STAFF REPORT
Bids for this project were opened at 2 : 00 p.m. , Tuesday,
10-12--93 .
A total of 16 bids were received, ranging from $98 , 477 to
$189 , 590 . The low bid of $98 . 477 is 55 . 3% under the Engineer' s
Estimate of $220 , 090 .
Below is the total estimated project cost, based upon the
actual low bid price:
Construction Contract $ 98 , 477
Inspection & Administration (W.O. 1514) 25 , 000
Sub-Total $ 123 , 477
Contingencies (15%) ± 18 , 523
TOTAL ESTIMATED PROJECT COST $ 142,000
All costs incurred for this project will be charged to
Account No. 224-365-57734 . An initial allocation of $500 , 000 was
made into this account to fund this work.
We recommend that a contract be awarded to the low
bidder.
URGENCY CLAUSE:
This sewer line construction was requested by area residents who
are experiencing failure of e.->isting septic tanks in the area.
Although plans were to construct utilities with the Orange Show
Road extension, the area residents felt that having the sewer
available sooner will alleviate health concerns on the septic
tanks and systems that may be inadequate at present.

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO CLEARWATER PIPELINE, INC. FOR INSTALLATION OF SEWER
3 MAIN IN PIONEER STREET, BETWEEN WATERMAN AVENUE AND SANTA ANA
RIVER.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1 . Clearwater Pipeline, Inc. is the lowest
7 responsible bidder for: Installation of Sewer in Pioneer Street,
8 between Waterman Avenue and Santa Ana River, per Plan No. 8988 .
9 A contract is awarded accordingly to said bidder for the total
10 amount of $98 , 477 . 10 , but such award shall be effective only upon
11 the contract being fully executed by both parties . All other
12 bids , therefore, are hereby rejected. The Mayor is hereby
13 authorized and directed to execute said contract on behalf of the
14 ( City; a copy of the contract is on file in the office of the City
15 Clerk and incorporated herein by reference as fully as though set
16 forth at length.
17 SECTION 2 . This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements , amendments , -codifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.
24 SECTION 3 . This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.

1 I HEREBY CERTIFY that the foregoing resolution was duly
