Fiedler and Patricia J. Tucker for property known as APN' s 0269-081-06 , 07 and 08, San Bernardino, and dedicating the property for Water Department use . BACKGROUND: The United States Environmental Protection Agency (USEPA) has completed a Remediation Investigation Feasibility Study and signed a Record of Decision in March of 1995 for the clean up of the Muscoy Operable Unit . This program was undertaken to clean up contaminants that are in the groundwater within the Bunker Hill Basin. As part of the clean up program, the USEPA will need land for at least five (5) well sites and one treatment plant . The Water Department is the USEPA' s contractor for activities associated with the clean up, pursuant to a Cooperative Agreement between the parties . Specifically, the Water Department is responsible for land acquisition, well design and drilling and pipeline installation. At their regular meeting held July 20 , 1999, the Board of Water Commissioners approved moving forward with the acquisition of this property for the treatment plant . The property is adjacent to our existing 19th Street treatment plant . The property being purchased is north of the existing treatment plant and is vacant . Alternative treatment plant sites were evaluated by the USEPA and the Water Department and this site is the preferred alternative since it is adjacent to an existing site and has the necessary infrastructure to distribute the water into our water system. FINANCIAL IMPACT: None to the City. The Water Department will finance acquisition of the property and the USEPA will reimburse the Water Department for the costs associated with acquisition. RECOMMENDATION: It is recommended that the resolution accepting the Grant Deed for the property known as APN' s 0269-081-06 , 07 and 08, San Bernardino, and dedicating said property for Water Department use, be adopted. TUCKER FOR PROPERTY KNOWN AS APN' S 0269-081-06, 4 07 AND 08, SAN BERNARDINO, AND DEDICATING THE PROPERTY FOR WATER DEPARTMENT USE. 5 6 WHEREAS, the San Bernardino Municipal Water Department is 7 involved in a project to clean up groundwater contamination in 8 the Bunker Hill Basin, in particular the Muscoy Operable Unit; 9 and 10 WHEREAS, the acquisition of APN' s 0269-081-06, 07 and 08, 11 San Bernardino, are necessary for the placement of a treatment 12 plant . 13 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 14 OF SAN BERNARDINO AS FOLLOWS : 15 SECTION 1 . The City of San Bernardino hereby accepts the 16 Grant Deed from Richard R. Fiedler and Patricia J. Tucker for 17 property known as APN' s 0269-081-06 , 07 and 08 , San Bernardino, 18 as set forth in Exhibit "1" attached hereto and incorporated 19 herein by reference as though fully set forth at length herein. 20 SECTION 2 .
