with Neighborhood Housing Services of the Inland Empire, Inc., (NHS) for the administration and oversight of the Mobile Home Handyworker Grant Program. This Program offers up to $5,000 grants to mobile home income eligible owners to improve their living conditions and correct any violations identified under the Mobile Home Park Act, Title 25. Under this contract, NHS is required to coordinate all improvements and inspections conducted on a mobile home unit with the City's Inspection Services Division. The Agency is responsible for paying 50% of the salary of the assigned Mobile Home Inspector to this Program. In the last two years, the Agency has allocated over $400,000 to NHS for this program and the demand will continue to grow as long as the City continues to inspect the 42 parks and identify problems. In 1999, the Agency again contracted with NHS to be responsible for implementing the Agency's Single Family Home Improvement Loan and Beautification Grant Program within the Neighborhood Initiative Program (NIP) seven (7) approved target areas. This program consists of providing up to $25,000, 3% deferred loans for owner occupants, whose incomes do not exceed 120% of the area median income and to provide up to $5,000 in exterior beautification grants (such as landscaping, fencing, and painting). The reason for limiting this program to the NIP Target Areas was to have NHS concentrate and focus their housing efforts in selected Council approved geographic areas and enable them to produce tangible changes in neighborhood perception and quality of life. The program was also intended to augment the Agency's and County's acquisition, rehabilitation and resale (ARR Program) efforts when dealing with HUD inventory. To date, NHS has processed over 25 loan/grant applications within the NIP target areas and has committed in excess of$200,000 of the original$500,000 allocation. CURRENT ISSUE: Despite the fact that the contract between WSCDC and the Agency no longer exists, the fact remains that there continues to be a great demand and need in the community by citizens who cannot access funds from traditional lending institutions due to their limited resources to make needed repairs to their homes outside the NIP target areas. Staff has asked NHS to keep a list of homeowners calling for assistance outside the NIP target areas. To date, they have compiled a list of 81 potential applicants who need help in the area of general repairs, code enforcement and health and safety violations, sewer problems, roofing -------------------------------------------------------------------------------------------------------------------------------------------- GVO:MP:Iag 7-24-00 NHS Single Family Maintenance Grant Program COMMISSION MEETING AGENDA Meeting Date: 07/24/2000 7 Agenda Item Number: /�U Economic Development Agency Staff Report NHS—Single Family Maintenance Grant Program July 14, 2000 Page Number-2- --------------------------------------------------------------------------------------------------------------------- replacement, exterior painting and landscaping, etc. In addition, staff receives inquiries from residents on a daily basis and many residents are referred to the Agency by the City's Code Compliance Department. Code Compliance cites violators daily and a large percentage of the property owners cannot afford to mitigate the violations particularly within the time allotted by Code. Therefore, Code Compliance's efforts would be more effective if they had a program in place that they could refer property owners to. Moreover, the Redevelopment Committee asked staff to insure that any applicants who remained on the WSCDC waiting list would be attended by NHS under the proposed program. That waiting list was provided to the Mayor, Council and NHS via a memorandum dated July 10,2000. Toward this end, Staff is recommending approval of the First Amendment to the September 7, 1999 original Agreement with NHS to allocate an additional sum of$350,000, to offer up to $5,000 grants to owner occupants (income not exceeding 80% of median income) who are in need of general repairs to include but are no limited to: roof repairs or replacement, exterior painting and landscaping, plumbing and electrical work, sewer back ups, replacement and installation of sidewalks, curbs, gutters, etc., - on a citywide basis. (The"Single Family Maintenance Grant Program"). NHS would be entitled to a$100 per grant application processing fee and 15% overhead/administration allowance similar to the percentage they are allowed to charge under the Mobile Home Handyworker Program. This program addition to the original Scope of Work will take the place of the previously administrator WSCDC grant program and compliment the Mobile Home Handyworker Grant Program. It should be noted that this proposed Program will help address the Mayor and Council's concerns expressed at the City Budget Workshop with respect to helping low income homeowners with funds to repair driveways, sidewalks, and sewers. The City budgeted $70,000 from the City's General Fund for a "50150"program for that purpose. However, given the fact that the Agency housing funds can be used for these types of repairs, it was determined by Staff that there were other needed uses for the City funds such as purchasing of cleaning equipment for downtown and additional downtown maintenance. A companion item on the Mayor and Common Council's agenda today addresses this issue. FISCAL IMPACT: The approval of the First Amendment will result in an appropriation and expenditure of$350,000 from the Agency's Redevelopment Housing Fund which is available in the current budget. RECOMMENDATION: That the Community Development Commission adopt the attached Resolution. The Executive Director of the Redevelopment Agency("Agency")is hereby authorized 10 and directed to execute on behalf of said Agency the First Amendment to the Agreement between the Agency and 11 Neighborhood Housing Services of the Inland Empire Inc.,(NHSIE)dated September 7, 1999,in order to allocate 12 the additional sum of$350,000,for a total allocation of$850,000 from the Agency's Low and Moderate Income 13 Housing Fund to NHSIE to add the Citywide Maintenance Grant Program to the Single Family Home Improvement 14 Loan and Beautification Grant Program as per the provisions of the First Amendment to the Agreement,a copy of 15 which is on file with the City Clerk and incorporated herein by reference as though fully set forth at length. 16 SECTION 2. The Executive Director of the Agency is hereby authorized to make minor convections, 17 additions,and clarifications to the Agreement,provided said changes are not substantive in nature,and do not 18 increase the monetary impact to the Agency. 19 SECTION 3. For u oses of satisfying p rp Eying the requirements of Health and Safety Code Section 33413(b),the 20 Commission hereby finds and determines that the Maintenance Grant Program expands and preserves the 21 community's supply of affordable housing with a benefit to such supply equal to fifteen(15)units of affordable 22 housing. The basis of this finding is that the Commission presently estimates that 159 households shall participate 23 in Maintenance Grant Program transactions and that each such household shall have an adjusted household income 24 which is not greater than a low-income household,and accordingly,on average each household which is qualified to 25 participate in the Maintenance Grant Program shall receive$2,000 in rehabilitation assistance(net of amounts 26 payable to NHSIE as administrator of the Maintenance Grant Program). 27 SECTION 4. Pursuant to the terms of Amendment No. i 't 9 this Agreement the Agency has retained the Services of the 10 Consultant to implement the Maintenance Grant Program on 11 city-wide basis. Each transaction as originated an 12 completed by the Consultant under the Maintenance Gran 13 Program shall be a grant transaction between the Agency an' 14 a Qualified Homeowner. The proceeds of each "Program Loan" 15 grant transaction under the Maintenance Grant Program shall 16 not be repayable by the Qualified Homeowner to the Agency; 17 provided that all of the representations and warranties of 18 the Qualified homeowner to the Agency in the Program Loa 19 Application (Maintenance Grant Program) are true an 20 correct. In the case of a Maintenance Program Gran 21 transaction, the use of certain defined terms and word such 22 as "Program Loan" and "Program Loan Documents" accordingly 23 refer to the special underlying grant transaction documents 24 evidencing the Maintenance Program Grant between the 25 Qualified Homeowner and the Agency. The first paragraph of Section 3 of the 20 Agreement is hereby amended to read as follows : 21 22 "Section 3. SCOPE OF SERVICES. Consultant agrees to 23 provide the Services to the Agency as set forth herein an 24 as described in the Scope of Services attached as Exhibit 25 "C" for each Program Loan originated under the Program, an SBEO/0001/DOC/4128-1 11 7/19/00 915 jmw I to provide the Services to the Agency as set forth herein 2 and as described in the Scope of Services (Maintenance 3 Grant Program) attached as Exhibit "D" for each Program 4 Loan originated under the Maintenance Grant Program. 5 Promptly following the date of approval of this Agreement 6 (and as amended by Amendment No. 1 to this Agreement) by 7 the governing board of the Agency the Consultant shall. . . " 8 9 Section 11 . Section 5 of the Agreement is hereby amended 10 to read as follows : 11 12 "Section 5 . TERM OF AGREEMENT. This Agreement shall 13 take effect upon approval by the governing board of :the 14 Agency and the complete execution by the parties . Th 15 Agreement, as amended by Amendment No. 1 shall remain in 16 effect through September 30, 2001 . Upon mutual written 17 agreement of the parties in their sole and separate 18 discretion, dated on or before August 1, 2001 , this 19 Agreement may be extended after September 30, 2001, for an 20 additional period of time of up to twelve (12) months . The Agency shal 5 compensate Consultant for the performance of Service 6 relating to the origination of each Program Loan gran 7 transaction under the Maintenance Grant Program in 8 accordance with the following schedule: (i) the sum of 9 $100 for each completed Program Loan Application 10 (Maintenance Grant Program) processed by the 11 Consultant under the Maintenance Grant Program, plus 12 (ii) Fifty Two Thousand Five Hundred Dollars 13 ($52 ,500 .00) , payable in twelve (12) equal monthly 14 installments of $4,375 . 00 each. The amount of 15 compensation payable to the Consultant for Program 16 Loan grant transaction originated under the 17 Maintenance Grant Program is consistent with the 18 Agency' s Mobile Home Handy Worker Grant Program 19 administered by the Consultant on behalf of the 20 Agency. This Grant Program shall be offered to Qualified Homeowners, who are in need of general home repairs which include but are not limited to: Roof replacement, exterior painting, landscaping (automatic sprinklers and grass seed),plumbing, flooring, heating and air system replacements, electrical work, sewer repair or sewer installation,termite repairs, exterior concrete flatwork (such as sidewalks, driveways, curbs, gutters), hand railings, doors, window screens or replacement,tub/shower and toilet repairs or replacement, repair foundation or structural deficiencies, etc. The Maximum Grant Amount the Consultant can expend per Qualified Homeowner and dwelling unit is $5,000. This Grant may be available to a Qualified Homeowner not more than once every five (5) years. This is a Grant to be provided to the Qualified Homeowner and requires no repayment or encumbrance on the real estate. The Consultant shall process Grant Applications on a first come, first serve basis. However, in case of emergency, or life threatening situations, the Consultant may process an application on an urgent basis subject to approval by the Agency Executive Director. The Consultant shall first utilize and exhaust the existing waiting list and continue to add applicants to the list. However, the Consultant shall also offer assistance to Qualified Homeowners who are on the waiting list provided by the Agency from the West Side Community Development Corporation (WSCDC). Upon Consultant determining that the Qualified Homeowner is eligible to participate in the Grant Program, the Consultant will insure that all work performed on the Qualified Homeowner's place of residence are performed by State Licensed Contractors. The Consultant shall be required, whenever feasible, to obtain a minimum of three (3) bids for all work performed. All work performed by Contractors, shall be completed within 45 days from commencement date. From time to time, the Agency and Consultant shall coordinate inspection site visits to insure that the work being performed on a Qualified Homeowners place of residence is being performed in a good workman like manner and in accordance with applicable codes (UBC, UPC, UMC, NEC and health & safety) and City Ordinances. The Consultant shall also require that any Contractor performing work under the Grant Program is licensed to perform business in the City of San Bernardino and has a current license with the State of California Contractor's License Board. "Qualified Homeowner"must be an owner occupant for a minimum period of one (1) year, on a case-by-case basis, and .depending on the circumstances, this requirement may be waived by the Executive Director of the Agency or his/her designee;Applicant must provide evidence of ownership and length of residency. 2. Qualified Homeowner must complete a Grant Application (see Exhibit "E") and meet the applicable income criteria. The applicant's annual income shall not exceed 80% of the median income for San Bernardino County. The Agency shall provide the Consultant with the income limits for each program year. All Qualified Homeowner's must agree to sign a maintenance covenant and agree to live in their home for not less than one (1) year following completion of the work performed under the Grant Program. The Consultant shall maintain accurate records for inspection by the Agency concerning income and program occupancy of all persons obtaining assistances from the Consultant pursuant to this Agreement.
