Recommended Motion: 1. That the public hearing be closed and the Findings of Fact as set forth in the Staff Report from the Director of Development Services, as to why a portion of the North/South Alley North of 201h Street between Guthrie Street and Newcomb Street is no longer necessary for public street purposes,be adopted. Description) Street Vacation Fees Finance: Council Notes: #33 $7/aq aoo0 CITY OF SAN BERNARDINO—REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Public Hearing for 10:00 a.m. and Resolution Ordering Vacation— a portion of the North/South Alley North of 201h Street between Guthrie Street and Newcomb Street. BACKGROUND: On April 17, 2000, staff was authorized to proceed with the proposed vacation and Plan No. 10070 was approved. This request came from the owner of the parcel located along the west side of the area proposed to be vacated. The applicant is in the process of obtaining a 20-foot strip on the east side of the 20 foot alley, which is owned by the Economic Development Agency, to construct off-street parking. City Departments, utility companies, and all adjacent or affected property owners were mailed notification of the proposal, and were given the opportunity to submit comments on any conflicts or to reserve easements. All responses received were favorable. Southern California Gas Company, Southern California Edison and Pacific Bell submitted requests to reserve easements for their existing facilities, which were reserved in the Resolution of Intention and will be reserved in the attached Resolution Ordering Vacation. On June 19, 2000, Resolution of Intention No. 2000-135 was adopted, setting a public hearing for July 24, 2000. Notices were posted along the area proposed for vacation and published in the San Bernardino County Sun newspaper. Adjacent property owners were also notified of the public hearing by mail. There appears to be no further necessity for the area proposed for vacation for street purposes, and we recommend the vacation based on the following facts: 1. The Acting Director of Development Services has determined that the proposed vacation is of no further necessity to the general public. 2. A finding of consistency with the General Plan was made. 3. There have been no objections by any adjoining property owners. 4. All of the City departments and public utility companies were notified of the proposal. Responses were received and no conflicts were noted. Easements across the area to be vacated will be reserved in the Resolution Ordering Vacation for Southern California Edison, Southern California Gas Company and Pacific Bell. FINANCIAL IMPACT: None. The applicant has paid the $1,000 processing fee. RECOMMENDATION: Staff recommends that the public hearing be closed,the Findings of Facts be adopted and that the attached Resolution Ordering Vacation be adopted. 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE 3 VACATION OF A PORTION OF THE NORTH/SOUTH ALLEY NORTH OF 20TH STREET BETWEEN GUTHRIE STREET AND NEWCOMB STREET. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. That the Mayor and Common Council of the City of San Bernardino, 7 8 having heard the evidence offered in relation to the proposed vacation of that certain portion of 9 the North/South alley north of 20`h Street between Guthrie Street and Newcomb Street, described 10 in Resolution of Intention No. 2000-135, hereby find from all of the evidence submitted that such 11 portion of said alley proposed to be vacated by said Resolution is unnecessary for present and 12 prospective street purposes. 13 14 SECTION 2. The Mayor and Common Council of said City do hereby vacate that 15 certain portion of the North/South alley north of 20`h Street between Guthrie Street and Newcomb 16 Street, more fully described as follows: 17 That portion of that certain North/South alley, 20 feet wide, as delineated on the map 18 of Tract No. 6898, in the City of San Bernardino, County of San Bernardino, State of California, as per plat thereof recorded in Book 88 of Maps, Pages 34 & 35, inclusive, 19 Official Records of said County, more particularly described as follows: 20 Beginning at a point at the Southeast corner of Lot 11 of said Tract No. 6898, said 21 point also being the North Line of 20`h Street with a half width of 30 feet; thence East, along said North Line, a distance of 20.00 feet, to the Southwest corner of Lot 32 of 22 said Tract No. 6898; thence North, along the West lines of said Lot 32 and Lots 31 through Lot 23 of said Tract No. 6898, to the Northwest corner of said Lot 23; thence 23 West, a distance of 20 feet, to the Northeast corner of Lot 20 of said Tract No. 6898; 24 thence South, along the East lines of said Lot 20, and Lots 19 through Lot 11 of said Tract No. 6898, to the Point of Beginning. 25 26 Also described in Resolution of Intention No. 2000-135. 27 SECTION 3. Nothing in this Resolution shall in any way affect or disturb any existing 28 easements for public utility purposes belonging either to the City of San Bernardino or to any o, 33 06/26/00 1 7/Z4/� RESOLUTION ORDERING VACATION THAT CERTAIN PORTION OF NORTH/SOUTH ALLEY 1 NORTH OF 20TH STREET BETWEEN GUTHRIE STREET AND NEWCOMB STREET(Plan No. 10070) 2 public utility and there is hereby specifically reserved for Southern California Edison, its 3 successors, heirs and assigns, an easement over the entire area proposed to be vacated, to 4 construct, place, operate, inspect, maintain, repair, replace and remove any overhead or 5 6 underground electrical transmission and/or distribution structure consisting of wires, cables, 7 conduits, poles, pole anchors and guy wires, manhole markers and necessary fixtures and g appurtenances and said easement shall include rights of ingress and egress thereto; and there is 9 hereby specifically reserved for Southern California Gas Company, its successors, heirs and 10 assigns, an easement over the entire area proposed to be vacated, including the right at any time, 11 12 or from time to time, to construct, maintain, operate, replace and renew one or more pipelines or 13 appurtenances for the transportation of natural gas, including the right of ingress and egress 14 thereto; and there is hereby specifically reserved for Pacific Bell, its successors, heirs and 15 assigns, an easement over the entire area proposed to be vacated to construct, place, operate, 16 inspect, maintain, repair and replace underground and overhead structures consisting of wires, 17 18 cables and necessary fixtures and appurtenances and said easement shall include the right of 19 ingress and egress thereto. 20 SECTION 4.
