Synopsis of Previous Council Action: 09/07/2010: Resolution of the Mayor and Common Council of the City of San Bernardino Accepting Grant Notice Letters and Approving Scope of CIP Projects: Splash Parks, Community Center Upgrades, Irrigation System Upgrades. Grant funds total $674,614 from the 2002 Resources Bond Act (Proposition 40) for Two Programs: The Roberti-Z'berg-Harris Urban Open Space and Recreation Program and the Per Capita Grant Program. 06/20/2011: Resolution of the Mayor and Common Council of the City of San Bernardino Authorizing the Execution of a Vendor Service Agreement and Issuance of a Purchase Order in the Amount of$416,841 Between the City of San Bernardino and California Commercial Pools for the Construction of Three Splash Pads at Tom Minor, Delmann Heights, and Anne Shirrells Parks and Improvements at Existing City Water Play Facilities per Capital Improvement Program Project PR 10-04. Background: The Parks, Recreation and Community Services Department ("Parks Department") is seeking Council approval to amend a Vendor Services Agreement with California Commercial Pools for the improvement and construction of splash pads at Tom Minor and Anne Shirrells Park. Splash pads at Tom Minor and Anne Shirrells Park are 50-75% complete. However, due to the City's bankruptcy, Departmental financial constraints and vandalism, the splash pads project is incomplete. In 2010, the Parks Department was awarded a block grant for new park improvements Updated: 12/4/2014 by Jolena E. Grider A Packet Pg. 133 3580 which included the splash pads project. The block grant does not provide initial funding for the project; instead, the grant reimburses the grantee for allowable expenditures incurred. Currently, the Parks Department has expended $431,000 on the splash pads project. However, due to the City's bankruptcy litigation, the Parks Department was unable to continue issuance of payment warrants to the original vendor, California Commercial Pnnlc, Ac a result, all construction for the project was suspended. Per the State of California's Department of Parks & Recreation - Office of Grants and Local Services, in order to receive reimbursement for the splash pads, the project must be completed and pass inspection. If the City does not complete the splash pads prior to the March 30, 2014 deadline, the City will incur a State mandated refund in the amount of$346,841. The Parks Department will request a proposal for the following projects: ❑ Repair broken/damaged toys ❑ Repair/replace all valve systems ❑ Provide factory rep to sign off on installation and operation ❑ Provide training on systems and maintenance ❑ Pressure wash/clean toys and concrete The State of California is aware of the City's financial constraints and willing to provide an advance to the City in order to complete the project. Prior to receipt of advanced funding, the City must provide proof of entering a contract with a qualified vendor for completion of the project. Thus, the Parks Department is requesting to amend the current contract with California Commercial Pools for required repairs. The agreement with California Commercial Pools will stipulate that all charges for equipment and services should be applied toward the current project only. Any other past invoices, surcharges or other fees for services should not be applied to the current, mutually agreed compensation for services. We are a current holder of a State of California °B" and "C-53" license. This proposal and scope of work shall be made an attachment to any subsequent contracts or other agreements. The following information will outline our proposed scope of work. All work shall be completed in accordance with the project N plans and specifications using generally accepted construction methods and practices. 0 Anne Shirrells Park a� Tom Minor Park E E 0 SCOPE OF WORK U a U California Commercial Pools (CCP)will repair all water toys installed at Anne Shirrells and Tom Minor Park under the agreement of June 20, 2011 to good working order by April 1, 2015. Below is a brief description and additional detail of items/work included in CD this proposal for both locations. L a� a INCLUSIONS • CCP will repair any broken or damaged toys. This will include providing new parts from > the manufacture that have been lost, stolen, or removed. Items that cannot be replaced 0 will be repaired on-site to the best of our ability based on the conditions. L • CCP will repair as needed and or replace any valves. These parks are designed to run of °a domestic water pressure that is available on-site. We will fix and replace valves and make the proper adjustments so that all systems function properly based on the domestic > pressure provided at each site. o • We have been told that flooding occurs at both splash pads. CCP will install additional drainage to help with the flooding in these grass areas. Z • Many of the toys have been damaged or vandalized which has compromised some of the finishes on the toys. We will repaint or touch-up any of those toys that have been 4) affected. These toys cannot be sent back to the manufacture so these repairs will take Ea place in the field to the best of our ability. • CCP will check and repair all electrical systems and low voltage at Anne Shirrells Park. E There is no electrical at Tom Minor Park. • We have scheduled for the original manufacture to come visit the site upon completion to co review and sign off on our work. This factory sign-off form will be provided to the City of M San Bernardino upon completion. • CCP will provide training to city personnel as well as maintenance procedures. Go • CCP will pressure wash all the concrete and toys. M • CCP will provide new drain covers at the drain locations in the concrete pad. E • CCP will provide a full time supervision and labor to perform this work. Contractor shall prepare the plans and specification and a cost estimate for the work o in conformance with City of San Bernardino standards. c d Plans and specification shall conform to the following design requirements: S 0 a) The plans shall be prepared at a scale of 1 inch = 20 feet on standard 24" by 36" Z sheets,using the City of San Bernardino standard title block. E M b) The plans shall clearly show existin conditions, including but not limited to existing site conditions, utilities and all improvements in the area of the E proposed splash pads, water facilities and existing right-of-way limits. 0 00 LO c) Contractor shall be responsible for survey, related research and other data or work needed to establish existing conditions. 0 0 a d) Contractor shall be responsible for inclusion of provisions in the plans and specifications to assure compliance with the CITY's National Pollutant L Discharge Elimination Program(NPDES). E E e) The Splash Pad plan shall clearly show the location and type of the proposed ci improvements, including but not limited to, details and location of foundation, v reinforcing, utility requirements, grading, including relocation of conflicting utilities, if any. r T r 0 f) All improvements shall be designed in compliance and accordance with the Americans with Disabilities Act(ADA). The project design must be completed within one (1) month after the notice to proceed with design is issued. n00 B. CONSTRUCTION PHASE m E 1. Prior to start of construction, Contractor shall prepare a cost estimate for approval o of the Department of Parks, Recreation and Community Services Deputy Director, v Robert Lennox. ¢ U I 2. Contractor shall submit construction surety consisting of Payment and Faithful r Performance Bonds based on the construction cost estimate and shall conform to c Section 2-4, "CONTRACT BONDS", of the Standard Specifications for Public N Works Construction, 2011 Edition. The contract bonds, including Payment Bond (Material and Labor Bond)and Performance Bond shall be underwritten by a surety E company having a rating in Best's most recent Insurance Guide of"A" or better. Progress payments for construction will be made monthly based on an estimate of the work completed during the preceding month. SELECTION PROCESS i The selection process will be based on a point system and will consist of three phases N as follows: °o n. I. First phase selection shall consist of an evaluation by staff (including the Director and Deputy Director of Parks, Recreation and Community Services, and the Project Manager) of proposals based on the above items identified in E Section IV B (except No. 11). An additional five (5) points will be given to v City of San Bernardino based Contractors. In order to be deemed as "City of v San Bernardino Based Contractor", the company shall have an office with a minimum of one (1) owner or employee doing business inside the City limits and shall possess a City Business License. The three (3) Contractors with the E highest points will continue to the interviews. A maximum of 100 points can be achieved in this phase of the selection process. The three Contractors with the Q highest numerical scores will be invited to continue with the second phase of the selection process. m 2. Second phase of the selection process will consist of staff evaluation of a o presentation by the three Contractors with the highest numerical score from the = first phase selection. The interview will be detailed questions on this specific j project, including, but not limited to, personnel, schedule, project staging, and ° knowledge of the project. Five (5) points of local preference will also be o awarded in this phase of the selection process for Contractors that meet the Z requirements identified in paragraph 1 above. A maximum of 100 points can be achieved in this phase of the selection process. E c w 3. The third and final phase of the selection process will consist of staff submitting a final package to the Mayor and Council for consideration approval. Final 0 scores of the top three Contractors will be submitted to the Mayor and Common 00 Council with a recommendation to award an Agreement for Professional Services to the Contractor with the highest numerical score. However, the c Mayor and Common Council have the prerogative to award an Agreement for a° Professional Services to any of the top three Contractors or reject all proposals. 'v L 4. If the Mayor and Common Council award an Agreement for Professional E Services, the selected Contractor will be required to execute an Agreement for o Professional Services (draft copy attached) and submit proof of insurance v conforming to the attached "Liability/insurance Requirements". Attorneys' Fees. Governing Law. This Agreement shall be governed by and construed under the laws of E the State of California without giving effect to that body of laws pertaining to conflict of laws. Assignment. Consultant shall not voluntarily or by operation of law assign, transfer, E sublet or encumber all or any part of Consultant's interest in this Agreement without City's prior written consent. Any attempted assignment,transfer,subletting or encumbrance shall be void and shall constitute a breach of this Agreement and cause for termination of this Agreement.Regardless of City's consent, no CD subletting or assignment shall release Consultant of Consultant's obligation to perform all other obligations to be performed by Consultant hereunder for the term of this Agreement. in L ° 6.8 Indemnification and Hold Harmless. All findings, reports, documents, information and data including, but not limited to, computer tapes or discs, files and tapes furnished or prepared by Consultant E or any of its subconsultants in the course of performance of this Agreement, shall be and remain the sole E property of City. Consultant agrees that any such documents or information shall not be made available v to any individual or organization without the prior consent of City. Any use of such documents for other v projects not contemplated by this Agreement, and any use of incomplete documents, shall be at the sole risk of City and without liability or legal exposure to Consultant. City shall indemnify and hold harmless Consultant from all claims, damages, losses, and expenses, including attorneys' fees, arising out of or c resulting from City's use of such documents for other projects not contemplated by this Agreement or use of incomplete documents furnished by Consultant. Consultant has been advised and is aware that all reports, documents, information and data including, but not limited to, computer tapes, discs or files furnished or prepared by Consultant, or any of its subconsultants,and provided to City may be subject to public disclosure as required by the California Public Records Act(California Government Code Section 0 6250 et. seq.). Exceptions to public disclosure may be those documents or information that qualify as 0• li trade secrets, as that term is defined in the California Government Code Section 6254.7, and of which Consultant informs City of such trade secret. The City will endeavor to maintain as confidential all E information obtained by it that is designated as a trade secret. The City shall not, in any way,be liable or E responsible for the disclosure of any trade secret including, without limitation,those records so marked if 0 disclosure is deemed to be required by law or by order of the Court. v 6.12. Responsibility for Errors. Consultant shall be responsible for its work and results under this Agreement. Consultant, when requested, shall furnish clarification and/or explanation as may be E required by the City's representative, regarding any services rendered under this Agreement at no (D additional cost to City. In the event that an error or omission attributable to Consultant occurs, then ¢ Consultant shall,at no cost to City,provide all necessary design drawings,estimates and other Consultant professional services necessary to rectify and correct the matter to the sole satisfaction of City and to participate in any meeting required with regard to the correction. Each party shall bear its own costs and fees incurred in the preparation and -E negotiation of this Agreement and in the performance of its obligations hereunder except as expressly provided herein. ¢ 6.16. No Third Party Beneficia!y Rights.
