Synopsis of Previous Council Action:
-Resolution No. 1999-173 Established the Administrative Fee of$70.00
-Resolution No. 2002-241 Amended Resolution No. 1999-173 to increase the administrative fee
to $ 82.00
-Resolution No. 2003-211 repealed Resolution No. 2002-241 with no change in fee
-Resolution No. 2004-058 repealed Resolution No. 2003-211 with no change in fee
-Resolution No. 2004-252 repealed Resolution No. 2004-058 with no change in fee
-Resolution No. 2005-147 repealed Resolution No. 2004-252 with no change in fee
-Resolution No. 2006-325 repealed Resolution No. 2005-147 with no change in fee
-Resolution No. 2008-149 repealed Resolution No. 2006-325 to increase the administrative fee to
$118.00
Background:
The City Clerk's Office uses the lien process to collect Business Registration fees from rental
properties within the City of San Bernardino. In addition to the Business Registration fees, an
administrative fee is also assessed. The administrative fee is assessed to recover additional costs
incurred by the city to lien parcels of non-responsive businesses and property owners.
In the past, when a lien was satisfied a"Release of Lien"was prepared and mailed to the party
that had shown proof of payment. However, many times this document was not recorded with
the San Bernardino County Recorder's Office and the lien(although satisfied) remained as
record on the affected property. This resulted in the division receiving many inquiries,
particularly from title and escrow companies regarding the status of the lien.

The City Clerk's Office began assessing the fee to record the"Release of Lien"with the San
Bernardino County Recorder's Office through the administrative fee. This allows the fee being
imposed on the City to be collected when the lien is paid and satisfied. This process ensures that
the release is completed by staff upon notice of payment, allowing it to become public record as
soon as possible. While also allowing the city to recover additional fees assessed for placing the
lien.
The request to amend the fee is necessary due to the increase of fees being imposed by the San
Bernardino County Recorder's Office,totaling an additional $7 for the "Release of Lien". The
City Clerk's Office places over 500 liens annually, and would like to avoid having these
additional fees assessed to the City without ensuring we can recover our costs.
