Synopsis of Previous Council Action:
On August 5, 2013, the Mayor and Common Council adopted Resolution No. 2013-238,
a Resolution of the Mayor and Common Council to appoint specific directors to the Big
Independent Cities Excess Pool (BICEP) Joint Powers Authority.
On March 18, 2013, the Mayor and Common Council adopted Resolution No. 2013-51,
a Resolution of the Mayor and Common Council to appoint specific directors to the Big
Independent Cities Excess Pool (BICEP) Joint Powers Authority.
On January 24, 2013, the Mayor and Common Council adopted Resolution No. 2013-
17, a Resolution of the Mayor and Common Council to appoint specific directors to the
Big Independent Cities Excess Pool (BICEP) Joint Powers Authority.
On June 2, 2008, the Mayor and Common Council adopted Resolution No. 2008-166, a
Resolution of the Mayor and Common Council to appoint specific directors to the Big
Independent Cities Excess Pool (BICEP) Joint Powers Authority.
Background:
The City of San Bernardino purchases excess liability and excess workers'
compensation insurance through BICEP. The Joint Powers Agreement creating BICEP
requires that the City designate a primary and alternate to serve on the Board of
Directors.
On August 5, 2013, the Mayor and Common Council assigned Helen Tran, Human
Resources Division Manager, to serve as the primary representative and Steven
Dokken Safety Officer, to serve as the alternate. Since this Mayor and Common
Council action, several personnel changes have been made. Mr. Dokken is no longer

working as the Safety Officer and Ms. Nita McKay is the Deputy City Manager;
therefore, changes are necessary to the appointments.
The following individuals are qualified to represent the City on the Board of Directors
and various committees:
Nita McKay, Deputy City Manager
Helen Tran, Human Resources Division Manager
Changes to the appointments of primary and alternate are being made to allow both
Helen Tran and Nita McKay the opportunity to retain and assume leadership positions
with BICEP.
The attached Resolution appoints designated individuals as follows:

OF SAN BERNARDINO APPOINTING SPECIFIC DIRECTORS TO THE BIG

NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
5 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
6 WHEREAS, The City of San Bernardino is a member of the Big Independent Cities
7 Excess Pool; and
8 WHEREAS, the City of San Bernardino is a member of the Liability, Property, an
9 Workers' Compensation programs; and =

WHEREAS, the Joint Powers Agreement creating a Big Independent Cities Excess Q

Pool require that a Director be appointed by resolution to the Board of Directors of the a

NOW, THEREFORE, IT IS RESOLVED BY THE MAYOR AND COMMON COUNCIL E

22 SECTION 1. Nita McKay is hereby appointed to serve on the Board of Directors of the
23 Big Independent Cities Excess Pool.
24 SECTION 2. Helen Tran is hereby appointed to serve on the Board of Directors of the
25 Big Independent Cities Excess Pool in the absence of the primary member noted in Section
26 1_
27 SECTION 3. Nita McKay is hereby appointed to serve on the Liability Committee.

16 interests and exercising the authority of the City with respect to the coverage and programs o
17 and voting on behalf of the City on all matters delegated to the Board of Directors and signing a

such amendments as are contemplated to be approved by the Board of Directors under the
18 Liability Risk Coverage Agreement and the Trust Indenture, and such individuals shall keep 0°
19 this Council informed of such matters on a timely basis.
