Financial Impact:
The proposed reclassification will cost approximately $13,900, which is the cost of
benefits for the remainder of the fiscal year, and will be absorbed within the approved
budget for the City Attorney's Office. Future costs related to this reclassification will be
included in the department's budget for FY 2015-16.
Motion: Adopt the Resolution.
Synopsis of Previous Council Action:
This item was originally submitted to the Personnel Committee for review on December
11, 2014; however, this meeting was cancelled. Due to the urgency involved and to
avoid any potential penalties, this item is being brought forth directly for Mayor and
Common Council approval.
Background:
Currently, the City Attorney's Office has two (2) Legal Secretary I (PT) positions (Class
No. 00322): one is currently vacant and the other is being proposed for reclassification
into an already-established, full-time, Legal Secretary I (U) position (Class No. 10322).
The workload of one of the Legal Secretary I (PT) employees was increased to full-time
hours to provide the additional coverage needed to offset a recent vacancy. Both PERS
and the Affordable Care Act impose restrictions on the number of hours a part-time
employee can work within a fiscal year. Exceeding those hours will impose additional
costs and possible penalties on the City.
Since it is foreseeable that the part-time position will exceed the restrictions in place,
and in an effort to be more cost-effective, this office proposes reclassification of one (1)
of the part-time positions to full-time status.
