Description) Finance: Council Notes: 75-0262 Agenda Item No. CITY OF SAN BERV iRDINO - REQUEST -OR COUNCIL ACTION STAFF REPORT REQUEST FOR WAIVER OF FEES IN THE AMOUNT OF $497.50 FOR USE OF STURGES AUDITORIUM BY JAMES ELDER'S ALL-AMERICAN YOUTH FOUNDATION. The James Elder's All-American Youth Foundation, through Executive Director James Elder, is requesting the waiver of fees for the use of Sturges Auditorium on December 7, 1992. The use of the auditorium is for a casting call for a movie based on a book, Attention, written by James Elder, narrating James Elder's tour of duty in the U.S. Army during the Vietnam conflict. Mr. Elder is proposing that he will be able to recruit a major Hollywood studio to produce the movie. Cost for the use of the auditorium is $497. 50. Profits from the movie are proposed to go for payment of a major Hollywood star, scholarships for the youth actors and to purchase land to build a "state of the art, tourist attraction, community center in San Bernardino. " Resolution 91-35 provides for the exemption of fees for non- profit organizations provided that the fees would create a financial hardship that would jeopardize the activity and that the event will be of unusual benefit to the residents of the City. While this use appears to qualify for exemption of fees, the City will be incurring the cost of the rental without any assurance that all of the other necessary elements can be secured to bring this project to fruition. It is recommended therefore, that the waiver be deferred until a letter of assurance can be provided by a Hollywood studio guaranteeing the production of the film.
